But if Senator Drake is a madman, he hos undoubtedly a great deal of Con? gressional companionship in his mad nefcsv Ooo of tho master-spirits of radi? calism iu the last Congress coutonded vehemently against tho Supreme Court's being allowed to exercise the power, which it is supposed by tho conserva? tives to possess, of declaring Acts of Congress unconstitutional. The whole tendency ol radical discussion and action for the lost th reo years in regard to the Snpreme Court has been to paralyze it. We do not believe that a single promi? nent radical member of either tho Senate or the House of Representatives bas within that period squarely admitted that it is -within tko competency of the conrt to decide upon the constitutionality of any law of Congress and to secure the enforcement of its decision. The radical members of the Senate, our readers may feel well assured, will be very careful not to commit themselves against Drake's bill. They will sheer around it, likely. Mr. Drake's bill contemplates nothing less than that Congress sholl make itself the supreme power of the country uothing less-than that it shall make itself omnipotent. If that bill were to bo enacted, Congress might pass a law that there should be no more Presidential elections, - a law that its own members should exercise all the executive func? tions and hold their places for life and appoint their successors; and there would bo in all the country no tribunal or judgment I seat to order the arrest of tho operation of tho law. Only the awful' giant of r?volution could eave American liberty from eternal annihila? tion. -* ? THE PHOSPHATE SWINDLE.-The fol? lowing is a copy of the preamble and re? solut i ons adopted ut thc meeting in Charleston, on Monday night, copies of which were transmitted to Gov. Scott and to both branches of thc Legislature. Republicans, Democrats and conserva? tives participated: Whereas, there is uow pending iu the General Assembly of South Caroliua "A bill to grunt to certain persons therein named, the exclusive right to dig uud mine in the beds of the navigable streams and waters of the State of South Caroli? na for phosphate rocks and phosphate deposits;" and, whereas, the graotiug of such exclusivo right is contrary to a sound public policy, because it would tend to check that competition among capitalists, which it is tho high interest of the State to foster for the development of her internal resources; and, whereas, the supply of labor in this State is already in excess of the demand, and the majority of laborers are therefore compelled to work nt grievously low wages; and, whereas, large numbers of laborers are engaged, on their own account, and in j the employment of small capitalists, in working these phosphate beds; and, j whereas, the granting of this monopoly J will forco these laborers and capitalists! thus engaged to cease the work, and will place them at the mercy of the monopo- j lists, who can thereby control their rate of wages ut pleasure, as there would be j no competing capital; and, whereas, to ; grunt this proposed monopoly would be in violation of the spirit of a Republican Government, because it vests in the ? favored fow (he common rights of till ; I therefore, Resolved, by the citizens of Charleston, in maits meeting assembled, That thc I General Assembly of South Carolina be. ami is hereby, most earnestly appealed to, in tho interest of tho people, to re- ? jeet thc bill to graut certain persons the exclusivo right to work thu phosphate ; beds of tho State. The following bills from the Senate, were read the first time: To re-eharter Rantowles' Bridge; to incorporate the Winnsboro Baptist Cburoh, of Fairfield County; to incorporate the African Me? thodist Episcopal Church, in this State; n joint resolution to extend the time in which claims of teachers for services rendered during the year commencing Ootober 31, 1867, shall be presented for payment. The following bills were read the se? cond time and ordered to be engrossed: For the better protection of migratory fish; to amend the law in relation to tho license of and registration of phurma oeutists, apothecaries and druggists, and to regulate the vending of drugs and poisons. A Senate bill to grant au tl give the con? sent of the Legislature of this State to the conveyance to the United States of the lot of land situate on Richardson and Laurel streets, in the city of Colum? bia, hereinafter described, for the pur? pose of a Post Office and Court House, or for other purposes, and to cede to tho United Stn fes jurisdiction therein, was postponed until January 8, 1870. Mr. Thomas introduced a bill, which waa referred, to provide medical assist? ance to the poor, (white aud colored.) The Senate was announced and un election for niuo Begeuts for the Lunatic Asylum, was entered into. The follow? ing were elected: D. A. Boseman and W. B. Nash, colored; Henry Sparnick. Muoh confusion hore ensued, when thc Senators returned to their chamber, without completing the election. Petitions from E. H. Griffon and 8. D. Keith, for removal of their political disa? bilities, were referred to Committee on Political Disabilities. Tho House refused to concur in th? Senate amendments to the joint r?solu tion instructing the County Commis stoners and State Auditor to levy cert ui i taxes, and asked for a Committee ol Oonferenee. Mr. Bansier introduced a bill provid ing that the remedy in all oases, civil anc criminal, that may be carried to th? courts of the State, heretofore applying only to white persons under old statutes shall apply to all persons, regardless o race or oolor, in pursuance of Section 3! ot Article 1 of the Constitution of th State.
