TIMONY IN CERTAIN OASES. SECTION 1. Be ii enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in ?enerat Assembly, and by the authority of the same, Tbat the Clerks of the Courts of Common Pleas in this State, io all civil oases or proceedings hereafter to bo instituted, or now pending, or at issae in the Courts of Common Pleas for their respective Counties, shall, upon the application of either party to auch causo or proceeding, after teu days' no? tice to thu adverse party, take in writing the depositions of said party, or of any witness or witnesses in said cause or pro? ceeding, whose examination shall be re? quired by tho party making snob appli? cation; upon taking which depositions, tho several parties shall be eutitled to the same rights of examination, oross examination and examination in reply, and the same exceptions to the udniissi bility of evidence as are allowed by law .upon examination before the court. And the depositions eo taken shall be certified by the Clerk before whom such examination was had, and shall be read in evidence at the trial of the fia id oause or proceeding; subject, nevertheless, to the right of either party to require the personal attendance and viva voce ex? amination of the witness or witnesses at the trial of said cause or proceeding, the exeroise of whiob right, however, not to oaueo a continuance or delay in the triul of the said CUUBO or proceeding. That every Clerk ot the Court of Common Pleas shall havo power to compel the attendance before him of tho witness or witnesses to be examined as aforesaid, upon the application of a party to any civil cause or proceeding here? after to be instituted, pending or at IBUUO in the said court, for which pnrposo be may issue a subpoena to any snob wit? ness, which shall be served personally; and if any witness npon whom such subpoena has been dnly served shall fail to attend conformably thereto, theCleik by whom the sumo was issued shall have power to issue a rule, requiring such person to show cause why be should not be attached for contempt; and upon the failure or neglect of such witness to show oause, the said Clerk ahall have power to issae an attachment against Buch witness for oontempt, which attach? ment shall not be dissolved, except by the order of a Judge, or of the said Clerk.
