"Whereas the State of South Carolina, has, by nud in pursuance of tho pro? visions of an Act. npprovcd thc fifteenth day of September, A. 1). 18GS, eutitled .'Au Act to authorize additional aid to tho Blue Ridge Railroad Compauy, iu South Carolina," endorsed a guaranty of tho faith and credit of tho Stato on four millions of dollars of bonds, issued by the said Blue Ridgo Railroad Company, comprehending tho Bino Ridge Railroad Company, in South Carolina; tho Blue Ridge Railroad Company, in Georgia; tho Teunessco River Railroad Company, ?in North Carolina; tho Knoxville and Charleston Railroad Company, in Ten I nessee, and tho Pendleton Railroad Company, in South Carolina, for tho purpose of aiding tho speedy completion of the eaiil railroad, which bonds aro liable for tho debts of tbo said railroad companies; aud, whereas, tbe present condition of tho finances of the State, and of said companies, is such ns to make tho further continuance of said bonds on the market inexpedient and unadvisablo, and n serious injury and prejudico to tho credit of thc State; and, whereas, the existence of tho said four millions of dollars of bonds, so guaran? teed, creates a large liability upon tho part of tho State, which the Treasury may be required to meet at unforeseen and inopportune tiares; and, whereas, tho liability of the State, on account of such guaranty, should be faithfully met und discharged; therefore, in order to secure tho recovery and destruction of the bonds and conpor.s of tho said com? pany, issued under and in pursuance of the provisions of tho aforesaid Act, now pledged in the city of New York and elsewhere, and to relieve tho State of all liabilities whatsoever, by reason of its endorsement and guaranty of said bonds: SECTION 1. f?a il enacted by the Senate ami House if Representatives of the atnie of South Carolina, now mel and sitting in General Assembly, and by the authority of\ the same, That tho Stato Treasurer is hereby directed, with tho consent, iu writing, of tho President of tho Bloc Ridge Railroad Company, in South Ca? rolina, to require the Financial Agent of the State, iii tho city of New York, immediately to deliver to the State Trea? sury all tho bonds of I he Blue Ridge Railroad Company, endorsed and gnni- | autoed by thu Stato of South Carolina, j which uro now in his possession, und held by bim us collateral security, for ? advances made hy the said Financial Agent, by tho order of the Financial Board, te? tho Bine Ridge Railroad Com- j jinny; and ti pon tho delivery of Raid bonds, tho Treasurer is hereby required to canec? the same, in Ihn manner In re- I inafter directed; end the said Blue. SEO. 7. vlmt whenever the whola nani ber of tho said guaranteed bonds shall hnve boen delivered to the Treasurer aud cancelo J, as required by tile provi? sions of this Act, tim lion of tho State of South Curohua, up .it the estate, pro? perty aud funds of u.u said Blue Ridge Railroad Company, in this State, aud of tho other associated companies in tho States of Guorgia, North Carolina and Tenneeseo, as secured by the provisions* of an Act entitled "Au Act to authorize additional aid to tho Blue Ridgo Rail? road Company, in South Carolina," passed on the iitteenth day of Septem? ber, Anno Domini ono thousand eight hundred and sixty-eight, and nil other claims or lions which ure held by the State against said company or compa? nies, on account of said guaranty, shall, from thenceforth, bo forever discharged and released; and should the saul com? pany be unable, from any cause, to de? liver all of said bonds, such liens shall be discharged and released to un extent which shall be proportional to the amount of such bonds actually delivered.
