It will be reoolleoted that about one year ago, a trouble arose be? tween the Wimberlys and Flynns about a horse race. That is, one of the Wim? berlys whipped one of the Flynns at the race, and the next day two of the Flynns, father and son, the former an ex-sheriff, and the latter thou noting sheriff, went to Wimberly'e Uoubo nod shot Wimberly, Wimberly returned the fire and succeed? ed in killing both of them. Blackwell, a son-in-law of Flynn, Sr., then took out letters of administration on his father in-law's estate, andrtha Flynns were op? posed to his selling the property, and shot Black well. , The. - Flynns were ar? rested, and- one of. them; imprisoned, while the other.proved an alibi, bat was shot as he was ooming out of the court house. John Flynn, the last one, broke jail about Christmas, and has been lay? ing around and making trips back and forth to the Indian Nation. On Satur? day last, they heard of his being in the neighborhood, and procured a warrant for nis arrest and went in search of him. They came upon him abont daylight ou last Sunday morning. He draw his weapons and made fight, when the posse fired upon him, shooting him through the body and through the head. # ? m ANOTHER Instance op Profitable Be nevolenoe.?Mr. Ezra Cor nel 1, who gets eredit for a magnificent bequest to found the university which bears his name in the great State of New York, is bring de? spoiled of the small part of his fame by the General Assembly of New York. In a discussion of the "bill entitled an Act to facilitate a settlement between the State of New York and Ezra Cornell," Mr. Cornell, it is stated, manipulated the college land Eorip donated by Con? gress so as to get the fame of establish? ing a great university, and to get wealth by purchasing the land scrip. 400,000 acres of the located land is represented as being worth $60 to $70 per acre; say, $2,500,000. Mr. Cornell gives the Cor? nell University a million und pockets the balance. After vainly endeavoring to get up a laud compauy to buy the laud at $5 per acre?of which company he was to be the chief stockholder and Pre? sident?bo sells tbe land to one McGraw for $4 50 per acre. The Cornell Lmd Company failed; McQrnw grab suc? ceeded. The Mayor stated that it was necessary to have made a plat of the old and new water works in the suit now pending with the Columbia Water Power Com? pany. On motion, the same was ordered prepared. He also stated that the Co? lumbia Water Power Company were col? lecting surface water from several points, and carrying tho same into the reservoir; also, tbat they were using river water, the same not being filtered, as their filtering apparatus had proved n failure The Mayor also stated that tho city I school house needed bracing under the floor, the same being weak and out of order; and stated that the same could be done by city employees by famishing a few pieces of timber. Tbe following resolutions were offered by Alderman Thompson, and, on motion of Alderman H?ge, adopted: Whereas Barhwell street, from Gervais to Plain, is in an impassable condition for the passage in safety of vehicles; therefore, be it Resolved, That the Committee on Streets be authorized and requested to have said street pnt in a better condi? tion at the earliest practicable day. Resolved, That the said oommittee is authorized to employ four hands in addi? tion to the number that is now employed on the streets, if necessary. Alderman Young rose to explain as to tho report made by him at last meeting, in tbe case of Mrs. Butler against the City Physician, saying that he had been misinformed, and, therefore, withdrew all charges or complaints then made, as, upon information, received, he believed; that Dr. Boberts acted right in the mat? ter,'and had done what any other physi? cian would do under the cironmstanoea. He, therefore, wished no reflections cast upon him in consequence of his report, as he was laboring under a misapprehen? sion in the case. The following motion, by Alderman Thompson, was adopted: That the city build a new Hospital, at a cost oot to exceed $3,000. The following motion, by Alderman Lowndes, was unanimously adopted: That the Council confirm the appoint? ment recently made by Mayor Alexander of Charles Mahon as City Surveyor. Motion by Alderman Carroll, that tbe City Surveyor be instrnoted to prepare a diagram of the..old and new water works, was, on being put to a vote, adopted.
