The State. Walterboro, March 28.-The grand jury sprung another sensation in court this morning when their pre sentment was read. They were not satisfied with the course taken by the county board of pensions and the so licitor in the pension fraud cases against C. W. Ulmer, P. M. Varn, G. J. Varn, Henry Dubois, alias J. Du bois, alias A. B. Varn, so they handed in the following presentment: "The grand jury were astounded when information reached thim that certain cases, known as pension fraud cases, were nol prossed by the solic itor, but they are aware that such ac tion is in the discretion of the prose cuting officer and that they cannot in terfere with such discretion. He has, however, given his reasons therefor as embodied in the letter from C. G. Henderson, Stobo R. Perry, B. G. Benton, J. T. Polk and W. B. Acker man, M. D. The grand jury are un able to find from such letter that the parties signing the same had any good reason -for their action, which amounts to malfeasance in office. They, therefore, present the above 'namned parties as members of th~e county board of pensions for Colle ton county, who signed such letter, for malfeasance in office and name James E. Peurifoy, H. D. Padgett and L. G. Owens as material witnesses to prove the same. Until a conviction of the original -parties accused of a crime they cannot be presented for compounding a felony. They present C. Yarn, for fraudulent misappro- t~ priation of funds and forgery as al- t -leged in the indictments now of rec ord in this court and nol prossed- I t And name as witnesses those named on back of said indictments and ear nestly urge that new indictments be t prepared against them. At the conclusion of the reading of a this presentment, Judge Dantzler t] took occasion to compliment Solicitor a Jervey on his ability and record as a t< lawyer and solicitor, and to say that t] it was not in his province to appoint 1, an assistant to the solicitor, but that t< he felt Mr. Jervey would do his full duty in the cases referred to. a Solicitor Jervey also stated to the hi court that he had no apology to makep for his action in the case; that the in e2 dictment was brought by the county e board of pensions and he fully in-e tended the cases to come up at thisp term of court until he received the , communication from the said board, et and on their request he nol prossed b< these cases. Varn, who can not be found in the county; and the payment to the clerk of court of the costs of this action (receipt also to be produced) by any one or all of the defendants above other than G. J. Varn, at such time as you may desig nate, that you do now nol pross this case in its entirety, it being our opin ion that the ends of justice will then be sufficiently subserved. D., "Pension Board for Colleton Coun It will be remembered that these parties were charged with falsely ob taining over $400 of the pension mon ey intended for Confederate veterans in the county by forging certain names to false affidavits, which were presented as claims for pensions. Clerk of Court H. D. Padget.t report ad that upon investigation he found that no such parties existed, and he< reported the' above named.-persons in t sonnection with the matter. They vere indicted for conspiracy, and the I ~ase was to have come up at this c ;erm for trial. !he Money Received to Settle Cases. Mr. A. W. Jones, comptroller gen ~ral, yesterday received from the ~lerk of court of Colleton county a ~heck for $423.98 in settlement of the 'pension frauds'' in that county. Mr. [ones was very much surprised to earn that these cases had been set led outside of the court. ''It seems hat all a man has to do these days hen he is caught in any rascality is o pay up and get out of the trouble,'' .e said. Last night when the news came to t he State office in a dispatch from t Valterboro that the grand jury had ebuked the solicitor for entering tl 'nolle prosequi'' on the indictments t gainst these parties, Mr. Jones was mech gratified that there was a grand ary which has the backbone to stand p to its convictions. The solicitor's tion was based on a request from a 2e county board of pensions. Colleton county gets about $7,300 nnually out of the pension fund and iese frauds attempted there last year mounted to nearly 8 per cent of the ei tal for that county. It is singular a iat such a bold attempt at fraudu- I mnt practice should have been at-B ~mpted. The names of persons who are dead,C d some persons who may never ave lived, were recorded on these ension rolls. The fraud was discov ed during the year by the clerk of >urt of Colleton county when he re-0 aived the pension warrants to be! aid to the beneficiaries. This territory was in Solictor Davis' circuit until the 10 circuit act was passed and Colleton, Dorchester and Charleston were plac ed together. It is a little singular that the pen sion frauds tried in the Federal courts of this state have been con fined largely to that section where there have been so many negro "vet erans' of the United States army. These ignorant negroes have been swindled time and again and the peo ple guilty of sharp practice have been caught sometimes and cases tried in the United States court right here in Columbia have resulted in white men being sent to the United States pris on. This sharp practice was indulged in by conniving lawyers and men holding commissions as notaries pub lic. Fag Ends. Coast Seamen's Journal. Many a simulated virtue has lived to plague the simulator.
