THE DAILY ''Let our inst Censures BY J. A. SELBY. COLUMBIA, S. C., FRIDAY MORNING, APRIL 5, 1872. VOL. VIII-NO. 14. The world is becoming tired of trials by jory, especially in civil oases, for in Booh oases nothing can be less certain than the results. In the hair-splitting of lawyers, and the vast aooumulations of mles of evidence, juries, at the best, may become confused, and, at the worst, their confusion is certain. If law be a science, a like state of facts should bo followed by like results, but wheo so muon ia left to ignorant or wilful jurors thia seqaenoo is not maintained. In tho Marok number of LippincoU a contribu? tor to that magazine writes as follows on this subject: It is said that juries in civil caseB de? cide the faot, in criminal ones both tho faot and the law. Butin oivil cases they do not even decide the faot. In overy State there is a court of lost resort which is entirely composed of judges, and nearly every case tried in the inferior courts moy bo brought beforo it for re? view. If the judge of a lower court make? an erroneous decision, tho party aggrieved appeals to tho higher court, in which tho case is reviewed, and the judgment, if wrong, reversed or cor? rected. The very same thing happens in trials by juries. If they decido against the weight of evidonco, their verdict is set aside; if they pass upon a question of law which it was the duty of the judge nt tho triol to decide, a now trial is granted. In short, the trial of a civil caso by a jury amounts simply to this-that if tho higher court consider the verdiot right, it stands; if not, thou it is reversed. Therefore, since civil cases aro in reality tried and decided by judges, why retain tho fiction that a jury com? posed of twelve ordinary men decide the cuses which are brought beforo them? Why not abandon that mode of trial, and thus savo tho inconvenience, ex? pense and delny that wo havo shown ex? ist? INTERESTING LETTER.-Tho Atlanta (Ga.) ?Sun, of tho 29th ult., publishes a letter from Hon. Charles J. Jeukins, de? tailing important-historical facts nnd re? miniscences connected with his adminis? tration and romoval from ofllco as Go? vernor of Georgia. It is addrcssod to Gov. Smith, giving a history of his removal from ofllco by Major-General Meade, in 18GS, and of tho cuses he triod to bring in behalf of tho State and hor peoplo beforo tho Supreme Court of the ?uited States. With this letter, he returns to the Governor, us his first legitimate successor, tho record of .warrants drawn by him and receipts given for tho same, whilo he was in tho J Executive office, also the seal of tho . Executive Department. These Gov. Jenkins carried with him when driven from office by military powor. The re? cords for his own protection-the othor, to preserve it from undefiled hands; and now returns it to an honest, legitimate, Governor, chosen by an honest people, sever having been usurpers to authenti? cate tho misdeeds of an upstart pre? tender. We need to face the faot that a man's life consisteth not in the abundance of tho things which he possesscth, bnt in the ability to make the best nse of all things; aud this ability faith supplies.
