Undismayed hy the growing practice of infringement, whioh disgraced the trade, they kept a large corps of artists in their, employ, whoso business it was to devise new and 'beautiful forms and decorations. These were, as.a general rale, oopied by others, and the Gorham Company resolved to see whether the lew, which had pro? mised them protection, was-adequate to furnish them relief against this great and serious mischief. They have carried on this good fight for art and their rights for six years, unaided save by the moral support of the trade, and the decision of the Supreme Court has at last orowned their courage and endurance with bril linat triumph. ? hoy selected, as ground on whioh tp make their fight, the patent for the design of ?pe well-known .cottage pattern bf spoons and forks. It was an additional griovanoe in this case, that thftopttege. goods were in sil? ver, while the imitation was in base raetaL They proved, by nearly all the leading silversmiths of New York, Phila? delphia, Boston and the West,, that the defendants' goods were so nearly liko the plaintiffs', thatordinarypurchasers would mistake the one for the other. Thoy further showed the great value of their design, whioh was/pronounced by an eminent duale*-'the best pi din. pat tern he had over seen, and which' was estimated by another leading silversmith to be, in hia j idgment, worth? 850,000, at least. ' And they called witnesses in the trado, who narrated occasions - when they hud actually- mistaken one pattern for tho other.; None of theue facts wero denied by tho defendants, who rested their case solely upon the' faat, not controverted by the Gorham' Company, that there were certain differences in the details of the two designs,.whioh expo/ts and per? sons accustomed to look at Bilverware would certainty observe. And the ques? tion was thus- fairly raised whether a pa teat- for a design was infringed if the infringer was clever enough to produoe upon. the eye the same artistic effect, and yet vary from the details shown and described in the patent. The plaintiffs claimed that if, to the eye of the purr chaser, the resemblance was so close that the patterns wero the same, then that, in law, they must be deemed the- same;, while the defendants urged that it was for experts and designers to determine tho identity of the patterns. The cause was beard in Newport in tho summer of 1870, and the viewB of tho defendants ' were sustained by the opinion of the court; This dootrine wont to the root of tho matter. If it wero sound, design patents were of no value, for it is always easy to vary the details of a work of art, and yet preserve the same artistic effect and the same results on the ey? of the observer. To such a rule, the Gorham Company, and, indeed, tho fine arts of the country, could not submit; and thoy, therefore, nppcaled their cause to the Supremo Court, which has just decided it in their favor, and has reversed the doctrine of vbo court below. Tho vnluo of tho doctrine of this de? cision to the artistic progress of the country can pcurcely bo overrated.
