The writer of this hus little doubt but that our. Supremo Court will ?declare this Act unconstitutional, BO far as.it ia retrospec? tive, as impairing the obligation of con? tracts. No authoritative decision can be found to sustain tho Act. The decisions of other States' have no authority. If the Acts construed are similar to oars, then they are entitled to consideration nothing more. Often the grounds of snob, decisions aro entirely different. Georgia, for instance, has a different constitutional provision, and the action 3? Congreso upon that Constitntion was lifforont from that npon the Constitution af any other State. Supposo, ho\ ever, that Congress bad enacted, (os assumed, without any '. foundation i fact,) that the Constitution of South C rolina should have the force of an Act < Congress. This would not- sustain homestead provision antagonistic to tl Constitution of tho United States, f< the constitution of 1868 itself provid that nothing in it "in contravention i subversion of the Constitution of tl United States can' have any bindii force." (Article I, Section 4t, and tl "oath," Article JJ, Section 30.) Let hear no more about Congress havii given its authority to a measure which so direotly in contravention of the Cu stitution of the United States. Bi mirabile dictu, tho Constitution of Sou Carolina does not moke a retrospect] homestead provision. I challenge a one to point out the clause. Article Section 20, and Article II, Section : make no provision that the exe ni pt ion to apply to antecedent indebtedness. A thorities can be cited, itd nauseam, tl in the construction of constitutional statute law, all provisions are presum to be prospective, unless. the contri be expressly enacted. ' Neither seoessi? then, Congress or the constitution 1868, authorized a retrospective hor stead law. Nothing is now left but I naked Act of 9th September, 1868, X Stats., p. 19. The provisions of tl Aot are retrospective. The Act of ll at once falls as impairing the obligat of contracts, by virtue of the prohibit of the United States Constitution, e by tho prohibition Of our own consti tion of 1868. Art. I, See. 21.). Do we hear any one bold-enough say that a retrospective homestead emption does not impair the obligat of contracts, and is not violative of Constitution of the United States? so, wo merely reply by citing the d sion of tho United States Supreme Cm (whioh is binding apon our judges,) tho case of the Planters' Bank vs. Shi wherein, after deciding (as quoted one of our judges) that States can \ laws exempting a homestead and to ?c., the court makes this qualificat whioh, we think, ought not to bo o looked, having a slight bearing upon question. "Again, State insolvent li if made like this law, to apply to contracts, and stop suits on them, 1 been held nut to be constitutional, ex so far as they discharge the person 1 i!-ro-;-m-?-! imprisonment. When so restricted, they do not impair the obligation of the con tract itself, boca uso t he obligation is left in full force and actionable, and future property, as well as present, subjected to its payment. Where future acquisi? tions are attempted to be exonerated, and the discharge extended to the debt or contract .itself, il .dqne by States, it must not, as hore, apply to past con? tracta, or it is held to impair their obliga? tion." This case, then, goes to the ex? tent of not only not 'allowing au exemp? tion to he made of property which ? debtor owns, bot not oven what he may hereafter acquire, as affecting "past con? tracts." Tbis extract from the case will be found in 6 Howard, page 328, where tho oourt sustains itself by ten authori? ties.
