And be it further c?iactcd, Tha the Mint of the United Slates, in the cit of Philadelphia, in the State of Pennsyi vania, and the Branch Mint, in the city o New Orleans, in the State of Louisiana and the vaults and safes thereof, respecti vely, shall be places of deposite and safe . .. keeping of the public moneys at thus points respectively; and the Treasurer o . . - the said Mint and Branch Mint respective ly, for the time being, shall have the cus tody and care of all public moneys depc ? sited within the same, and shall perforr all the duties required to be performed b them, in reference to the receipt, safekeep ing, transfer and disbursements of all sue! moneys, according to the provisions liTe inaftcr contained. Snc. 13. And be it further enacted, That n addition to the examinations provided for in the last preceding section, and as a further guard over the public moneys, it shall be the duty of each naval officer and surveyor, as a check upon the rcccivcrjencral ot public moneys, or collector of die customs, of their respective-districts; ">f each register of a land office, as a :heck upon the receiver ol his land office; ind of the director and superintendent of jach Mint and Brunch Mint when separate officers, as a check upon the Treasurers, espectiyely, of the said Mints, or the lersons acting as such, at the close of sach quarter of the year, and as much liore frequently asrihuy shall be directed jy the Secretary of the Treasury to do so, o examine the books, accounts, returns, iud money on hand, of the reeeivcrs-gcn;ral of public money, collectors, rccciv?rs of land offices. Treasurers, and per sons acting as such, anil to make a lull, iccnratc, and faithfui return to the Treasury Department of their condition. Sec. 14. Andbe it further enacted, That he said officers respectively, whose duty t is made by this act to receive, keep, tnd disburse the public moneys, as the iscal agents of the Government, may be lilotvcd any necessary additional expenses or clerks, fireproof chests, or vaults, or ither necessary expenses of safekeeping, ransferring, and disbursing, said moneys: ill such expenses of every character to be irst expressly authorized by the Secretary )f the Treasury, whose directions upon ill the above subjectr, by way of regula,ion and otherwise, so far as authorized >y law, are to be strictly followed by all he said officers. Provided, That the whole lumber of clerks to be appointed by virue of This section of this act, shall not ixceed ten, and that the aggregate compensations of the whole number shall not ixceed eight thousand dollars, nor shall hn rnmtiensaiion of anv one clerk, so appointed, exceed eight hundred dollars ;icr annum. Pec. 15. And be it further enacted, That ;ho Secretary of the Treasury shall, with is much promptitude as the convenience if the public business, and the safety of .he public funds will permit, withdraw the lalunecs remaining with the present depoiitarics of the public .moneys, and confine .he safekeeping, transfer, and disbursenent of those moneys to the depositaries established by this act. Sec. 10. And be it further cnacetd, That ill marshals, district attorneys, and others, laving public money to pay to the United Stales, anil all patentees, wishing to make jaymcnt for patents to be issued, ..may all inch moneys to the Treasurer of the Unit id States, at the Treasury, to the Treauirer of either of the Mints, in Philadelihia or New Orleans, to either of the reicivers-gencrul of public money, or to inch oilier depositary constituted by this id as shall be designated by the Secretay of the Treasury, in other parts of the Jititcd Slates, to receive such payments, khI give receipts or certificates of ilepoitc therefor. Sec. 17. And be it further enacted, That ill officers charged by this act with the safekcccping, transfer, and disbursement if the public nionevs, other than those .-.i -;.i1 nm nnrt,i.i. ;onnccicu wuu me iu:i wu.wt nent, arc hereby required to keep an accurate entry of e^ch sum received, and of lie kind of money in which it is received, ind of each payment or transfer, and ol ,he kind of currency in which ifr fs made; ind that if any one of the said officers, or )f those connected with" tlic^ost Office Department, shall convert to his own use, n any way whatever, or shall use, by ivay of investment, in any kind of properly or merchandise, Or shalJ loan, with 5r without interest, any portion of the public moneys intrusted to him for safekeeping, disbursement, transfer, or for uiy other purpose, every such act shall jc deemed and adjudged to be an cmbez dement of so much of tho said moneys is shall be thus taken, converted, investjd, used, or loaned, which is hereby declared to be a felony, and any officer or igent of the United States, and all persons advising or participating in such act, jeing convicted thereof before any court )f the United States of competent jurisliction, shall be sentenced to imprisonlicnt for a term not less.than six months, nor more than five years, and to a fine equal to the amount of the nioney embez:lcd. And be it further enacted That from and after the thirtieth day o 'June, which will be in the year one thou sand eiglit hundred and forty, the resolu lion of Congress of the thirtieth day o April, in the year one thousand eight hon I dred and sixteen, so far as it authorize! the receipt in payment of duties, taxes sales of public lands, debts, and s'uriis o money, accruing or becoming payable t< the United .Slates, to be collected ant paid in the notes of specie-paying banks shall be 60 modified us that one-fourtl part of all such duties, taxes, sales o public lands, debts, and sums- of moncj accruing or hecoming due to the Unitei States, shall be collected in the legal cur rency of .the United Slates, and fromuu* after the thirtieth day of June, which wil be in the year one thousand eight hundrci and forty one, one other fourt part of al such duties, taxes, sales of public lands debts, and sums of money, shall be co! lected; and that from and after the thirtictl day of June, which will be in the yea one thousand eight hundred and forty-two one other fourth part of all such duties taxes, sales of public lands, debts, am sums of'money, shall be collected; am that from and after the thirtieth day o June, which will be in the year one thou sand eight hundred and forty-three, tin remaining fourth part of the said duties taxes, sales of public lands, debts, an< sums of money, shall be collected in tin legal currency of the United States, an< from and after the last mentioned day, al sums accruing, or becoming payable t< the United States, for duties, taxes, sale of public lands, or other debts, and alsi all sums due for postages, or otherwise, t< the General Post Office Department, shal be paid in gold and silver only. Sf.c. 20. And be it further enacted, Tha from and after the thirtieth day of June which will be in the year one thousani eight hundred and forty-three, every of licer or agent engaged in making disburse mcnts on account of the United Slates, o: of the General Post Office, shall make al payments in gold aad silver cofii only and any receiving or disbursing officer, o agent, who shall neglect, evade, or vio late, the provisions of this and the las preceding section of this act, shall, b] the Secretary of the Treasury, be imme diatejy reported to the President ot th< United States, with the facts of such ne gleet, evasion, or violation, and also t< Congress, if in session, and, if not it session, at the commencement of its ses sion next after the violation takes place. Sec. 21. And be tt farther enacted That no exchange of funds shall be mad< by any disbursing officers, or agents, o the Government, of any g:ade or deno initiation whatever, or connected with am branch of the public sc. vic , other thai an exchange for gold and silver; and cverj i such disbursing officer, when the mean: for his disbursements are furnished to hin in currency legally receivable under th< provisions of this act, shall make his pay ments in the currency so furnished, o when those means are furnished to him it drafts, s: allcause these drafts to he pre sented at their place of payment and pro perly paid according to the jaw, and shal make hi.? payments in the currency so re ceivcd fur the drafts furnished, unless, ii either case, he can exchange the means ii his hands far gold and silver at par, and s< as to facilitate his payments, or otherwisi accommodate the public service and pro mote the circulation of a metalic curren cy; And it shall be, and is hereby made the duty of the head of the proper depart meat immediately to suspend from dut; any disbursing officer who shall violate thi provisions of this section, and forlhwit! to report the name of the officer, or agent to the President, with the fact of thevio lalion and all the circumstances accom panving the same and within the know ledge of the saiil Secretary, to the cn< that such officer, or agent, may be prompt ly removed from office, or restored to hi; trust and the performance of his duties, a; to the President may seem just and pro per. Sec. 22. And be it further enacted That it shall not be lawful for the Sccre taryof the Treasury to make or continui in force, any general order, which shal create any difference between the differcn branches of revenue, as to the funds o medium of payment, in which debts o: dues accruing to the United States may b< paid. Sec. 23. And be it further enacted That it shall be the duty of the Secretary of the Treasury to issue and publish regu lations to enforce the speedy presenlatior of all Government drafts for payment a; the place where payable, and to prescribe fl>r> I! i nr> nrr.nrrli n tr lit ll-.p ilifJV'rrill <1 is I ?- ? - tanccs of the depositaries from the scat ol Government, within which all drafts upon them, respectively, shall be presented fot payment; and, in default of such present lalioh, to direct any oilier mode and place of payment which he may deem proper; but in all those regulations and directions, it shall be the duly of the Secretary of the Treasury, to guard, as far as may be, against those drafts being used or thrown into circulation, as a paper currency, ot medium of exchange. Sec. 2-1. And be it further evaded, That tne receivers-general of public money directed by ibis act to be appointed, shall receive, respectively, the following salaries, per annum, to be paid quarterly, at the Treasury of the United States, to wit: the rcceivtfr-general of public money at New York shall be paid a salary ol four thousand dollars per a'uhum; the fe . :?*l-T-s'/;: ?y^X&Sri'? And be it further enacted, . That the Treasurer of the United States ~ g be, and he is hereby, authorized "to , ceive at the Treasury, and at such oilier -^ J points as he may designate, paymen|8 inv;^iC^ e advance for public lands, the payments' ; :r: J so made, in all cases, to be evidenced.by ] the receipt of the said Treasurer of the ^ ~ 3 United States; which receipts so r shall be receivable for public lands, at any 3 public or private sale of lands, in the v 3 same manner as the currency authorized 1 by law to be received in payment for the public lands: Provided, however, That t the receipts given by the Treasurer of the United States, pursuant to the autho-" : j rity conferred in this section, shall not . ^ . : be negotiable or transferable, by deliye- ? . ry, or assignment, or in any other man- ; r ner whatsoever, but shall, in all cases, be : j presented in payment for lands by or lor . the person to whom the receipt was given, I as shown upon its face. ? * Sec. 20. And be it further enacted,- yv t That for the purchase of sites, and for , the construction of the offices of the re. ceivers-general of public money,-bv this V/*' v~ , act directed to be erected at Charfesion, South Carolina, and at St. Louis, Missouri, j there shall be, and hereby is, approjjria? - .^ 1 ted, to be paid out of any money iii the . Treasury not otherwise appropriated, they^ ^v sum of ten thousand dollars, to be expen-' (led under the direction of the Secretary 2 of the Treasury, who is hereby required r '* f to adopt plans for the said offices, and the vaults and safes connected therewith, and to cause the same to be constructed and prepared for use with as little delay as shall . ^ he consistent with the public interests, and (the convenient location aiid security of ? the buildings to be erected: Provided, .' i however, That if the Secretary, of Treasury shall find npon inquiry and exa- it mination, that suitable .rooms for the use ]"/* o 1 the receiver-general at Charleston can be obtained in the custom-house now owned by the United States at that place, and , that seenre vaults and safes can be con- ^^ slructed in that building for the safefceep-' . ing of the public money, then he shall ' cause such rooms to be prepared and fitted ' up, and such vaults and safes to be con-Y . structed in the custom-house at Charleston, and no independent office shall be there erected. Sec. 27. And be it further enacted, \ That, for the payment of the expenses y authorized by this act, other than those B herein before provided fur, a sufficient ^ sum of money be, and the same is hereby, appropriated, to be paid out .of any ' money in the Treasury not otherwise ap propriated.
