Meeting of the City Council. COUNCIL Chamber, OOLTJMBIA, 8. 0., February 24, 1874. Council met at 7.80 P. M. Present? His Honor the Mayor, and Aldermen Carpenter, Lowndes, Mitohell, Carroll, Yonng. Oarr, Williams. Griffin and Oooper. Absent?Aldermen Thompson, H?ge and Taylor. On motion of Alder? man Lowndes, the reading of the mi? nutes of last meeting was dispensed with. petitions and communications. A oommunioation from..A. W. Cutu? rnings was received, asking from tho faculty of the South Carolina University for a sufficient number of lights to bo put in the campus to light the same properly. Ou motion . of Alderman Grifflo, the same was referred to the Committee on Lights. A communication from J. Levin, Treasurer of Columbia Qua Light Com pany, asking payment for their bills for the past year, was, on motion of Alder? man Carpenter, receive 1 as information, and the City Treasurer was ordered to pay the same as soon as possible. The Mayor explained, stating that the Gas Company would have been puid before, but they declined to take city money, and the Treasurer bad no other funds. A communication from the Globo Gas Light Company, of Boston, was re? ceived, stating that they bad shipped fifty barrels naphtha; also,'200 globe gas burners. On motion of Alderman Grif? fin, the same was received as informa? tion. The following, from ^Independent Steam Firo Engine Company, wns re? ceived, and referred to the Committee on Ways and Means, to report at the next regular meeting: Columbia, February 20, 1874. To the 'Honorable Mayor and Aldermen of the city 'of Columbia, 8. C.?Gentle men: The agreement between the Oity Council and the Independent Fire Com pany, in referonoe to the ubo of their hall, expired on the 1st instant. The rent for the ensuing year will bo $300, payable quarterly. . A. .0. SQUIEB, Secretary. The following oommunioation, from George H. In?ruhnm, of Charleston, was read, and, On motion, was received as information: Charleston, February 11, 1874. C. iiarnum, City Treasurer?Sir: I wrote you October 80, about the oity of Columbia bond, No. 61, in possession of Mr. J. T. Wslstnan, executor of bis father, J. Welsman, and then stated be would arrange it. On yesterday, he surrendered mo the bond, boing satis? fied it was the property of the estate of W. P. Ingraham. I will hand it to Col. Pinoknoy, my oo-exeoutor, who will soon go to Columbia and hand it over to yon, as it is yoar property. I regret this matter was not settled long since; but it was no fault of mine, as I have urged it ever since I waa informed he had the bond at first, I- send y on an extract from my cash book, showing when I got these bonds, No. 3, Ac-., and did always collect the interest. This bond is for $500, issued March 21, 1850, and was supposed to have been lost in 1865, when Sherman's army passed through Columbia, and in 1867 a new bond was lesued in lieu of tho sumo, surrendered as aVjfc v? stated. Abe following opinion of J. D.Trade well wns presented by his Honor tho Mayor, who stated that he had n6ked it, as an Alderman of the city hud publicly stated that tho Mayor was at fault for the condition of tho streets and hide walks. On motion of Alderman Griffin, the opinion was reoeived as information, and was ordered to be published: ' Columbia, S. C, Feb. 19. 1874. To Hon. John Alexander, Magor?Sin: In answer to your inquiry, "Whou par? ties arc summoned to have tho tide walks in front of their promises put in order, refuse to do so, und the oiry has . ifo funds to do tho same, and charge it .. to the parties the samo as taxes, what power bus the Mayor iu the premises \ then?" I reply, that the Muyor indi %sfvisually is powerless, and that tho ': power in question is vc?tod iu tho Mayor np4; Aldermen in-Couuoil, both by the Actj of thu General Assembly and tho ordinances of the oity, to which I now v refer yon. Iu tho seventh section of the ? Act of 2d March, 1871, it i8 provided as follows: "And said Mayor and Alder? men shall have power and authority to require all persons owning a lot or lots in said city to olose in and to make and . keep in good repair sidewalks in front of > oKitl-.Iot or lotB, wherever tho same shall fjj|?i\/ or adjoin any public street in said "'fifty, if, in their judgment, such sido watts shall bo necesaury?tho width thereof nnd tho manner of construction tpVbo designated und regulated by the staid Mayor and Aldermen: aud for de? fault or rofusal, ufter reasonable notice, make and keep iu good repair auch ?.^(lewallt, nnd to close in Etioh lot or '/jflpts, tho Mayor and Aldermen may '..?cauao it to ba done, nnd require the " owner to pay tho oust of the work; und - the said Muyor and Aldermen are hereby empowered to nuo for aud- recover the samo by ncticn in any ooni-r, of no tup r tent..jurisdiction: Provided; That tho continot bo lot to thu lowest responsible bidder." [See City Compilation, pogo 78 of Aots.J ..By.the fourth section of un ordinance concerning nuisances, ratified on tho 9th of May, 1871, (p. ii of Compilation of City OrdinuuooB,) it is ordained: Thut nil open cellars or pita, where any houso or houses shall have boon burned or torn dowo, situated near any public f treet, or alley, shall bo ouolosod by the owner by a substantial feuco or railing; nnd iu case tho owucr or owners of any such cellar or pit shall neglect or refuse to do bo, after due notico, tho Chief of Police or any of hid assistants shall cause the eamo to bo enolosod at tho es pensu.of GUoh owner or owners. GO May, 1871, poge 23 of Compilation of City Ordinances, it is ordained: That all owners ot lots in tho city of Colum? bia Bhall ouch repair, mend and keep in order, at his or her own espouse, the sidewalk butting on bis or her lot, ac? cording to suob directions ae the Mayor and Aldermen may, from time to time, give; and any person neglecting or re? fusing to do so, after ton days' notice, Bhall forfeit and pay tho sum of $10 for each nnd every day ho or sho shall or may so refuse or neglect; uud it shall be tho duty of tho Ohiof of Police, after the expiration of said notice, to cuuso said sidewalk to bo leveled or repaired, at tho expense of tho owner of tho ad? joining lot; which expense, when np proved by the Mayor aud Aldermen, shall he collected in tho same manner as tho tax npon reul estate, after ten days' notice to the parly concerned. By a further ordinaueo, at pugo 43 of the Bame compilation, it is ordained: That the owners of properly or lots Bituatod on Riohard30u street, between Upper and Gervais streets, ou wbioh thcro arc no buildings, shall, before tho ?rut day of September, 1871, (printed, by mis? take, 1870.) cause the samo to bo se? curely fenced, tho fences to be suffi? ciently high to pro vent injury to pedes? trians; and when said lots have frontage on side streets, said fences shall extend at least fifty foot from Richardson street. And by the second section it is ordained: If any person or persons owning pro? perty, us above stated, fail to comply with this ordinance, tbo work shall bo done by the city, and the cost of tbo work charged against the owner as taxes, aud collected accordingly. It is thus seen that tho power over tho subject mutter of your inquiry belongs to the Mayor and Aldermen as a body, and not to the Mayor alone, and that it is ample for the purposes contemplated, but thnt it must be exercised in acoordauce with the Act to which I refer you, so far as the cost is to be reimbursed to the city, when the work is done by it, and the work must be done by the lowest re? sponsible bidder; nor can the expense be charged aud be oolleoted as taxes, as the present ordinanee provides, but must be oolleoted by an notion in any Trial Justice's court, if the amount do not exceed 8100. Considering the great im? portance of your inquiries concerning tbo proper jurisdiction over tho.;u por? tions of tho city water work? referred to in your communication to mo, I ask respootfully for further lime for the. pre? paration'of my answer. Alderman Carpenter answered, and argued aguiust tho decision of tho City Attorney, and thought tho matter be? longed to the Mayor, and that he had the power to act; tliut he was in fact tho Council when they wore not in session. If ho hud not the power, they ought to give it to him, or to some one else. His Honor tbo Mayor made some lengthy remarks, us follows: The Mayor stated that Alderm.tu Car? penter had remarked, at a meeting held in the Fourth Ward, that lie (the Mayor) had never enforced tho ''ordinance re? gulating side-Walks." Tho Mayor .stated that Aidurmau L. C. Carpenter's state? ment was false, which bn could prove by tho Chief of Police, who, by hia or? ders, had notified different parlies. Some individuals wore too poor, aud others replied, lot tho city authorities atteud to tho matter with regard to side? walks. The Cily Atioruey given Iiis opinion iu the promises who are tho proper partius to enforco thv ordinance and tho mode ot collecting. The Act of tho Legislature gives the Mayor und Aldermen the power, und not tho Mayor alone. Mr. P. Sabmidt, who owns a lot in the city on Riohardson street, has dug out a ciliar, preparatory to building, nnd has put up a temporary fence on a par! of it. Some citizens having fallen into tho Cavity, I Instructed the Chief of Po? lice to notify Mr. 8. to huvo Ibo same fenced according to HlP ordinance regu? lating the same. Tho Chief of Police informs me thnt he has several times no? tified Mr. Schmidt, who replied that ho would not do it. I thou bad Mr. Schmidt summoned before me, uud gave him until l> o'clock that evening to tiuvo Ibo fsnce < rooted. Ho failed to do tbo samo. I repeat, thai the Alderman's assertions are false. With regard to streets, I will state that Aide: mau Carpenter isscoond ou Urn Com mitteo on Streets, and it iu a part of his duty to seo to them. I nm awnro that the central portion of the city is not iu as good oondition ns it has been. This is owing to the fact that the Chairman of tho Commiltco on Streets bus been opening some new streets on the out? skirts of tho city, so that tho poor muu can rench his homo ns well ns tho rich man, who lives in a central locality. I will hero state that Alderman Carpenter has not done his duty. Some time siuco, the City Council passed a resolu? tion making arrangements with one of our banks to reccivo our city money, ami exchange the snmo for United States currency. Tho Chairman of the Committee on Ways and Moans has failed to mako any report. I havo been awaiting his action. If ho will say that ho cannot attend to the duties of his po? sition, I will do it myself. I never shrink from nuy duty that I nm called upon to do, by day or by night. Alder-, mau Carpenter states that it i3 not bis duty to raise funds for tho city. I will state that wheu W. H. Wigr, Esq., was Chairman of tho Ways aud Means Com? mittee, ho nlways attended to tho duties devolved upon bis position with zeul find alacrity. Tbo Alderman (L. O. Carpenter) is not fit for the position he occupies as Chairman of tho Committee of Ways aud Means. A communication from tha City At? torney was also presented by his Honor the Mayor, as to tho power of tho Mayor and City Council in making repairs nt the distributing reservoir of tho Water Works; also, ns to tho engine house or old Wuter Works, stating that, under the decision of Judge Carpenter, ho did not think the oity had the right or privi? lege to mako repairs, or to in- any way iuterfere; that the city had control of all hydrants, and distributing pipes, but nothing more, as everything bad, by de? cree of the oonrt, been turned over to tho Columbia Water Power Company. It was, therefore, inoumbeut on them to make the necessary repairs. On mo? tion of Alderman Lowndes, tho same was received as information. Tho Mayor stated that, as the Colum? bia Water Power Company did not keep the fenoe in repairs around the distribut? ing reservoir, therefore, ho had ordered the same repaired, and hoped tho Coun? cil would Bustain him in his action. City Ha!!, reported that tho committee had met, and proposed that Mr. Cramer have entire control as to tbu construction of tho hull or theatre, aud asked Council to net. Aldci-mno C.;rr, Chairman of tho Com mittou on Lights, roported to Council that fifty burr- h of tiapthu had arrived, and that be hud stored it ut tho Guard Honst'; but us it was explosive, he thought it bust to build u shed on ?uluc vacant lot. On motion, by Alderman Carpenter, tbn committee wero author' iznd to build the idled proposed ut some suitable point. Alderman Griffin risked as to the office of City Surveyor, and wanted to know who wan responsible; and stated that Mr. Miles had, poluj two years ago, bought a lot, had the tame surveyed by 1>. P. Jackson, Iben City Surveyor, aud built a house on tin* same. The present surveyor had re surveyed tbo same, and took in a portio 1 of tho house on an nd joiuing lot, and Mr. Miles was ordered to move bis house. Ho thought that!
