J-_ ' i ? i ? i ? uagaeaasgM AN ACT TO AMEND THE LAW IN RELATION TO THE BONDS REQUIRED "OP PUBLIC OFFICERS. fe a ' I. lie it enacted liv thc Semite and House of Representatives, now met and sit ting in General Assembly, and by the authority of tho same, That the bouda of all public officers of this State, which have heretofore been required by law to be deposited in tho office ot the Treasurer of tho Upper or Loweri)ivision. shall be deposited in the ofliceof the Treasurer of the State of South Carolina, within the several times now fixed by law ; ami all such bonds, except those of tho Comptroller-General, Secretary of State and Treasurer, shall be annually examiwed by a Board, to consist of the Secretary of State, Comptroller-General Sid Treasurer of the State; and if any suretv in either of thc aforesaid officer's bonds should die or depart permanently from tho State, or if tho said Board should, at the time of their examination, or at any other time, be of opinion that either of the said sureties is not worth as much, clear of debt, as his proportion of the obligation to which his name is affixed, they, the said Board, shall cause the said public officer, whoso surety has departed this life or removed from tho State, or is objected to for insufficiency of estate, as' aforesaid, to bo notified of such exception ; ami the said officer shall, within thirty ?lays after the service of such notification, procure other satisfactory surety to tho said Board, for such as have departed the State or died, (but shall not cancel or at all impair the original bond,) or produce satisfactory evi? dence to the said Board, that the surety objected to as owuing insufficient property, as aforesaid, is worth as much as his proportion of the said - obligation, clear of debt, or else the said publie officer shall procure such additioual and sufficient surety or sureties as the said Board shall approve of; and in default of compliance with either of the said requisitions, within the said thirty days, the office of thc said defaulting officer shall bc regarded as vacant. II. That the bond of the Comptroller-General, Secretary of State and Treasurer shall be auuually examined by the Governor, and if any surety in either of the aforesnid officer's bonds should die or depart perma? nently from the State, or if the said Governor should, at the time of bis examination or at any other time, be oi" opinion that either of the said sureties is not worth as much, clear of debt, as his proportion of tho oldi gatjon to which his name is affixed, he, the said Governor, shall cause the said public officer, whose surety has departed this life or removed from the State, or is objected to for insufficiency of estate, as aforesaid, to be noti? fied of such exception ; and the said officer shall, within thirty days after the service of such notification, procure other satisfactory surety to the said Governor, for such as have departed the. III. That as soon after the ratification o? this Act os practicable, 5^ the Treasurer shall furnish to the several boards of Commissioners appointed to approve the security given by public officers, a statement of the names of the sureties and the amount of the bonds of the several District officers within their respective Districts, which said Board shall forthwith report in writing to the Treasurer whether any and which of said sureties have died, or removed permanently from tho Stab*, orare not wort h as much, idear of debt, as his proportion of the obligat ion to which his name is affixed ; whereupon the Treasurer shall cause a notice to be served on each public, officer whose bond is re]>orU'd as insufficient, and sueli public officer shall, within thirty days from the service ?il* such notice, procure other security satisfactory to the said Treasurer, or produce evidence satisfactory to the Treasurer that the surety reported as insuffi? cient is worth as much, clear of debt, as his proportion of the obligation to which his name is affixed ; and the office ol' any publie officer win? shall fail to comply with the requisitions of this seeti'ui of this Act, within t he said thirty days, shall be regarded as vacant. IV. That every District officer hereafter to be elected or appointed, who is required to give bond for tho faithful performance of the duties ?d' his office, shall be required, within thirty days after such election or appointment, to have his said bond recorded in the office of the Register of Mesno Conveyances for the District in which such officer resides, und the Register shall keep a separate book, properly indexed, for the pur? pose of recording .such bonds ; which hook shall be provided by the Commissioners of Publie Buildings, and shall br-entitled to exact a fee from the public officer of one dollar bu- recording his bond. V. That the various persons .now constituting the Board ol' Com? missioners to approvo tb? security offered by the various District officers, shall continue to perform the duties now required by law until the adjourn ment of the next regular session of the Geuerol Assembly of this State ; and the Genend Assembly shall, at its next regular session, and at tin expiration of every four years thereafter, appoint, live persons in each Judicial District, who shall thereafter constitute a Board to approve thf security offered by the various District officers within their respeetivc Districts?, whose duty it shall be t<> examine annually into the condition, as to the solvency of the?said bonds, omi report thereon in writing to tin Treasurer of the State on or before the first Monday in duly in each year, lu case of any vacancy in tho said Boord, before the expiration oi' th. time for which they may have been appointed, such vacancy sholl b? tilled by the Governor until the m-xt regular period for appointment, on? a majority ?if tho Board shall constitute o quorum authorized to perforn any duty required of them by law. VI. Tb? sevfiral Railroad Companies ia this state, and all persona who have oom? plaints to make of excessive or unequal charges, or violations of their charters by said roads, will take notice that the fol? lowing joint resolution of the Oeneral Assembly was adopted at tho last regular session: Resolved, That a Special Commission, consisting of two members of the Senate, ?and one from each Congressional District in the House, bo appointed to investigate and report to this General Assombly, at ita next regular session, tho complaints made of excessive and unequal charges by the different .Railroad Companies of this State, and to inquire if, ami in what manner, they havo violated their respectivo char? ters. That the said Commission have power to summon such witnesses, and to require tho production of such books and papers as may bo necessary, and also to inquire and report what charters are sub? ject to amendment: and in those casen where amendments arc practicable, what changes should be made to protect thc interest of the public. The Commission appointed nuder the foregoing resolution, hereby call upon all persons having knowledge of material facts relating to thc matters embraced in said resolution, to forward statements duly authenticated to the several mem? bers of the Commission as hereinafter indicated. Complaints and charges i elating to the Greenville and Columbia Railroad, the blue Ridge Railroad, tho Laurens Rail? road, tho Spartanburg and Union Railroad, may bo forwarded to Ci. F. Townes, at Greenville C. H., or to W. S. Grisham, at Walhalla. Charges and complaints relating to the South Carolina Railroad, may bo forwarded to M. C. Butler, Edgotield C. H.. or !;. S. Duryea, at Charleston. Those relating to tho Charlotte and South Carolina Railroad, ami the King's Mountain Railroad, may be sent to B. W. Ball, at Laurens C. H. Those relating to the "Wilmington and Manchester Railroad, and the Cheraw and Darlington Railroad, may be sent to Harris Covington, at- Benucttsville. Those relating lo the North-eastern Railroad, and Charleston and Savannah Railroad, to R. S. Duryea, at Charleston.
