His views arc worthy of con side ration: . It requires no prophetic oyo to sc that the feeling now being engendei - -ed between the debtor and cr?dito -class (unless a course of conduct dil ferent from that now being pursue by both parties bo adopted) will cu! ?minute in deadly hostility, in lawless mess, and in serions injury to th -agricultural interests of the countrj On. ?ne hand, the debtor? whose pro: pe ri ty consisted principally in slavei and who, by reason of emaucipatioi Ls not now possessed of property su fiaient to discharge his pecuniar liabilities, feels that the action < Government has relieved him fro! nil moral obligation, and is, therefor ' indifferent as to tho payment of h debts. On the other hand, tho cr?dito ?wring this indifference, is, in mo cases, proceeding to obtain jud ment fn ?a.to bo v^pdv.ta eufarce tl -.ullection ol his debt to the extent the debtor's assets, whenever tho '. shall allow him so to do. This course of conduct, by thc .ftpeetiveparties, brings about mut charges of dishonesty and un: dealing, and must, if persisted eventually lead to a state of thi easily imagined, hard to be depict and greatly to be deplored. I propose, briefly, to establish proposition, that in all cases of dc contracted prior to tho 1st day Jone, 1866, where the debtor has a sufficiency of property to discho all his liabilities, without leaving family comparatively destitute, will be to the interest of the deb ta- the interest of the creditor, for the good of the country, 1 there should be a compounding tween the parties at once, they tah for their guide the rule of con. prescribed by Him who spake never man spoke, viz: "As ye wc * that men. should clo unto you, do also unto them likewise." Second. Will it be tb the interest of the creditor? Every lien obtained 'diminishes the assets of the debtor to the extent of costs, at least, and takes from the creditor tue collecting 'com? missions. Although the State has no bankrupt law, and may not have the constitutional power to pass one affecting contracts made prior to its I enactment, it is almost certain that Congress will very soon pass a gene? ral bankrupt- law, in which they may, os they have power to do, in the dis? tribution of the assets of the bank? rupt, put all debts upon the same footing, in entire disregard of local liens; but if such law to bo passed sb mild give priority to hens, the ex? penses of the proceedings in bank? ruptcy onst necessarily take prece? dence of everything else; and judging from the experience of those who are familiar with tho operation of the bankrupt acts heretofore passed by Congress, there will be precious little loft for distribution among creditors, leaving the creditor not, by many degrees, as well off as he would have been by compounding now, without costs and without judgments. In? sides, if the creditor compounds now and discharges tho debt, leaving to the debtor not only what is exempt by our ins lvent laws, but a suffi? ciency of property to enable him to live and hope, my word for it, if he be a man imbued with proper sensi? bilities, he will bo a hundred-fold more anxious to discharge the moral obligation of a debt from which be has been released by the voluntary action of his creditor, than he ever will be if released by operation of law. In the one case, he will feel that he is relieved from his legal obligation merely-in the other case, he will feel that ho hus boen relieved from his mond as well us his legal obligation. Such is the nature of man. S.?, that in every aspect of the subject, it seems to me, it is to the interest of tho creditor to com? pound now. Liet the debtor und creditor alike, remember tho proverb, "A prudent mau foreseeth thc evil and hideth himself, but the simple pass on and are punished." Third. Will it be for the good of the country? It is undeniable that the largest number ol' persons, who have not a sufficiency of property left .todischargc their indebtedness, bc-' hing "PTVrn r ngim-fl tn VJll ClOSS of OUI* citizens, and have been" hrus?>fc to their present condition by the actidii of the Government in abolishing the . institution of slavery; and unless these persons can, iu some way, be relieved from tho incubus of indebt ' edness incurred prior to the 1st ol June, 18G5, tho country must lose tho benefit of a large portion of its ag ! ricnltural talent and enterprise. Thc ! last Legislature of the State, seeing the difficulties in thc promises, at ' tempted a remedy in the passage ol what is known as '"The Scay Law;" ' but, with the meagre croj-s of this year, amounting, in many districts ol tho State, almost to a failure, taken in connection with the construction put upon said act by the Chairman of tho Judiciary Committee, who reported the bill, that a failure to pay one-fourth of a debt by first day of January of any year, makes the whole collectable, it is now reasonably cert:1':-; that said act will not afford the relief iutondeiL SOUTH CAROLINA INSTITUTION FOR THF.
