The State cancer control program was inaugurated for these purpos es by an Act of the South Carolina General Assembly June, 1939, and the first clinics were established in 1940.” Directors for the nine clinics are Dr. J. It also works closely with the many groups engaged in cancer control —general practitioners, specialists, medical, dental and nursing socie ties, and the S. C. Division of the American Cancer Society, which carries on an extensive education al, research and service program. Although the opinion said that “membership in activities connected with an organization listed as sub versive obviously might fairly sup port disbelief in hte employee’s loy alty, it asserted: “Yet, in each instance, it rests with the head of the department or agency to make the final and con trolling determination. In this case, involving Kutcher’s loyalty, the vital decision still awaits the administra tor’s decision. "Neither Congress nor the Presi-. dent has seen fit to make member-J ship in any organization disignated by the attorney general cause for Thursday, November 6, 1952 removal from government employ ment. In other words, according to the opinion, the decision to dismiss the employee was not “based upon any declared belief” in his disloyalty, but entirely upon his admission as to membership. Nov. 1. — A government worker, under loyalty regulations may not be i dismissed becaue of the single fact of membership in an organization listed as subsersive by the attorney general. Such a dismissal must, be | | backed by a finding of reasonable 1 ground of disloyalty. The federal court of appeals here made this ruling unanimous recent ly in the case of James Kutcher, 39, a legless, decorated war veteran lately dismissed by the Veterans Ad-, •ministration after he admitted pre-' vious membership in the Socialist Workers’ party, listed as subversive. Appellate Judge James M. Proctor of the appellate court here opined, after Kutcher’s appeal was turned down by a lower court, that Kutch er’s loyalty was the issue, not his membership in the subversive or ganization. He said that laws did not exist prohibiting membership in the organization. ■ * * * However, he added “We do not mean to suggest that membership in activities connected with the desig nated organization may not, in the circumstances of a case, justify dis- belief in the loyalty of an employee.” rT M t ■<9u- HOME LOANS On Terms You Will Welcome The right financing plan will make it easier to meet your monthly mortgage payments—because it will be on terms you can afford.
