SEC. 2. And that any person who, under color of any law, statute, ordinance, regu? lation or custom, shall subject, or cause to be subjected, any inhabitant of any State or Territory to the deprivation of any ri^ht secured or protected by this Act, or to punishment, pains and penalties on account of such person having, at any time, been held in a condition of slavery or involunta? ry servitude, except for "the punishment for crime, whereof thc party shah have been duly convicted, or by the reason of his color or race, than is prescribed for tho Sanishmeat of white persons, shall be eemed guilty of a misdemeanor, and, on conviction, shall be punished by a fine not exceeding $1,000, or imprisonment not ex? ceeding one year, or both, in the discretion of the court. j SEO. 3. That thc district courts of thc United States, within their respectiva dis? tricts, shall have, exclusively of tho courts of the several States, cognizance of all crimes and offences committed against tho provisions of this Act, And also concur- { rently With the circuit courts of the United State's, of all causes, civil and criminal, af? fecting persons who are denied or cannot enforce in thc courts or judicial tribunal of the State or locality where they may be, any of the rights secured to them by the first section of this Act; and if any suit or prosecution of civil or criminal, has been or shall be commenced in any State court 1 against any such person for any cause i whatsoever, civil or criminal, or any other person, any arrest or imprisonment, tres- 1 passes or .wrong done or committed, by virtue or under color of anthoritv derived from this Act, or the Act establishing a bureau for the care of freedmen and refu? gees, and all Acts amendatory thereof, or for refusing to do any act upon thc ground that it would bc inconsistent with this Act, such defendant ?hall have the right to re? move such cause for trial to thc proper district or circuit court In the manlier pre? scribed hy the Act relating to habeas corpus and regulating judicial proceedings in certain cases, approved March 3, 1SR3, and ali Acts amendatory thereof. The Jurisdiction in civil and criminal matters lereby conferred on the district and circuit courts of the United Statos shall be exer? cised and enforced in conformity with the laws of the United States, so far as such laws are suitable to carry the same into effect; but in all cases where such laws aro not adapted to thc object or are deficient in the provisions necessary to furnish suit? able remedies and punish offences against the law, the commun law as modified and changed by the Constitution and statutes of the State wherein the court having ju? risdiction of the cause, civil or criminal, is held, so far as tho same is not inconsistent with the Constitution and laws of the United States, shall be extended, ami go? vern the said courts in the trial and dispo? sition of such cause, and, if of a criminal nature, in thc infliction of punishment on the party found -milty. Ssc. 4. That tho district attorneys, mar? shals and deputy marshals of the United States, the commissioners appointed by the circuit and territorial courts of the United States, with powers of arresting, imprisoning or hading offenders against the laws of thc United States, thu officers and agents of the Freedmen's bureau, and every other officer who may be specially empowered by tho President of tin United States, shall be and they aro hereby spe? cially authorized and required, at the ex? pense of tho United States, to institute proceedings against all and every person who shall violate thc provisions of this Act, and cause him or them to be arrested and imprisoned, or bailed, as the case may ho, for trial before such of the United States or territorial courts as by this Act have cog? nizance of tho offence; and with a view to affording reasonable protection to all per? sons in their constitutional rights of e ; ial ity before the law, without distinctio i of race or color, or previous condition of slavery or involuntary servitude, except as a punishment for crime, whereof the party shall have been duly convicted, and tho prompt discharge of the duties of this Act, it shall bo the duty of tho circuit courts of the United States and the superior courts of the Territories of tho United States from time to time to increase the number of commissioners, so as to afford a speedy and convenient means for thc arrest anil ex? amination of persons charged with a viola? tion of this Act. } Sic. 5. That said commissioners shall ve concurrent jurisdictitf? with tho of tho circuit and district courts of ';V>d States, and the judges of the and collectively, in term time and vacation, upon satisfactory proof being made, to issue warrants arid precepts for arresting and bringing before them all offenders against the provisions of this Act, and on examination to discharge, admit to bail, or commit them for trial, as tho facts may warrant. SEC. C. And such commissioners are herebv authorized and required to exercise and discharge ail the powers and duties conferred on them hy this Act, and the same duties with regard to offences cre? ated by this Act, as they aro authorized by law to exercise with" regard to other offences against the laws of thc United States. That it shall be the duty of all marshals and deputy marshals to obey and execute all warrants and precepts issued under til* provisions of this Act when to them directed; and should any marshal or deputy marshal refuse to receive such war? rant o"r other process when tendered, or to uso all proper means diligently lo execute the same, bo shall, on conviction thereof, bo fined in the sum of one thousand dol? lars, to the use of the person upon whom the accused is alleged to have committed tlie offence; and the better to enable the said commissioners to execute their duties faithfully and efficiently, in conformity with the Constitution of "the United States and thc requirements of this Act, they arc hereby authorized and empowered, within their counties respectively, to appoint, in writing under their hands, one or more suitable persons, from time to time, to execute all such warrants and other pro ! cess as may be issued by them in the law? ful performance of their respective duties, I aud the persons so appointed to execute any warrant or process as aforesaid, shall have authority to summon and call to their aid the by-standers or a posse com ?tatns of the proper county, or such portion of the land or naval forces of tho United States, or of the militia, as may be necessary to the performance ot the duty with which they are charged, and to insure a faithful observance of the clause of the Constitu? tion which prohibits slavery, inconformity with the provisions f this Act: and said I warrants shall run and be executed by said I officers auywhere in tho State or Territory j within which they arc issued. SEC. 7. That any person who shall'Know? ingly and wrongfully obstruct, hinder or prevent any officer or ot her person charged with the execution of any warrant or pro? cess issued under thc provisions (if thia Act, or any person or persons lawfully as? sisting bim or them, from arresting any person for whose apprehension such war? rant or process may have been issued; or ! shall reseno, or attempt to rescue, such person from the custody of tho officer, ? other person or persons, or those lawfully I assisting, aa aforesaid, when so arrested, pursuant to the authority herein given and I declared: or shall aid, abet or assist any j person so arrested as aforesaid, directly or indirectly, to escape from the custody of [ the officer or other persons legally autnor ! ized, as aforesaid, or shall harbor or con 1 ceal any person for whom a warrant or I process shall have been issued as afore* j said, so as to prevent bis discovery and t arrest, after notice or knowledge of the ! fact that a warrant has been issued for the I apprehension of such person, " shall, for either of said ofiences, bo subject to a fine I not exceeding $l,00u, and imprisonment ? not exceeding six months, by indictment beforo tho district court of the United States for tho district in which said offence may have been committed, or before the proper court of criminal jurisdiction, if committed within any one or the organized Territories of the United States. SEC. 8. That the district attorneys, the marshals, their deputies, and the clerks of the said district and territorial courts, shall be paul for their services the like fees as may bc allowed to them for similar ser? vices in other cases; and in all cases where the proceedings are before a commissioner, he shall bo entitled to a fee of ten dollars, in full, for his services in each case, inclu? sive of all services incident to such arrest and examination. The person, or persons, authorized to execute the process to bc is? sued by such commissioners for the arrest of offenders against the provisions of this Act, shall be entitled to a fee of five dollars for each person he. or they, may arrest and take before any such commissioner, as aforesaid, with such other fees as may be deemed reasonal by such commissioner for such other additional services as may I be necessarily performed by him or them such as attending at the examination, keeping the prisoner in custody, and pro I vidmg food and lodgings during his deten? tion, and anti) the final determination of such commissioner, and in general for per? forming such other duties as may be re? quired in the premises, such fees to be made up in conformity with the fees usual? ly charged by thc oilicers of the court of justice within the proper district or county, as near as practicable, and paid out of the Treasury of tho United States on the certi? ficate of the district judge within which the arrest is made, and to be recoverable from the defendant as part of the judgment in case of conviction SEC. 9. That whenever the President of I the United States shall have reason t<> bo ! lievo that offences have been or are likely ' to bc committed against the provisions of j this Act within any judicial district, it j shall be lawful for hun, in his discretion, to ? direct thc judge, marshal and district at ! torney of such district to attend at such place within the district and for such time I as bc may designate, for the purpose of the moro speedy arrest and trial of persons charged with a violation of this Act, and it shall be the duty of every judge or other officer, whoo any such requisition shall bo received l y him, to attend at thc place and for the time therein designated. SEC. lt). That it shall bc lawful for the J President of the United States, or such 1 persons as he may empower for that uur , pose, to employ such part of the land or I naval forces of the United States or ot the j militia as shall be necessary to prevent the ! violation and enforce the due execution of , this Act. SEC. 11. That upon nil questions of law I arising in any cause under the provisions I of this Act, a final appeal may he taken to the Supreme Court of the United states.
