That, o 'Board of Health be, and the samo in hereby, established, wbiob bb all ooDsist of twelve members, to . be chosen by bal? lot by the City Connoil/at their first meeting in May of each and every year; I and said Board shall be so chosen, that three of them shall be elected from Ward Ko. 1, three from Ward No. 2, three from Ward No. 8, and three from Ward No. 4, seven of whom shall constitute a quorum; and if any person BO elected a member of the Board of Health, shall refuse or neglect to perform the duties hereafter reqaired, he shall, upon con? viction thereof before the Oily Connoil, forfeit nud pay tbesnm of 815: Provided, That no person shall be compelled to servo more than one year in every three. SEO. 2. Be il further ordained. That the said Board of Health, of whom seven shall constitute a quorum, shall meet at least once a fortnight from the first day June to the first day of November of each and every year, and at anch other times and at Buch places as they may deem necessary and convenient, for the purpose of receiving and communicat? ing ail possible information relative to the health of the city, and to advise and eonsult together respecting the pr?serva? tion of the same; and shall have full and ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessary to the discharge of the trust hereby confided to them; and eaoh and every praotioal physician within the oity is hereby re? quired to give immediate information of the existence of any contagious or malig? nant disease to the Board, or to any mem? ber thereof, and at all convenient times to aid and advise tho said Board in the preservation of the health of the city, and in the preservation or suppression of contagious or malignant diseases. SEO. 3. Be it further ordained, That ii shall bo the duty of each and every member of the said Board to canee to be removed, from the streets within the Ward nuder his or their charge, all of? fensive substances or nuisances tending to endanger the health of the oitizens of tho oity; sud the Chief of Police and his assistants, and the Superintendent of the Streets, are hereby required, without de? lay, to obey all orders or' precepts that Bball be given them, or either of them, by either of the members of said Board respecting removal of such nuisances. SEO. 4. Be ii further ordained, That the said Board of Health, or any mem? ber thereof, shall have power, and are hereby invested with fall authority, to enter into and upon any lot, ground or possessions of any person or persons, and thoroughly examine the same; and whenever the Heid Board, or any mem? ber thereof, shall have cause to suspect that any foul or noxious effluvia origi? nates, or ia oolleoted in any house, cel? lar, or in any endosare whatever, abut ap from publia view, they, or any of them, may demand entry therein, and direct the esme to be opened and venti? lated, or the cause of snob tfnavia to be removed, as may be deemed necessary; and if the owner or occupant of such lot, house, cellar or enclosure shall ref uso or delay to open the same, or Buffer it to be examined and ventilated, or removed, EIS aforesaid, or shall in any wise ob? struct the said Board, or any member thereof, or any policeman or oilier officer, in discharge of his or their official duty, moh owner or occupant shall be fined act exceeding twenty dollars for each iud every day be, she or they shall so negleot, refuse or delay, after demand by ?aid Board, or any momber thereof; and mall also defray all expenses incurred in -he removal or suppression of such nui mnces, under the direction of said Board, or any member thereof. Be it further ordained, That it mall be the duty of the Chief of Police, jr acting Chief of Police, to make dili? gent inquiry as to all nuisances which nay exist within the city; to receive all somplaints which may be made to him joncerning the same, and to report im? mediately to any member or members of ;bo Board of Health having charge of be Ward in which such nuisance ex ste; and it shall be the duty of the said 3hief of Police, or aoting Chief of Po? lee, to attend the meetings of the Board >f Health when required, and obey such nstrnotions as said Board of Health nay give relative to the health of the city SEO. 7.
