Hum* ber* and Franklin J. -Moses, Jr., forj breach of trust for fraudulent intent* and grand laroeny: As was expected und predioted, the trial of Franklin J. Moses, Jr., to-day amounted to nothing. The case wan called at 12 o'clook, Moses being rep? resented by E; W. Moise, Elliott and Obamberlain, and Solicitor Euttz ap \ pearlng for tho State. At the opening of the court the crier was ordered'to call Moses, and, no answer being made, tbe Solicitor asked tbe court to sign another bench warrant for his ar? rest. This the court refused to do, saying that it could make no special exception in this cam, as the coart had alreudy made a general order for a bench warrant for all absent defend? ants. Mr. Bnttz then entered formal objections agaiust the oourt allowing auy lawyers to appear for Moses until be oame iuto oourt and acknowledged its jurisdiction. Mr. E. W. Moise, counsel for Moses, then made a motion to have tho case stricken from tbe docket, on the ground that the Go? vernor of a Stute oanuot be indicted and tried without being first im? peached. Mr. Bnttz objected to the oourt entertaining the motion until Moses appeared and was arraigned; but the court decided to hear argument on the point, whereupon M<mso made a long argument iu support of his mo? tion. Solicitor Buttz followed in a long and earnest speech, contending that the Governor of a State was just as much liable to arrest and indictment for felony as auy privato citizen, and urgiug the oourt to vindioute its out? raged dignity aud self-respect by re? fusing to recognize the counsel of Mose.; until he appeared iu court aud parged himself of contempt. Elliott followed in a ioug Bpoech iu support of the motion, contending that the court bad no jurisdiction in the case. After the argument, the court deoided to reserve its decision, and announced that this would work a continuation of the ease until the next term of the court. It is stated bore that under the general orders of the Oourt of Sessious, the Clerk of the Coart will issue a beuch warrant for tbe urrest of Moses. Tho expected motion for a change of venue was not made. During tbe argument the Court House was crowded to its utmost capacity, aud the Solicitor's detiuocia tious of Moses' peculations wero re? ceived with shouts of luughter. After announcing that the decision would be reserved, the Court of Sessions was adjourned for the term. This termi? nation of the aase is regarded as fa? vorable for Moses, whose friends are jubilant this evening. Mr. Buttz says that be has documentary evidence in his possession sufficient to conviot Moses if he can ever bring him to trial; but the prospects of doing so seem, from the present outlook, to be rather slim. The third race was between Major Frazier's grey horse Wild Irishman and the bay'mqre Lady of the Lake, a quarter of a milo dash. The bay came in twenty feet ahead. The fourth race wus between Mr. Bunch MoBee's black mare Mollie Darling and Mr. MoDavid's black horse Teoumseh, a half mile dush, which was won by Mollie Darling.
