Su:: A special term of the Circuit Court of tue United S'ates was appointed for thc first Tuesday of October, 1866, at Rich? mond, Virginia, for the trial of Jefferson Davis, on the charge id' treason, lt now appears that there will bo no session of that Court at Richmond during tin pie sent month, and doubts are- expressed whether the regular session, which, by? law, should commence on the fourth Mon? day of November next, will be held, lu view of this obstruction, and the conse? quent ?le!..y in proceeding with the trial ot Jefferson Davis, under the prosecution for treason now pending in that Court, am!, ther#,bcing, so far as the President is in? formell, no g.I reason why the civil courts of the United States are not compe? tent to exercise adequate jurisdiction with? in the district or circuit in which the State of Virginia is included, 1 deem it proper to request your opinion as to what further ! steps, if any, should be taken by the Ex- | eentive, witiia view to a speedy public and ; impartial trial of the accused, according : to the Constitution and laws of th.- United States. 1 am, sir. veiw respectfully,vours, ANDREW .JOHNSON. General, under date of the 12th instant, ? states: 1 am clearly of opinion that there is no- ; thing in the present condition of Virginia ? to prevent the fall exercise of the jurisdic- i tion of the civil courts. The actual state i of things and your several proclamations of peace and of the restoration id' civil order, guarantee to the civil authorities, l'eilerai and Suite, immunity against mili? tary control or interference, it seems tome that in this particular there is no necessity for further action on the part of the Exe? cutive in the way of proclamation, espe? cially as Congress, at the late session, re? quired the Circuit Court of the United States to he held at Richmond, on the first Monday of May and the fourth Monday of November in each year, and authorized special or adjourned terms of that Court to be ordered hy the Chief Ju dice of the Supreme Court, al such time ard on such notice as he might prescribe, with ibo same power and jurisdiction as at regular terms. This is an explicit recognition by Congress that tin- state ot things in Virginia admits Hu.- holding of the United States Courts in that State. He also states that .Mr. Davis re.nains in custody at Fortress Monroe precisely as ho was held in January last, when, in answer to a resolution id' Con? gress, you reported a communication from the Secretary of War and the Attorney General, showing that he was held to await trial in the civil courts. No action was then taken by Congress ia reference to the place of custody. No demand has since been made for his transfer into civil cus? tody. The District Attorney of the United States ha- t'ne District of Virginia, where .Mr. Davis stands indicted for treason, 1 as been notified thal the prisoner would he surrendered to the United States Marshal, upon a capias, under the indictment; but the District Attorney declines to have the cnyAas issued, because there is no other place within the. District where the pri? soner could he kept, or where his personal comfort and health could be so well pro? vided for. No application has been made, within my knowledge, hy the counsel for Mr. Davis for a transfer of the prisoner to civil custody. Decently, an application was made by ins counsel for his transfer from Fortress Monroe to Fort Lafayette, on the ground chiefly of sanitary consider? ation. A reference was promptly made to a Board of Surgeons, whose report was de? cid? div adverse to tho change,on thescore III health ami persona! comfort. I am un? able to see what further action can be taken on tho partof the Executive to bring the prisoner to trial. Mr. Davis must, for the present, remain where he is, until the Court which has jurisdiction to try him sha!! he r.-ady to act. or until bis custody is demanded under lawful process of the Federal Courts. The Attorney-Genera! suggests, that to avoid any misunderstand? ing on the subject, an order bo issued to the commandant of Fortress Monroe, to surrender tm.- prisoner to civil custody, win never demanded by the United States Marshal, upon a process from thc Federal Courts. Mr. Stansbury encloses a hiter of the United States District Attorney for Vir? ginia, who states, in answer to the ques? tion why no demand had been made upon tin- military authorities for the surrender of Jefferson Davis, in order that lie might he tried upon the indictment found against him in the United States Circuit Court, at the term held in Norfolk, in May last, that two reasons had influenced lum in not re? moving him fruin their custody. He says the one relates to the safe keeping; the other to his own personal comfort ai.il health. I have never had anv doubt but thut he would bo delivered to ?Lo United States Marshal of the District whenevei he should have demanded him, on a capias or any other civil process.
