That ins.ine radical and bad man, Forney, in bia Chronicle, speaking of tbc recent decision of tbc Supremo Court pronouncing the illegality of military commissions for the trial of civilians, utters the following lan- j guage: "Treason, vanquished upon the j battle-field and hunted from every i other retreat, has at last found a se? cure shelter in the bosom of the Su-1 prerne Court. * * * This extra-1 ordinary decision will doubtless receive the serions? attention of Con? gress at ".u early day." And suppose it does attract thc attention of tho so-called Congress. Wc have yet left two sufficient bar- j riers against the insane measures of | destruction which that cabal passes, j in tho executive and judicial depart? ments of the Government. So long as public sentiment holds in high esteem the chief judicial tribunal, and so long as tho Executive is comman? der-in-chief of the land aud naval forces of the United States, the peo? ple are comparatively safe from tho j execution of revolutionary edicts. "We further believe that the masses of the Northern ' people will never consent that the temples of jnstico bo laid violent hands upon by these radical vandals. The Supreme Court, since the earliest days of the Govern? ment, bas been the strong palladium of the rights and liberties of the peo? ple, and cannot be permitted to fall a victim to the destructives in Con? gress. An assault upon it would bo an assault upon about all that is left ns of conservative Republicanism, as left by tho founders of the Govern? ment. The Southern people, under their extraordinary trials, have only to persevere in their present course of conduct; patient, but firm, manifest? ing their full reliance on the great principles of the Constitution-enter? taining a bigh-toned regard for their whole duty as citizens towards the Federal Government, of pa: riotic submission to the laws they are pledged to obey, and a proper firm? ness in resisting revolutionary meas? ures, as in the case of the Constitu tioi_al amendment; and ?ts sure as tho principles of truth and right are given to men by Omnipotence itself, so surely will their ultimate triumph come. The ?faction that would de? stroy such a Constitution and such a Government ai; our fathers bequeath? ed us, cannot, under the justice of Heaven, be permitted long to rule the peopki in wickedness. A Dublin letter to tlicSunday Neus says the Government officials are fre? quently sold Ivy stones that Stephens bas landed a', different points on the coast, keeping troops and gun-boats constantly on the move. Phoenix Park, in which is situated the Govern? ment powder magazine, has been sur? rounded by heavily-manned earth? works and palisades. Troops are continually arriving from England, and suspected Irish regimen..-, are transported to England and the colo? nie?. Despite the exertions of tho authorities, midnight meetings for drill are held all over Ireland, and the people evidently are awaiting Stephens' arriva! to rise, in spite of the great odds against them. The investigating committee ap? pointed by the House of Representa? tives, a few days since, have unearth? ed stupendous distillery frauds in New York, it is said. They expect like success in their investigations in Western cities, which they aro to visit after tho holidays. The Governor of North Carolina bas sent a special message to the Le? gislature, announcing tho sucess of the Commission to Washingtion, in procuring the abrogation of Gen. Sickles' order prohibiting infliction of corporal punishment by the Courts of the State. It is said that the Postmaster-Gene? ral is considering tin; practicability of receiving and delivering mails from express trains without lessening speed, ana at points where they do no'tstop! He believes this can bo done, and will institute experiments in that direc? tion. . I Act? Paued bjr the Legl?l?ture. TO AT7THOT;iZE THE CREATION OF PRI? VATE CORPORATIONS. Private corporations for any pur? pose whatever, excepting banking, i insurance, constructing railroads, canals, turnpikes, bridges, causeways and ferries, making and selling gus for light in and for any city, town or village, supplying tho inhabitants of any city, town or village with ?water, manufacturing or distilling spirituous or intoxicating liquors, and, also ex? cepting military, fire :'.:.d lottery companies, may be created in this State, by complying with the follow? ing provisions: A petition by tho persons desiring a charter tn the Court of Common Pleas, for the District where a ma? jority of the corporators reside, or in which they may desire to transact business, or to a Judge or Chancellor at Chambers, setting forth the object of their association, the amount ol' its capital stock, if any there be, the privileger, tiley desire to exercise, and the name and style by which thoj desiretobe incorporated, (notice of such application having been first published one a week fortwo months, in one moro public gazettes nearest to the point where such business is to be located.) If the application is legitimately within the intention of this Act, and not inconsistent with public welfare, the said Court, Judge or Chancellor, shall ptiss an order declaring thc said application grant? ed, and thc petitioners and their suc? cessors incorporated for a term not exceeding fourteen years, with the privilege of renewal at the expiration of that time, according to the pro? visions above set forth; and the said petition and order shall be filed in the office of the Clerk of the Court for the District in which thc business of the corporation is to be transacted; and it shall bc the duty of the Clerk to record the same in a book to be procured by him for the purpose, at I the expense of thc funds in the hands of the Commissioners of Public Build? ings for his District; and he shall also forward a certified copy thereof to the Secretary of State, to bo filed in his office. The individual members of such corporations, whenever tho object of the association is for the purposo of trading or transacting business for profit, shall be jointly and severall}' bound for the ultimate payment of all the contracts of said companies, incurred while they are members of the same. The Clerk of the Court, for his services in each case, shall receive the sum of two dol? lars. Corporations thus created, shall have succession of officers and members, power ami authority to make all by-laws not repugnant to the laws of the land, to have and use a common seal and same to alter at I will, to sue and be sued, plead and be impleaded in any Court of law or ; equity in this State, and may exercise j all corporate powers necessary to thc purpose of their organization, but shall make no contracts or purchase, or hold any property of any kind, except such as is necessary in legiti? mately carrying into effect such pul? p?se, or for securing debts due to i!:. company. j A private corporation for the pur j pos:: of carrying on agricultura] mechanical, mining, or manufactur? ing business-except that of manu? facturing or distilling spirituous 01 intoxicating liquors-may be created without the stockholders incurring an individual liability for its indebt? edness by complying witli the follow? ing provisions: A declaration ii: writing by the applicants, specifying the object of their association, and the particular business they propose to carry on, together with their name, and the amount of cap?*?! to be em? ployed by them, and t",o time, not exceeding thirty years, for which thej desire to be incorporated; whiel declaration shall ho signed by al the stockholders, and aecompaniec by the affidavit. of tho President taken before some person authorize! to administer oaths, of the amount o capital or property, at its swori valuation, actually paid in, owned anc employed by such corporation. Stiel declaration and affidavit shall be filet in tho office of the Clerk of the Cour of Common Picas for tue Dis trie where the business is proposed to b< transacted, to be by him recorded and shall also be published once J week for two months in one or mor; public gazettes nearest to the poin where such business is located, tin expense of such publication to bi paid by the applicant?. If such cor poratioa shall at any time desire t< increase their capital stock, an affi davit, like to the above, shall be made recorded and published as above, ant a new certificate issued. And in case of a violatioi of this provision, the officers am agents by whom such excess shall b created, shall be jointly and sever iii, liable to the extent of such execs--. 1 the officers or directors of such co poratiou shall dec?an; and pay ai., dividend when the company is in solvent, or any dividend, tho pay ment of which would render it in solvent, or which would diminish th amount of its capital stock, they sha! be jointly and severally liablo for all the debts of the company then exist? ing, and for all that shall bo there? after contracted while they shall respectively continue in office: Pro? vided, That if any of tho officers or directors shall object to the declaring of such dividend, or to tho payment of the same, and shall at any time before the time fixed for the payment, file a certificate of their objection iu writing with the Secretary of the company, and with the Clerk of thc Court of Common Pleas for the Dis? trict in which the business of the cor? poration is transacted, thej shall 'oe exempt from said liability. Every j such corporation shall annually, within twenty days from the first day of January, make a report, setting forth the amount of its capital, the proportion thereof actually paid in, and the amount of its existing debts; which report shall be signed by the President, verified by the oath of the President or Seeretarv, and tiled in the office of the Clerk of the Court, for flu; District where the business of the company shnll be carried on; and upon failure so to do, all tbc officers and directors of the company shall be jointly and severally liable for ail the debts of the company then existing, and for all that shall be con? tracted before such report shall be made. The stockholders of such cor? poration shall be individually liable for all debts that may bo due and owing to all their laborers, servants and Ap? prentices, for services performed. If any corporation formed or created under this Act shall not or? ganize ; nd commence the transac? tion of its business within one year from the date of its incorporation, its corporate powers shall cease. For the encouragement of trade with foreign countries, and tho other States of tho United States, private corporations, having such trade for their object, may bo formed by any number of the citizens of this State, by complying with the provisions of the foregoing section, incorporating companies for carrying on agricul? tural, mechanical, mining or manu? facturing business, except that of manufacturing or distilling spirituous or intoxicating liquors. Be il enacted, That the Act entitled "An Act to amend the Criminal Law," which was ratified on the 19th I day of December, 18G5, is hereby re I pealed in so fr.r as it is not hcrein I after re-enacted. An assault to commit a rape is hereby declared to bo a felony with I out benefit of clergy. With respect to the crimes ol burglary and arson, and to all crimi? nal offences which arc constituted 01 aggravated by being committed in r dwelling-house, out-bouse, apart? ment, building or box, in which there sleeps a proprietor, tenant, la? borer, or person who lodgt s '.her?, with a view to the protection of pro I perty, shall be deemed a dwelling liouse; all houses, buildings, shed: I 1 erections, which are within 20C ; yards of it, and are appurtenant tc it, shall be deemed parcels. ; Stealing from the lie-Id any grail I or cotton not yet severed from th? i freehold, is hereby made a felony j with benefit of clergy, j For any person to put any obstrue tiou upon a railroad, or to remove o: disarrange any part thereof, or to in jure the machinery or cars uset thereon, or to mislead any persoi employed thereon by false statement: or signals, or in any way to interfer? with any part or appurtenance there of, with wanton indifference to conse quences, or to plunder, or LO delay ? train for dishonest purpose, shall bi a felony without benefit of clergy. Any poison committing a breach o trust with a fraudulent intention shall be held guilty of larceny; ant so shall any person who shall hire o counsel any other person to commit ? breach of trust with a fraudulent in tentiou. Every entry on the enclosed or v.n enclosed laud of another, after no tice from the owner or tenant prohi biting the same, shall be deemed misdemeanor. If any person shall, directly or in directly, purchase any product of j farm from any person who is in th employment of another engaged i husbandry, without sufficient evi deuce of .his right to sell, the pm chaser and seller shall each be guilt of a misdemeanor, and, upon coi viction of any such offence, shall b liable to a fine not exceeding fiv hundred dollars, and to suffer impr sonmentnot exceeding twel vc month; and shall bo liablo to a fino at leaf equal to twice the value of the prc duct sold; and if that bo not immed ately paid, shall suffer imprisonmei in the penitentiary, at the discretio j of the court. The punishment of felony wit benelit of clergy, for the first offene? j shall, at the discretion of tho cour be by ono or moro of the followin modes, to wit : confinement in penitentiary, work-liouso or pen farm (when such institution shall e: ist,) for a period not less than thrc months nor moro than ten years, wit such imposition of hard labor an solitary confinement as may bo d ' rected; con?neineut in tread-mill c stocks; solitary couliuement, hai labor, corporeal punishment; impr soument not less than three monti nor more than two years; fine not le than one hundred, nor moro than or tho isand dollars. Where no special punishment provided for a misdemeanor, it shal according to its natnro and degree, bo punished, at tho discretion of the court, by one or more of the modes prescribed in the section last preced? ing for a felony with benefit of clergy. Upon view of a felony committed, or upon certain information that a felony.has been committed, any per? son may arrest the felon and take, him to a judge or magistrate, to bo dealt with according to law. It shall be lawful for any citizen to arrest any person i ; the night time, by such efficient meansas the darkness and the probability of his escape render necessary, even if h's life should bo thereby taken, in eases where: he has committed a felony, or has entered a dwelling-house with evil intent, or has broken or is break? ing into au out-house, with a view to plunder, or bas in his possession sto? len property, or being under circum? stances which raise just suspicion of his design to steed or commit some felony, ilees when he is hailed. Whensoever hereafter any person shall migrate into Ibis State, and re? side here, or exhibit an intention so to reside, if Ids bad character or his inability to support himself and family shall be made tc? appear to the Judge of the District Court, the said Judge shall, by written ?warrant, re? quire him to enter, within twenty days thereafter, in a bond, payable to thc Sbite, with two freeholders as sureties, whoso sufficiency shall be approved by the Clerk of the Court, in a penalty of one thousand dollars, conditioned for his good behavior, and for his continued support of himself and family. And in case such person shall fail to give the bond as so required, the District Judge is hereby authorized and required, upon complaint and due proof thereof, to issue a warrant commanding such person to leave the State within ten days thereafter. And if any such person so ordered to leave the State shall not do so within the time pre? scribed in such warrant, he shall be guilty of a misdemeanor, and, upon conviction thereof, be liable to fine, imprisonment, corporeal punishment and hard labor, at the discretion of tho Court. Tf the bond aforesaid should be given, it shall be kept by the Clerk, and suit thereon may be ordered by the District Judge. In such suit, any fine imposed upon the principal obligor and not paid by him, and any sums expended for the support of himself or his family, under public authority, shall be as? sessed as damages, to bo collected under the judgment for the penalty of the bond, which shall be recovered upon proof of any breach of the con? dition. If any person, who shall have beeu convicted of any infamous offence in any other State or country, shall come or be brought into this State, such person, on conviction thereof, shall be sentenced to trans? portation beyond the limits of this State for life, or to hard labor, with occasional solitary confinement, for any period not exceeding fifteen years. Any simple larceny of any article of goods, choses in action, bank bills, bills receivable, chattels, or any arti? cles of personality, of which now by law larceny may be committed; of all domesticated animals and animals fierce naluro, which have, in any de? gree, been subjected to the control of an owner; of all growing crops, or parts thereof; of all annual products of the soil, and of all such fixtures and parts of the soil as were severed from tho soil by an unlawful act, below the value of twenty dollars, shall bo a misdemeanor, and be con? sidered a petit larceny. -? ? ? ? NEGROES ON STBKET CABS ts PHELA DELIPHIA.-A conductor kicked a colored woman from a street car, in Philadelphia. The woman's husband brought an action against the railroad company for damages. The judge decided that the company had the right to exclude negroes from their cars, and the jury found for the de? fendant. This throws Forney into a passion. He says: We do not hesi? tate to siy that, at this time, and in this country, sach a decision is scarcely less infamous than that ren? dered by the Supreme Court of tho United States in the Dred Scott case. The incomes last year paid a reve? nue of $60,894,185, which was nearly three times the revenue of the year before from tho same source. The cigar-smokers contributed for the support of thc Government $3,474, 438, and the chewers and tobacco smokers nearly four times as much. Distilled spirits gave a revenue of .$29,198,576; and the Commissioner thinks the Government loses more by evasion under this head than under any other, except, possibly, that of income. A letter from London says: "If a war does come, and England cannot .keep out of it, everybody knows that an army can land on the coast, and in three marches take London and its great arsenal, Woolwich, when Eng? land would be utterly powerless and at the mercy of the invader; ftjr there is but one great arsenal, one military depot; and tho little army, defeatetl in one action, has no line to fall back upon, and no reserves." Colonel James J. Bomford, com? manding thc military department in the Carolinas, his directed the com? missaries of his command to obtain, from the chief commissary of the department, ftdl supplies of bread stuffs and meats for the subsistence of the destitute whites and blacks in that department. LOOK OUT.-The Chronicle and Sentinel leurus thut two citizens of Augusta have bef u arrested and sum? moned to Savannah, for failure, through ignorance, to comply with the revenue laws.
