I Lieutenant Fowler is charged with acting without authoritv and in reck-; less disregard of probable conse-) quences in sending an armed patrol, to a public highway to look through j all street cars and transfers, and j that he was without authority to j order the search of such vehicles and j cause the death by gun-1 shot wound inflicted bv a bullet fired i * from a service rifle in the hands of f a member of the armed patrol. The lieutenant is charged with violating ?the 96th article of war. Private Roy Sanders is charged f with two counts. The first alleges: j ' "That on or about January 19, 1920,; on the Garner's Ferry road with t malice aforethought, wilfully, deliber- j ately, feloniously, unlawfully and j with premeditation kill one William j S. Chaplin, a human being, by shoot- j ing him with a rifle.''
