SEOIION 1. Be il ordained, by the Mayor and the Aldermen of the city of Co? lumbia, in Council assembled, That a Board of Health be, and tho same is hereby, established, whioh shall consist of twelve members, to be chosen by bal? lot by the City Council,'at their first meeting in May of each and every year; and said Board shall be so chosen, that three of them shall be elected from Ward No. 1, three from Ward No. 2, three from Ward Mo. 3, and three from Ward No. 4, seven of whom shall constitute a quorum; and if nn'y person so elected a member of the Board of Health, shall refuse or negleot to perform the dutiee hereafter required, he shall, upon con? viction thereof before the City Connoil, forfeit and pay the sam of $45: Provided, That no person shall be compelled to serve more than one year in every three. SEO. 2. Be it further ordained. That the enid Board of Health, of whom seven shall constitute a quorum, Bhall meet at least once a/fortnight from the first day June to the first day of November of each and every year, and at such other times and at such places as they may deem necessary and convenient, for the purpose of receiving and communicat? ing all possible information relative to the health of the city, nnd to advise and consult together respecting the preserva? tion of the same; and shall have full and ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessary to the discharge of the trust hereby confided to them; and eaoh and every practical physician within the city is hereby re? quired to give immediate information of the existence of any contagious or malig? nant diBeaBO to the Board, or to any mem? ber thereof, and at all convenient times to aid and advi?e the said Board in the preservation of the health of the city, and in the preservation or suppression of contagious or malignant diseases. SEO. 3. Be it further ordained. That il Bhall be the duty of each and every member of the said Board to canse to be removed, from the streets within the Ward under his or their charge, all of? fensive substances or nuisances tending to endanger tho health of the citizens of the city; and the Chief of Police and his assistants, and the Superintendent of the Streets, are hereby required, without de? lay, to obey all orders or precepts that shall be given them, or either of them, by either of the members of said Board respecting removal of such nuisances. SEO. 4. Be ii further ordained, That the said Board of Health, or any mem? ber thereof, shall bave power, and are hereby invested with full authority, to enter into and upon any lot, gronnd or possessions of any person or persons, and thoroughly examine the same; and whenever the said Board, or any mem? ber thereof, shall have cause to suspect that any foal or noxious effluvia origi? nates, or is collected in any honse, cel? lar, or in any enclosure whatever, shut np from public view, they, or any of them, may demand entry therein, and direct the same to be opened and venti? lated, or the cause of such effluvia to be removed, as may be deemed necessary; and if the owner or occupant of such lot, honse, cellar or on closure shall refuse or delay to open the same, or suffer it to be examined and ventilated, or removed, as aforesaid, or shall in any wiso ob? struct the Baid Board, or any member thereof, or any policeman or other officer, in discharge of his or their official duty, snob owner or occupant shall be fined not exoceding twenty dollars for each and every day he, she or they shall so negleot, refuse or delay, after demand by said Board, or any member thereof; and shall also defray all expenses incurred in tho removal or suppression of such nui? sances, under the direction of said Board, or any member thereof. SEC. 5. Be it further ordained. That it shall be the duty of the City Clerk to act as clerk of tho said Bonrd of Health. SEO. ?. Be il further ordained, That it shall be tho doty of the Chief of Police, or acting Chief of Police, to make dili? gent inquiry as to all nuisances which may exist within tho city; to receive ull complaints which may bo mado to him concerning tho same, and to report im? mediately to any member or members of the Bonrd of Health having chargo of the Ward in which such nuisance ex? ists; and it shall be the duty of the said Chief of Police, or acting Chief of Po? lice, to attend the meetings of the Board of Health when required, and obey such instructions as said Board of Health may give relative to tho health of the city Sro. 7. Be it further ordained. That the Chief of Police, or acting Chief . of Police, shall have power, and is hereby authorized and required, to demand entrance into any lot, building, cellar or enclosure, wherein ho may suspect nny nuisance to exist, for thu purpose of ascertaining whether any such nuisance does exist therein; and if the owner ot occupant of any such lot, building, cellar or enclosure shall refuse to permit said Chief of Police, or acting Chief ol Police, BO to enter for the purpose afore' said, or aimil otherwise obstruct or bindea him in the discharge of the above duty, such owner or occupant shall forfeit and pay for eaoh and every offence a sum nol exceeding twenty dollars. SEO. 8. Be it further ordained, Thai the second [section of an ordinance passed on the IGth day of April, A. D 1851, entitled "An ordinance to esta blish a Board of Health," bo so amend?e as to require that every physician in tb? city of Columbia shall report to tho sail Board of Health, within twenty-foui hours, tho occurrence of any case o contagions or malignant disease in hi; practice, undera penalty of ten dol?an for each and every case which ho ebal neglect, within twenty-four hours afte his knowledge thereof, to report; aaii fine to be collected by information bo fore the Mayor, or any of tho Aldormen SEO. 9.
