E. H. AULL, L2ITOR. UM GENERAL ASSEXBLY. (Editorial Correspondence.) Columbia, January 25.-Now that the elections are over the leg islature can get down to work. There has been a great rush of new bills at this session. A great many bills have been killed and none of very great importance has been passed. The past week was broken into by the elections, which took all of Thursday. There was no ses sion on Monday and Tuesday. Hon. H. H. Evans had easy sail ing for chairman of the board of directors of the dispensary, receiv ing almost two votes to one given his opponent, though Mr. McDer mott, who ran against him, is a most excellent gentleman. The vote stood 99 to 56 in favor of Evans. Mr. W. 0. Tatum, who was elected dispensary commissioner, is an Orangeburg farmer and a member of the legislature. He has long been a warm friend of the dis pensary and is a successful business man. He was elected without op position,-something a little re markable for so good a position, for the pay of this job is exactly what we pay our governor, $3,ooo, and more than the pay of the chief justice of the supreme court. The business of the institution will be safe in the hands of Mr. Tatum. The other members of the board of directors elected are Hon. John Bell Towill, a member of the house from Lexington, and a young man of high character and sterling qual ities of head and heart; and Mr. H. W. Boykin, of Kershaw. Mr. Boykin is a successful farmer and was a candidate for this same posi tion two years ago. These two were elected on the first ballot over two opponents of high character,Mr J. B. Wylie, of Chester, and Hon. R. H. Walker, of Barnwell, a mem ber of the present house. The election of Miss Linne La borde as State librarian over several applicants for the place on the first ballot is a deserved compliment to a most excellent and a most deserv ing young lady. The other elections were held on Thursday evening and there were few candidates. These included trustees of the various colleges and resulted as follows: Members of the board of trustees for the South Carolina College, C. E. Spencer, of Yorkville; Robert P. Hamner, Jr., of Marion. Trustees of Clemson Agricultural College, G. D!lncan Bellinger, of Columbia; Jesse H. Hardin, of Chester; Ivy M. Mauldin, of Pick ens. Trustees oi the State Colored Col lege, zt Orangeburg, A. G. Brice, of Chester; J. W. Floyd, of Ker shaw. Trustees for Wnthrop Normal and Industrial College, D. W. Mc L4aurin, of Marion; Dr. T. A. Craw ford, of Rock Hill. Trustees for the Citadel, Col. C. S. Gadsden, of Charleston; W. W. Lewis, of Yorkville. It issallaistake about Mr. L. A. Sease being legislated out of his office as a trustee of Clemson Col lege. The committee to whom was referred the vacancies to be filled reported three vacancies on the board of the college but no one seemed to know whose terms had expired, except that there was the unexpired term of Mr. Garris, of spartanbnrg, who died the past year. It was also stated that the term of Mr. Jesse, Hardin, of Spartanburg, had expired and he was nominated to succeed himself. The president:of the joint assembly held that a thencmmittee reported three places to be filled, the election could not proceed until three names were presented, whereupon Mr. Mauldin, of Pickens, was nomi nated and the three were voted for. After the ballot had proceeded some one suggested that term of Mr. L. A. Sease. of Newberry. had ex pired. An examination of the journal of the house disclosed that Mr. Sease was elected in 1901, and again in 1902, and as the term is four years it was concluded that the first election was for an unex pired term and the second for a full term, making it expire in 19o6. There should be a record kept in the office of the secretary of State and it would be done if these trus tees were commissioned, though Mr. Sease tells us he has his com mission for four years from 1902. The same thing happened with the trustees of Winthrop, though Senator Tillman was actually left off the board of that institution, whereas in the Clemson matter it seems only one too many was elected. Dr. Crawford has resigned and this will require a new election and it is presumed Senator Tiliman will be elected. There were more candidates for members of the board of penitentray directors than any other office. Mr. D. B. PeuriBy, of Saluf'a, who was one elected, ?s .%nown to many I Newberry people. The other suc cessful candidate was Hon. J. D. Wingo, -ot Greenville, a member of the house. Mr. Kibler has introduced his in surance bill again this year. It passed the house last year but was killed in the senate by a very close vote. Mr. Banks' bill to require school trustees to be freeholders was killed. Mr. Aull has introduced a road bill which has been published in The Herald and News and a bill to provide for rural school libraries. He had prepared a bill on labor con tracts but inasmuch as a bill which was brought over from last year embodied about the same provisions he advocated it. Two bills on this subject have passed the house. They provide as follows: "Section 357. Any laborerwork-. ing on shares of crop, or for wa ges in money, or other valuable consideration, under a verbal or writen contract on farm lands, who shall receive advances, either in money or supplies and, thereafter, wilfully and without just cause fail to perform the reasonable service required of him by the terms of the said contract, shall be liable to pros ecution for a misdemeanor; and, provided, the prosecution shall be commenced within forty days after the alleged violation, and, on con viction, shall be punished by im prisonment of 30 days, or to be fined in the sum of not less than $5,nor more than $roo, in the discretion of the court; provided, the verbal contract herein referred to shall be witnessed by at least two disinterested witnesses; provided, that the contract shall be valid only between the original parties thereto and any attempted transfer or as signment of any rights thereunder shall be null and void.'' "A bill to amend the Crimninal Code (Vol. 2, Code of Laws, 1902), as to Labor contracts. "Be it enacted by the General Assembly of the State of South Carolina: "Section x. That the Criminal Code (Vol.2, Code of Laws, 19o2), be amended by adding after Section 357 a section to be known as Section 357a. to read as follows: "Sec. 357a. That a conviction of either party mxentioned in Sec- 355 and 357 of the Criminal Code (Vol. 2, Code of Laws, 1902), for viola tion of such contract as is mentioned in said sections, shall not operate as a release or discharge of s.ch person from the performance of any part of said contract which is to be performed subsequent to the date of the breach for which such con viction was had : Provided, how ver, that such person shall not be criminally liable for the non-per formance of any obligation due to be erformed during the period of time such person may be under going imprisonment." The question of taxation will be under consideratiou this week There will be several bills before the legislature on tbis most impor tant question and it is difficult at this time to forecast the outcome. A bill has been introduced to provide for a secretary of immigra tion and alsu a bill to provide for an inspector of oils. These with Mr. Kibler's insurance bill would create three new State officers. The estimate submitted by the county supervisor for Newberry provides for a levy of 3Yz mills. The delegation met with Mr. Hunter, clerk, and went over the matter with him. Another meet ing will be held this week when the delegation will decide what the levy shall be.
