TEST.-After a twelve days, session tho Council Board adopted tho fol? lowing resolution, proposed by Al? derman Marshall : Resolved, That the Board do de? claro the late eleetiou for Mayor aud Aldermen illegal and void, and that no persons have been duly elected to the said offices of Mayor aud Alder? men of the city of Charleston at said election. The following is the decision <>f tho Board, which, on motion of Al? derman Geddings, was signed by the members agreeing thereto: Tho eleetiou of a majority of thu persons voted for at tho municipal election of the City of Charleston, held on thc second Tuesday of No? vember, instant, in pusuauco ol' tho Act of Assembly, entitled "An Act to provide for tho election of officers of tho incorporated cities and towns in the ?State of South Carolina," ratified on the twenty-fifth day of September, A.D. ?5G8, having buen contested on the part of sundry citizons and elec? tors, and tho Managers of Elections having been charged with illegal con? duct, and the acting Board of Alder? men having been duly convened, and having proceeded, in accordance with said Act, to examine the returus, to? gether with the ballots, and to inves? tigate the case, in order to declare thc said election, and to make a de? cision which shall be binding upon all parties. The said Board, having made such examination and investigated the case by taking the testimony of wit? nesses, thereupon do find that the Mauagers of Elections in tho regis? tration of tho voters failed to require tho oath to be taken and sub? scribed, as required by law, and iu their qualification and organization as Managers, in the holding and con? duct of said election, and in the counting of tho votes and in making the return of said election, did not conform to tue requirements of the law in sueh ease made and provided, in essential particulars; that many other irregularities and illegalities occurred in thc conduct of said elec? tion in essential particulars; and that ballots exceeding tho majorities claimed for a majority of the persons voted for, have been destroyed and cannot be produced for examination. Wherefore the said Board do de? clare that there has l>ecn no legal valid election, and that no persons have bceu tl ti ly elected to the offices of Mayor and Aldermen of tho City of Charleston at said election. Fellow-Citizens of the Senate ami of the House of Representatives: In accordance with tho requisitions of tho Constitution to loy before you information of tho condition of tho State, and recommend to your consi? deration such measures us may bo deemed necessary or expedient, I shall proceed to perform that duty as briefly as circumstances will permit, postponing to a futuro opportunity til? discussion of all questions not directly connected with the adminis? tration of tho Government. Thc in? terval since your last sessidn has been so brief, and the details connected with tho organization of tho new branches of public service have occu? pied so much timo and attention, aa to leave but little opportunity for the consideration of matters of a more general character, many of which were fully discussed in my message at tho special session. Tho Act providing for tho assess? ment and taxation of property has re? ceived considerable attention, and tho organization of the Auditor's Depart? ment has progressed as rapidly as circumstances would permit. Great caro and caution have been necessary in selecting tho officers to whom will be entrusted tho execution of tho tax law; but it is believed that thc ap? pointments made, and to ho made, will givo efficiency and success to this important department of the Govern? ment. I shall lay before you, at tho earliest practicable period, tho com? plete assessment of tho property of tho State, which will afford thc ne? cessary basis for taxation. Thc estimate of tho Auditor for the contingent fund may appear large, but it should be remembered that tho Assessor's books, blanks and other forms for tho whole State, aro to bo provided out of this fund, not only for the asssessment which is about to be made, but for that which will have to be made previous to the con? vening ot the General Assembly in IStV.). Thc organization <>f the Auditor's Department, and the successful com? pletion of the first assessment of pro? perty, will involve a large amouut of labor and some unusual expenditures, but :vs the result aimed at is most desirable, 1 recommend that the Le? gislature will afford every facility for the accomplishment of the object.
