Pravidc.l Mayor \V??rnrr% little Joke on the Reporters._ A regular monthly meeting of the City Council was held yesterday afternoon at five o'clock; Dresent, the Mayor, Aldermen O'Neill, Bowen, Voigt, Gage, Garrett, Sweegao, Glo? ver, Johnston, Brown and Blgwald. The call for petitions being made, the follow? ing were presented: Petition o? residents In Duncan street to nave a lam plighted. Referred to committee on lighting the street?. Petition of Henry Ritter to erect a wooden building on Church street. Referred to vbe committee on wooden buildings. At this stage the procedings were Interrupted by Alderman Sweegan, who said he noticed there was not a quorum lu the room, and that lt was contrary to tho ordinance on the sub? ject to proceed with business without a quo? rum. The roll being called, It was lound Al? derman Voigt was absent. He returned alter a few minutes, and was informed by the Mayor that he had rendered himself liable to a fine of from one to fifteen dollars. It being the wish of Council, the fine was not Imposed. The business was then resumed. Petition of Mrs. A. C. Curtis to repair a wooden building at No. 48 King street. Re? ferred tb the committee on wooden build? ings. The Mayor stated, in connection with the petition of residents for lighting a lamp in Dnncan street, that the number of lamps now lighted throughout the city was tan hundred and thirty-nine, against five hundred and thirty when the present Council came Into office, and that the cost ot lighting the present number was"lUtl9 more than that of the lormer. He said that two hundred additional lamps were needed, and asked Conucll whether they would proceed In the matler or stop where they were. On motion ot Alderman Gage, it was decided to postpone further consideration of the matter until the beginning ef cool weather. The quarterly return of the chief of police waa referred to the committee on accounts. A communication from Dr. Robert Lebby, Sr., stating that he had been ordered by the Governor to torn over the Lazaretto Hospital on Morris Island to the city In trust for the State was read, together with the order of the Governor, and referred to the committee on quarantine. The report of the city Inspectors to the 30th of Jone being a very lengthy document was referred to the committee on streets, without being read, and ordered to be printed. The commlt:?9 on retrenchment and relief reported in favor of paying Dr. M. H. Collins for disinfectants furnished the city during the Pillsbury administration, and their report wan ? adopted by the Council. The committee on contracts reported two estimates for building tho new engine house in Smith street; one of Peter Halls for $2650 another of G. W. Egan for $2220. Action on the report was deferred for the present. The committee on public institutions, buildings and grounds reported lavorably ou the recommendations of the medical commit? tee of the Board of Health' for the establish ment of an lnsaae hospital and alteration of the House ot Correction into a city hospital, and recommended that they bi carried out, provided the cost do not exceed ten thousand dollars. The report being long was ordered to be printed, and action deferred until the next regular meeting. A resolution Was -adopted authorizing the city Sheriff tu provide a Jury box and a jury List for the City Court. The following resolution, offered by Alder? man O'Neill, was adopted after a little discus? sion : Resolved, That the penalty now charged against all defaulters, as well as that paid since the 15th Instant, be remitted them; provided that they, on or before the 1st ot August next, pay their annual tax; and that the two remain? ing terms fixed for the payment of quarterly taxes be extended to the first days of October and January next respectively. Alderman Bowen offered a resolution au? thorizing the Mayor to appoint temporarily a city auditor, whose duty it should be to audit all accounts against the city, with a salary at the rate of fifteen hundred dollars per annum. Adopted. Alderman Voigt said that the dally papers had published that the city attorney had made a motion before Judge Graham for the remo? val of the Injunction against the Council lr. the Enterprise Railroad case, and asked whether the city attorney bad been authorized by the Connell so to proceed, as he wanted to know If the Connon Intended the repairing to be done to the streets by the Euterprise Railroad Company. The Mayor, after stating parenthetically that the statements of the press were not always to be relied on, stated that he bad instructed the city attorney some time ago to make ap? plication for the removal of the injunction He then read a letter from the latter stating that action had been prevented in the matter until yesterday by the absence from the city ot the Hon. J. B. Campbell, counsel for the com pany, and that yesterday the judge was pre? occupied with other cases. He concluded by saying that the case would be carried before Judge Graham this morning, and thus, after all, confirmed In every particular the accuracy of THE NEWS reports. Aldeiman Bowen called attention to a print? ed petition of the vestry and wardens of St. Philip's Church, with the city attorney's opln lon thereon, and the report ol the commlttoe on retrenchment and relief, and suggested that action upon it be defered until the next regular meeting, so that the members could take the pamphlet home and read lt. His suggestion was adopted, and COUBCII then adjourned. The petition above alluded to sets forth that the Te8try and wardens of St. Philip's ChNrch have been assessed for taxation upon certain real estate in the City of Charleston known as the glebe land of St. Philip's Church, given to the minister ot Charlestown for the use o? the church by Mrs. Alfra Coming in 1698. This land was divided Into lots and let out on leases, perpetually renewable, on certa'n rents, the limita of which were fired by an act of the Legislature, passed in 1770. These lands were never taxed by the State, and this Immunity was recognized and confirmed by the successive constitutions of the State until 1868. The Courts ol the State have re? peatedly affirmed the right o? exemption from taxation by the City of Charleston, in conse? quence of this exemption by the State. The officers charged with the duty of assessin and collecting taxes for the State and for the City of Charleston now claim that no property held by the petitioners is exempt trom taxation, other than the church build? ings and cemeteries connected therewith The petitioners do not propose, however, to dispute or call in question thia construction of the present law. A part c of this property situated on Glebe street is t exempt by reason of an agreement to that ef t feot entered into by the Cit Council with the church In consideration of the opening of t Glebe street through glebe land, and the pay- s rr. ?n t by the church of certain sums of money, b The building on the northeast corner of Church and Queen streets being used as a i home for the poor, ia an institution of purely public charity, and as Buch ia exempt by the provisions ol the constitution. The peti? tion ends by praying that the petitioners be relieved from paying taxes upon such property as shall be found to be exempt fi-om taxation. The opinion of the city attor? ney is unfavorable to the exemption of the property on Glebe street, but is favorable to the exemption of the building upon the cor? ner of Church and Queen slreetB.. The report of the committee on retrenchment and relief recommends that the petitioners be exempted from all past due taxes on the property on Glebe street, and declares that the building above noticed is actually exempt. THE ENTERPRISE RAILROAD CASK.-The motion for the modification of the injunction against the City Council In the Enterprise Railroad case was made before Judge Graham yester? day by the city attorney, .but owing to the ab? sence from the court-room of the Hon. J. B. Campbell, counsel for the company, the case was continued to this morning at ten o'clock. REAL ESTATE SALES.-Messrs. Lowndes &? Grlmball sold at auction yesterday the wooden residence on the north side of Hasel street, long occupied by the Rev. C. P. Gadsden, lor $4600-one-fourth cash, balance In one, two and three years. Mr. William McKay sold a house and lot on the back beach of Sullivan's Island for $476 cash. ANOTHER INJUNCTION_On motion of A. G. Magrath, Jr., and G. L. Buist, Judge Graham yesterday Issued a rule temporarily restricting A. M. Mackey, and all other trial justices of | the State of South Carolina, from Interfering in any way with the members of the Charleston Joint Stock Company, and requiring them to Bhow cause, on Monday, 29tb of July, why a permanent Inj unction Bhould not be issued. A NEW RACE BOAT.-A bran new racer, JuBt from the hands of ingersoll, arrived on the steamship James Adger yesterday for the At? lantic Rowing Club. Some members of the club had her upon the water in the afternoon testing her merits. She ls a white boat, with black walnut seats and foot board, and ls thirty feet long by three feet beam. She will be named the Wave and entered for the next race. CRUMBS.-John Dozier and not John Dolan was arrested a lew days ago for stealing three hams. Dozier gave his name as Dolan, with the hope of being discharged. A match game of base ball will be played upon the Citadel Green, this afternoon, be? tween the Gray Stockings and the Emeralds. It was C. Oakmau and not R. Oakman who was fined on Monday morning for last driving through King street. BOBBERT.-A robbery was committed on Monday last at the drug store of Mr. D. Vogt, King street, opposite Hasel. The bedroom of Mr. Vogt, above the store, was entered some time during the afternoon and robbed of a number o? articles of clothing and a gold Masonic pin. The thief effected an entrance hy cutting a large hole through a wooden par? tition that separated the room lrom a closet at the head of a flight ol stairs. The detectives ire upon the track. CLUBS AND STARS.-Hollins Peck and Ed? mond Huott, two United States soldiers who became drunk and disorderly iu Meeting street, Monday, wore turned over to a trial ?UHtiCP. W. Brimson, up on charge of shooting a dog in Amherst street, Monday night, explained that it was accidental, and was dismissed wlth 3Ut penalty. Julia Simons and Jane Robinson, colored vagrants, trespassed and became disorderly ipon premises in Shepherd street. They were jent to the House of Correction for thirty lays. Kate Pinckney, for being drunk and disor lerly, and abusing a policeman, was allowed he option of paying one dollar or spending en days in the House of Correction. George Alston, colored, found lurking about he premises of a gentleman living in Calhoun treet, being unable to give an account of his usiness there, was held for examination. A cow, captured in Friend street, was dellv red lo the owner on payment of one dollar. CITY IMPROVEMENTS. St. Haul * Church to he Refurnished A New Store on East Bay. The interior of St. Paul's Church, Radcllffe boro', is about to be remodelled to suit the modernized Ideas of Its congregation. The old high-backed pews are to be taken out and their places supplied by others ot a newer and neater order. The new pews will have square fronts of black walnut, with sunk panels .and heavy beading, with borders to the backs of j the same material, and will bo supplied throughout with green cushions. The aisles and chancel will also be furnished with new carpets by the ladles of the congregation. The pews are being made by Mr.'P. P. Toale, of this city. The work of tearing ont the old pews will be commenced about the latter end ot next week. A new three Btory brick building ls about to be erected on East Bay, ono door north of Qulgnard street. Ic will be twenty-five feet front by Bixty deep, and will have an Iron front on the first 6tory, with square windows ?nd doors. The first story will befited up as a store, and the others as a dwelling. The contract will be given out on Saturday, and the work commenced next week. The build? ing will be erected for Mr. James Kerney, (he owner of the lot. TBE HEAT YESTERDAY. UNITED STATES DISTRICT COURT.-In the case of the United States against two horses, harness, wagon and eleven boxes manufac? tured tobacco, informatiou for violation of the re veone law, upon the return of the writ of venditioni expon as, the sum of ninety-two dol? lars and forty cents having been paid into court, twenty-two dollars and ninety-five cents was ordered to be paid .'to Wallace and Donaldson for the use of the court, and thirty four dollars and seventy-three cents to each of | them as informers.
