BE IT ORDAINED by the Mayor and Alderman of the Town of Clinton, South Carolina, in Coun cil assembled: Section 1: RULES GOVERNING GAS. No person, firm or corpora tion shall install, replace, repair, extend or alter any system or pip ing for the onveyane, distribution or use of illuminating or fuel gas, or construct, repair, replace, install, alter or maintain any gas burning devised connected to any such sys tern of gas piping, in any building or structure in the Town of Clinton and its Police Jurisdiction, other wise than in confarraity with the provisions of £his Ordinance and the Building Code of the Town of Clinton. Section 2: GAS WORK TO CON FORM TO LAWS. It shall be un lawful for any person, firm or cor poration to do, or cause to be done, any of the acts hereinafter prohib ited, or fail, refuse or neglect to do any of the acts hereinafter required to be done or performed. Section 3: WRITTEN APPLICA TION AND PERMIT REQUIRED FOR EACH PIECE OF WORK. No person, firm or corporation shall connect, or cause to be connected, any gas piping or appliance with son fol* whom the work is being 1 done, the name or names of the master gas fitters who are to do the work, the exact location of the premises, by {he number of the lot and block or house, street number or o ther good and sufficient de scription, or the distance, from the side boundary to the nearest street, a clear description of the work, and the number and kind of fix tures. Said application must be on poration in charge of the work, and it shall be thoroulghly covered or securely barricaded from sunset to sunrise and lighted red lamps shall be so placed after dark every night and so maintained as to prevent ac cidents to persons or animals pass ing along the streets or alleys, and the Town of Clinton shall be pro tected and saved harmless from the consequences of afty injury to any person or property due to the blanks which it shall be the duty; execution of the permit issued by of the Gas Inspector to keep in his office for the use of the person de siring same. Section 8. The fee for inspections for all work where a permit is re quired shall be $1.50 for each in spection. No gas piping shall be painted or covered in any way before inspec tion is made and the Gas Inspector has given his approval thereof. After all piping is installed and all outlets capped, the gas fitter shall apply, in the presence of the Gas Inspector, an air pressure' test equal to five (5) pounds air pres sure which shall be maintained for at least ten (10) minutes. This shall constitute the “Roughing-in test” and must be mdae before the meter is set and before any heaters or any appliances of any kind are con nected to the gas piping. When this test is made all piping must be completely installed to the fixture or appliance connection and no part of such piping shall be left not in the Town of Clinton, to any person, firm or corporation, to excavate in any public street or alley. When ever any person or firm making any excavation in the street or al ley flails to refill the same in a proper manner as required by this Ordinance or fails to maintain the same for a period of one year, then the street department shall cause the work to be done and the cost thereof shall be charged against the deposit hereinbefore provided. Any excess dirt, pieces of paving, etc., left on public property at the time the excavation is repaved will be removed by the street department and the cost of same charged against the deposit The same rule shall apply when it becomes nec essary for the Town street depart- stalled. Section 17: ALLOWING ONE’S NAME, LICENSE OR BOND TO BE USED TO OBTAIN PERMIT FRAUDENTLY. No person, firm or corporation engaged in the business of gas fitting in the Town of Clin ton shall allow, his, or their name to be used by any other person, firm or corporation, directly or in directly, to obtain a permit for the construction of any work under his, its or their name, certificate, license or bond, nor shall he, it or they make any misrepresentation or omission in his, its or their returns. Section 18: INFORMATION AS TO NAME, RESIDENCE AND PLACE OF BUSINESS TO BE FURNISHED BY GAS FITTERS. It shall be the duty of every per son, firm or corporation desiring to engage in the gas fitting business in the Town of Clinton, to have his, its or their full name, or names, Town of Clinton, and it shall be his duty to see that such mode or man ner of construction or materials used shall cbnform to the true in tent and meaning of the several provisions of this Ordinance. It shall be the duty of the person, firm or corpora tion responsible for the installation to furnish the gas department with tions without having first filed a written application as hereinafter set forth, and having obtained writ ten permits for such work as re quired in Section 4 hereof from the Town Clerk. It shall be the duty of the Gas In spector to issue a permit to any person, firm or corporation who files with him a written application and complies with the provisions of this Ordinance. Section 4: FEES OR PERMITS; DEPOSITS REQUIRED: For issu ing a gas permit for work in build ings or houses of two fixtures or less, a fee of one dollar and fifty cents ($1.50) shall be paid by the master gas fitter; for houses or buildin&s having jmore than two fixtures a charge of twenty-five cents (25c) extra shall be charged for each additional fixture rough- ed-in or constructed. “Fixture”, as used herein, means each of the fol lowing: Conversion burners, side- arm heater and-or storage tank, au tomatic water storage heater, floor furnaces, gas fired furnaces and boilers, automatic main gas control valves, unit heaters and vented circulator or vented space heater. “Fixture” also includes the follow ing when installed separately ex cept replacements: Automatic pil ots, draf{ hoods, appliance presure regulators and relief valves. The word “fixture” shall also include any other single fixture or appli ance that must be vented to active flue not herein specifically named. To insure the collection of fees for permits, inspections, costs of repair ing paving, or any other expense caused by the failure of the master gas fitter to comply with the gas Ordinance or expense required by law, each person, firm or corpora tion doing gas business in the Town of Clinton, South Carolina, shall pay to the Town Clerk in cash for each permit, inspection fee or any other charges as reported by Gas Inspector and if such persffn, firm or corporation should at any time allow his, its or their account with the Town of Clinton to become in arrears then the Town Clerk shall not issue to such person, firm or corporation any more permits or inspections until he, it or they shall have paid to the Town Clerk all delinquent fees or other charges. Section 5: EXPIRATION OF PERMITS. All permits are good for a continuous performance of work named therein; permits shall auto matically expire when work ceases for a period of ninety (90) days without good and reasonable cause for same; but will naturally ex pire upon completion of work for which it was issued. Section 6: WRITTEN PLAN OR ABSTRACT REQUIRED BEFORE PERMIT IS ISSUED. Before issu ing a permit, a plan, abstract or written explanation showing the name of the owner, occupant or location, the nature of the work agent of the building, and its exact and method of performing same shall be furnished, the Gas Inspect or and receive his approval before a permit is issued for the same, which plan, abstract or written ex planation shall be kept on the job by the one doing the work until the same is finished and accepted, the number of said permit shall be painted on a board not less than 6 inches by 12 inches which shall be ' nailed or otherwise posted in conspicuous place on the job. Section 7: APPLICATION TO BE FILED: CONTENTS OF. Any person, firm or corporation doing busines as a master gas fitter must conform to the following and foregoing rules and regulations of this Ordinance. Before beginning any work, plans or satisfactory written explanation and an appli cation written in ink must be filed with the das Inspector, and must show the name of the owner or owners of the property or the per 1NG DONE: It shall be the duty of the person in charge of any gas work at any premises to maintain in a conspicious place as near the main highway as possible on said premises, and so as to attract the attention of passers on the high way, a metal sign not less than 12 x 8 inches in size, said sign to be painted a bright red color with the full name, or names, residence or residences, and place or places of business, in a book kept for that purpose by the Gas Inspector, and Fitters Examining Board. However, the Gas Inspector is sub ject to call twenty-four (24) hours a day in case of an emergency break down. Section 9: ILLEGAL WORK TO ever any gas construction, altera tion or addition is made to the gas system within any building or res idence, any existing dangerous con ditions shall be brought to the at tention of the owner by the pros pective gas contractor prior to the inspection of the present work be ing done. Any person, firm or cor poration engaged in the gas-fitting business whose work does not con form to the rules and regulations hereafter set out, or whose work manship or materials are of inferior quality shall on notice from the Gas Inspector make* the necessary changes at once in order to remedy the same; if the work has not been so changed after ten days’ notice from the Gas Inspector, the said Gas Inspector shall then refuse to issue any more permits until he, it or they shall have conformed to all the rules and laws applying to said work, or the Gas Inspector shall issue a written order requir ing the Gas Department to discon nect the premises on which such work is installed from the gas main, without further notice. The expense of disconnecting from said gas main shall be charged to the person, firm or corporation who installed such illegal work. It shall on the outside face of the building wall on the street side. Said sign shall be so displayed before the work is started and be so maintain ed until the work is completed. All trucks or passenger cars con verted into trucks used by gas fit ting contractors shall have painted GAS FITTERS LIABILITY INSURANCE. Every person, firm or corporation engaged in the business of gas fit ting and every person doing any work as a gas fitter not in.the em ploy of some other person, firm or corporation carrying such insur ance shall file with the Town of Clinton before doing any work an acceptable liability insurance pol icy with limits of not less than $25,000.00 for bodily injury and BB MMBniBn OR KOTICE FBQM. -hah Aamse, At MX “! There is here by created the Town of Clinton Gas Fitters Examining Board, which Board shall consist of three mem bers to be appointed by, and serve at the pleasure of, the Town Coun cil of the Town of Clinton. One member of such Board shall be the Gas Inspector of the Town of Clin ton, from time to time employed by the Town, and the Gas Inspector shall be the Chairman of said Board. No member of such Board shall receive any compensation for his services on the Board. Meetings of the Board shall be held at such times and places as specified by said Chairman. Section 13: ISSUANCE ANY RE- cease to be in full force and effect it shall be unlawful for any such person, firm or corporation to per form any work of gas fitting in the Town of Clinton until such insur ance is reinstated. Every person, firm or corporation enaged in gas appliance installation and gas fit ting business in the Town of Clin ton upon the effective date of this Ordinance snail file such liability insurance policy with the Town of Clinton before performing any fur ther work of such nature, and here after no licenses shall be issued for gas fitters or gas appliance instal lations until such liability insur ance policy shall have been filed with the Town Clerk. BOND. Every person, firm or corporation spector a notice of appeal, stating specifically the question or ques tions which the applicant desires to have passed upon the Gas Fit ters Examining Board. The deci sions of the Gas Fitters Examining Board shall be subject to review and approval of the Town Council. Any decision rendered by the Town Council is final. , Section 22: DEFINITIONS OF TERMS USED IN THIS ORDI NANCE. MASTER GAS FITTER. A per son who has an established place of business and who either as prin cipal or as the representative of any person, firm or corporation sat isfies the Gas Fitters Examining Board that he is competent and quirements and regulations contain ed in the said pamphlet. Wherever in said pamphlet refernce is made to the “Gas Company", it shall be understood that the reference is to the Gas Department of the Town of Clinton. Section 25: Any person violating the provisions of this Ordinance shall, upon conviction, be sentenced to pay a fine of not more than One Hundred ($100.00) Dollars, or to serve a sentence of not more than thirty (30) days upon the pub lic works of the Town of Ctfhton. Section 26: This Ordinance shall become effective immediately upon its adoption and ratification by the Town Council of the Town of Clin ton. When any gas piping or any ap pliances become defective, it shall be the duty of the owner or agent for the building or dwelling to promptly cause the necessary re pairs required for compliance with the provisions herein. Section 10: EXCAVATION IN STREETS. A permit is required to be taken out for each excavation in a public street or alley before the work is commenced. Work un der said permit to be commenced within forty-eight (48) hours after the issuance of same, otherwise the said permit to become void. Said permits shall be kept at the place of excavation while the work is be ing done and exhibited whenever called for by any person having authority to examine the same, and no more than one-half of said street or alley shall be opened or obstruc ted at one time, and no tunneling will be allowed; no authorized un derground construction shall be in jured or interfered with, and shall be subject to the provisions of these regulations; all portions of! the street excavated shall be put in as good condition as before the ex cavation was made; the trench shall be filled up and thoroughly ram med, and puddled if necessary, within forty-eight (48) hours after making the connection or repairs, the ramming to be done in six inch layers, and all rubbish or other foreign material sh?H be removed within the time designated for the completion of the woj-k, after which the permit shall become void and of no effect. During the execu tion of the work, the trench shall be suitably guarded during the day and a sign placed thereon with the name of the person, firm or cOr- petency, duly issued by the Gas Fitters Examining Board, and whether original or a renewal the Certificate of Competency shall be issued only for the calendar year in which it is issued and dated, and shall be of no force or effect in any subsequent calendar year. Section 14: REVOCATION OF CERTIFICATES. The Gas Fitters Examining Board shall have power to revoke any certificate if, after fair hearing, it be found that actual practice under such certificate has demonstrated to the satisfaction of the Board that the holder thereof does not possess the qualification necessary for issuance of a certifi cate after examination as provided hereinabove, and no revoked cer tificate shall be reinstated within thirty days or without examination. The Board shall have power to sus pend any certificate for a definite period not exceeding sixty days if, after fair hearing, it is determined that the holder has been guilty of any violation of the laws of the City relating to gas installation and construction or of any clearly incompetent or neglectful work manship. Section 15: APPEAL FROM AC TION OF BOARD. Any person feel ing aggrieved by action of the Gas Fitters Examining Board in refus ing to grant a certificate of com petency, or in revoking or suspend ing a certificate already issued, may appeal to the Town Council. Such appeal shall be taken within ten days from thfe date of the ac tion complained of by filing tfith the Board and with the Town Council a notice of appeal, specify ing the grounds thereof. Such bond shall also provide that any person, firm or corporation injured by the breach of any condition thereof may maintain a suit thereon in his, their or its name. Section 20: CITY COUNCIL MAY REQUIRE BONDS TO BE RENEWED. The said bond shall be for the benefit of all persons in jured or aggrieved by any viola tion of, or neglect to observe, the gas fitting laws of the Towp of Qlinton, or the rules and regula tions established under the author ity of laws and Ordinances, and said bonds may be required by the Town Council of the Town of Clin ton to be renewed at intervals of two years, or oftener, if, in the judgment of the Council, the secur ities shall be impaired and at any SEE AND BUY \0V$ND£Eft£ * QUALITY FARM EQUIPMENT •• .at...
