Be it ordained, by the Mayor and the Aldermen, of the city of Co? lumbia, in Council assembled, That a Board of Health be, and the same is hereby, established, which shall consist of twelve members, to be chosen by bal? lot by the City Council/at their first meeting in May of eaoh and every year; and Haid Board shall be so chosen, that three of them shall be elected from Ward No. 1, three from Ward No. 2, three from Ward No. 8, and three from Ward No. 4, seven of whom shall constitute a quorum; and if any person so elected a member of the Board of Health, shall ref uso or negleot to perform the duties hereafter required, he shall, upon con? viction thereof before the City Council, forfeit and pay the sum of $45: Provided, That no person shall be compelled to serve more than one year in every three. Sfco. 2. Be il further ordained. That the said Board of Health, of whom seven shall constitute a quorum, shall meet at least once a fortnight from the first day June to the first day of November of each and every year, and at such other times and at euch places i as they may deem necessary and convenient, for the purpose of receiving and communicat? ing all possible information relative to the health of the city, and to advise and consult together respecting the preserva? tion of the same; and shall have full and ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessary to the discharge of the trust hereby confided to them; and eaoh and every praotical physician within the city is hereby re? quired to give immediate information of tho existence of any contagious or malig? nant disease to the Board, or to any mem? ber thereof, and at all convenient times to aid and advise the said Board in the preservation of the health of the city, and in the preservation or suppression of contagions or malignant diseases. SEO. 8. Be it further ordained. That it shall be the duty of each and every member of the said Board to cause to be removed, from the streets within the .Ward under his or their oharge, all of? fensive substances or nuisances tending to endanger the health of the citizens of the city; and the Chief of Police and his assistants, and the Superintendent of the Streets, are hereby required, without de? lay, to obey all orders or precepts that shall be given them, or either of them, by either of the members of said Board respecting removal of such nuisances. SEO. 4. Be il further ordained, That the said Board of Health, or any mem? ber thereof, shall have power, and are hereby invested with fall authority, to enter into and upon any lot, ground or possessions of any person or persons, and thoroughly examine the same; and whenever the said Board, or any mem? ber thereof, shall have oanse to suspect that any foal or noxious effluvia origi? nates, or is collected in any house, cel? lar, or in any endosare whatever, Bhut ap from publia view, they, or aay of them, may demand entry therein, and direct the samo to be opened and venti? lated, or the cause of saoh effluvia to be removed, as may be deemed necessary; and if the owner or. occupant of such lot, boase, cellar or enclosure shall refuse or delay to opea the same, or suffer it to be examined aud ventilated, or removed, as aforesaid, or shall in any wise ob? struct the. said Board, or. any member thereof, or any policeman or other officer, ia discharge of his or their official duty, such owner or occupant shall be lined not exceeding twenty dollars for each and ?v?ry day she or they ahull so negleot, refuse or delay, after demand by said Board, or any member thereof; and shall also defray all expenses incurred in the removal or suppression of snob nui? sances, nader the direction of said Board, or any member thereof. SEC. 5. Be it fur?ier ordained, That it shall be the duty of the City Clerk to aot as clerk of the said Board of Health. SEO. 6. Be it further ordained, That it shall be the duty of the Chief of Police, or acting Chief of Police, to make dili? gent inquiry as to all nuisances whiob may exist within the city;.to receive al] complaints which. may be made to him concerning the same, and to report im? mediately to any member or members ol the Board of Health having oharge.ol the Ward in which saoh nuisance ex? ists; and it shall be the doty of the said Chief of Police, or acting Chief of Po? lios, to attend the meetings of the Board of Health when required, and obey bu ch instructions as said Board of Health may give relative to the health of the city SEO. 7. Be it further ordained, That the Chief of Police, or acting Chief ol Police, shall have power, and is hereby authorized and required, to demand eotraoceioto any lot, building, cellar oi endosare, whereia he may suspect any nuisance to exist, for the purpose ol ascertaining whether any saoh nuisance does exist thereio ; aud if the owner oi occupant of any such lot, building, cellar or enclosure shall refuse to permil said Chief of Polioe, or acting Chief oi Police, so to enter for the purpose afore said, or shall otherwise obstruct or hindei him ia the discbarge of the above duty, such owner or oooapant shall forfeit aac pay lot eaoh and every offence a sum no exoeeding twenty dollars. SEO. 8. Be il further ordained, Tba the second section of an ordinance passed ou the 16th day of April, A.
