A conclusive judgment, whioh subjects only to review by Cougress, was absolutely binding upon idl per? sons, including tho President himself, and. also irrevocable by him, even though be should have subsequently discovered the mistake. O'Couner thiuks it was not, and says no propo? sition is better established than that it is the duty of every court to recall any decision of its owu which it has be oome couvinoed was erroneous. He reviews the case at considerable length, uud says thut the ouly hope is that the independent press may pre? vail on the President to reconsider his coarse. The Herald, in commenting on the above, says: We are so profoundly ooovinued of th* justice of tbe Mu Enery movement, thut we should wel? come any method of reasoning whioh would enable the President to give tho people relief, so sorely needed. There is nothing he could do that would gratify the country so much as the overthrowing of the Kellogg govern? ment. Gen. Emory.?It may interest your readers to learn that Urant's satrap iu New Orleans, Colonel and Brevel Major Gen. W. H. Emory, was a "virulent, and malignant seces? sionist" in the year 1860. Being oi dered to Now Mexico iu the latter part of 1800, or early iu 1861, he left his resignation iu tho hands of his brother, a Murylamier of strong Southern pro olivtties, to be tendered when Mury html should joiu her fortunes with those of tho South. When tho Massa? chusetts troops were attacked in Balti? more, tho brother thought the time hud arrive I, and forwarded tho resigna? tion which was accepted. On Gone rat (then Major) Emory's return to WusLiiugtuu, iu May, 1861, he realized thu fact that bo conhi make a better thing of it for himself by banging on to the army. He accordingly beuiegod President Lincoln, the War Depart? ment, uud every oue eise that he thought could aid bim, and, after eat? ing nu immense amount of "humble pic," the acceptance ot his resignation wi.s reconsidered, and Emory was re? instated in the army. This is the"man who so flippantly styles the best men ol Louisiana "insurgents und anar? chists," because they made a manly effort to regain their liberties. Of such is the kingdom of Grant.
