Stewart & Co. vs. Kerrison & Leidiog is a valid and subsisting one, and that they are entitled to be paid out of the proceeds of such of the real estate of the bank? rupts as it was a lien upi a, according to its priority. The Court further BS d: "While the Oonrt refuses to set aside this judgment on aooount of the irregularities complained of, it cauaot refrain from'saying, for the benefit of the profession, that in its judgment a Slea to the jurisdiction of the District ourt at Greenvillo would have been well taken. That Court is not a Cir? cuit Court. Neither the Chief Justice rvf the United States nor the Circuit Judge, who are required by law to bold Circuit Courts, can hold or assist in holding tbo District Conrt for the Wiesteru District of Sonth Carolina. How it happened was not known, as tbey never spoke after being found, and the supposition is that tbey quarreled and shot each other, as their bodies were found abont twenty feet apart.
