AN ACT TO AUTHORIZE THE FORMATION OF, AND TO INCORPORATE, THE SPARTANBUItO AND AIKEN RAILROAD. Whereas it is desirable that thero should be a connection by railroad be? tween the town of Aiken and the town of Edgefleld, tho village of Ninety-Six and the towns of Laurens and Spartan bnrg, in thiB State; therefore, SECTION 1. Be it .enacted by the Senate and House of Representatives of the State of South Carolina, now mel and silting in General Assembly, and by the authority of the same, That the formation of a corpo? rate company is hereby authorized, for the purpose of constructing a railroad to conneot the town of Aiken, the town of Edgefleld, the village of Ninety-Six, the town of Laurens and the town of Spartanbnrg, with the privilege of ex? tending the same to the town of Ham? burg, in snob manner as may be deter v mined by said company. SEC. 2. That, for the purpose of raising the capital stook of said com? pany, it shall be lawful to open books at the town of Spartanbnrg, under the direction of G. Gannon, J. H. Evans, Alfred Tollison, D. R. Duncan, S. Bobo and Joseph Walker; at the town of Lau? rens, under Y. J. P. Owens, J. W. Fow? ler, Joseph Crews, Dr. John Henry and H. L. That when tho sum of one hundred thousand dollars shall have been subscribed, in the manner before specified, the subscribers shall be, and they are hereby, declared n body corpo? rate, to be known by the name and stylo of the "Spartanburg and Aiken Rail? road Company," and may meet and or? ganize said company, at such time and place as may bo designated hy the Com? missioners for the town of Spartanburg, hereinbefore named. SEC. 4. That, for tho pnrposo of or? ganizing said company, all such powers as are conferred by the oharter of tho Greenville and Columbia Railroad Com? pany, and the Commissioners at Green? ville, 8hull be, and uro hereby, conferred upon the Commissioners herein appoint ed at tho town of Spartanburg; and all the powers, rights and privileges granted by tho said charter and its amendments to tho "Greenville and Columbia Rail? road Company," shall be, and they are hereby, granted to tho "Spartanburg and Aiken Railroad Company," and sub? ject to like restrictions as aro thorcin contained, except as to tho capital stook, the sum necessary to authorize tho or? ganization, and the amount of shares, exoept so far as may bo necessary to con form to th- speoial provisions of this Act: Provided, however, That nothing herein oontained shall bo so construed as to bind the State to subscribo stook in said company, or make any appropri? ations to enable the said company to build said road, or in any mannor to loan the credit of tho State thereto: Provided, further, That nothing herein contained shall be construed so as to ox cmpt tho said company from the provi? sions of Section 1, Chapter III, of tho General Statutes. Holmes, Robert Tarlton, George Leo, B. Byas, P. P. Hedges, William B. Jervey, and such other porsous as they may associate with them, their successors and assigns, be, and they aro hereby, constituted a body corporate and politio, by tho namo and style of tho Edisto, Caw Caw and Waites' Creek Canal Company. And they aro hereby ruado corporate iu law, to have, hold, purchase and possess lands, and to make salo of the same, or any property acquired by thom, as a company, to carry on the lumber, wood business, dig phosphates that may be on their lands, to erect houses, mills, ma? chine shops, manufactories, dig out and alean away any obstructions which may bo necessary in order to complete a na? vigable water course from the Edisto River to the Ashley River, in this State, conveying water, lumber, wood, barges, rafts, boats, or any craft that may bo ne? cessary to oarry out the design of said company. They may also convey fresh water to the city of Charleston, by such means as they may deem best, and at such time as shall bo most practicable, and shall havo authority to impose such a toll on vessels, rafts, barges, boats and flats as may be deemed proper for the uno of said canal. I SEC. 2. Tho capital stock of this com? pany shall bo five hundred thousand dol? lars, divided into shares of ten ($10.00) dollars each, and shall organizo when ten thousand dollars shall bo subscribed and paid in, either in cash, or lands, ma? chinery, goods, or any material which may be deemed of equal value to said company, which may bo applied in its operations. SEC. 3. Thero shall bo held annual meetings of the stockholders to elect a President and Directors; there shall be four Directors, who shall hold their of? fices ior one year. SEC. i. Eaoh share shall represent one vote in all eleotions for officers. SEC. 5. All transfer of shares shall be made in accordance with bank rules foi making transfers of shares. Tho Direct? ors shall make all needful by-laws foi tho government of the company, and alter and amend tho Bame at ploasure. SEO. G. This company shall have water communication from tho Edistc River through Bull Creek, and the most direct route through Caw Caw Swamp, water lead to Waites' Creek, two hun drod feet wide, and may appropriate any lands on said route neccseary to forward this enterprise and facilitate quick trans? portation: Provided, That they shal pay a just and reasonable compensatio! for all land appropriated for said purpose, SEC. 7. That thoy, and their succ?s sors, shall fix and establish any toll, and receive tho same, on all goods, merchan? dize, timber, lumber, wood, bouts, flats, rafts, or any means of transit throngl said canal, and any party refusing to pay said toll, their goods may bo detained till said toll is paid. SEC. 8. The said company havo autho rity to irsue coupon bonds, bearing eight per cent, interest, redeemable ic tea and twenty years, not exceeding one hundred thousand dollars. SHO. 9. SEC. 3. Whenever tho said sum of fifty thousand dollars shall have been subscribed, the subscribers, their execu? tors, administrators and assigns, shall be, and they are hereby declared to be, incorporated into a company, with all the rights, powers nod privileges con? ferred upou the "Port Boyal Railroad Company," by an Act cntitlod "An Act to charter the Port Royal Railroad Com? pany," ratified December the 21st, A. D. 1857: Provided, That nothing herein contained shall b9 so construed as to ex? empt said company from tho provisions of Section 1, o? Chapter G3, of thc Gene? ral Statutes. SEC. 4. That Faid "Bull River nud Port Royal Railroad Company" 6hall havo power to niortgago its property and franchises, and issuo bonds, at such rates of interest, and upon such terms and conditions, and for such uses and purposes of said corporation, as thc Board of Directors thereof may deem expedient. SEC. 5. That no other railroad ehnll be constructed, with a terminus, or point of beginning within ten miles of tho lino of tho said "Bull River and Port Royal Railroad" for a period of ten years. SEC. G. That tho said company shall have tho right to build bridges across navigable rivers: Provided, They shall put in good and sufficient draws, and shall construct necessary stations and turn-outs, and shall have ono or moro tracks to tho road, with such gauge as will correspond with that of tho "Port Royal Railroad." SEC. 7. Nothing herein contained shall bo so construed ns to exempt tho said company from the pnyment of taxes. SEC. 8. Said railroad shall bo com? menced within one year, and completed within seven years, after thc passage of this Act. Approved March 12.1S72. AN ACT TO ESTABLISH A PUBLIC FERR? IN FAIRFIELD COUNTY. Be it enacted by the Senate and House of Representatives of the Slate of South Caro? lina, now met and silting in General As? sembly, and by the authority of the saine, That tho ferry commonly known as "Rocky Mount Ferry," across tho Catawba River, in Fairfield County, shall he, and the same is hereby, estab? lished a public ferry, and vested in James Johnson, his heirs, executors and assigns, until repealed, with tho privi? lege of collecting tho following rates of toll, to wit: For each wagon drawn by four horses, mules or oxon, seventy-five cents; for each wagon drawn by throe horses, mules or oxen, sixty-five cents; for each wagon drawn by two horses, mules or oxen, fifty cents; for each wagou, ciirringo or buggy, drawn by ono horse, mule or ox, twenty-five cents; for each man on horseback, ten cents; fur each foot passenger, five cents: Pro? vided, That children going to and re? turning from school, and voters going to and returning from tho polls on election day, shall bo passed freo. Approved March 12, 1S72. AN ACT TO INCORPORATE TIIE GETHSEMANE CHURCH, OF CHESTER COUNTY. SECTION 1. Be it enacted by the Senate and House of Representatives of the S(> '.; of South Carolina, now met and sitting ?n General Assembly, and by the authority of the same, That Rev. Barney Humphries, Willis Blackwell, Edward Allen, James Smith, James Williams, and their asso? ciates and successors, be, and they are hereby declared to be, a body politic and corporate, under the name and style of tho Gethsemane Baptist Church, of Chester County, aud may have a com? mon seal, with power to ulter tho same at will. SEC. 2. That said corporation shall have power to purchase und hold any real or personal estate, not exceeding in value tho mun of ten thousand dollars, and to sell, convey and disposo of tho same, and by its corporato namo to sue and be sued in any court of this State, and to make such rules and by-laws, not repugnant to the laws of tho land, as they may deem necessary and expedient.
