THE CHT- or POLICE VS. Darxonvx COATES um DsTEcnvE COATES VS. THE CHIEF or Po LICE.-On Tuesday last THE NEWS mentione :he arrest of a yoath named John H. Blah by Officers Coates and Quinn, apon the chug of appropriating money from the till of th oroprietor of the American Hotel, said Blanl having been employed as clerk for aim months, the salary for which time amounte< io $140, yet he had bought $280 worth of cloth [og, had $75 in bank, and $80 in bis pooke when arres ted. The case was carried before Justice Krna paux, and the prosecutor consented to drop the case if the accused would retara the $75 ia bank ?od the $30 fou nd in bis pockets, sad then leave the o ty. This the accused consented fx io, and signed an agreement to that effect On Wednesday afternoon Officer Coates carriec Blank to the steamship Saragossa to see th it be complied with the latter part of the agree? ment, viz: to leave the city. On the wharf t difficulty occurred, the points of which will be found in the testimony before the Mayor yes fcarday morning, bef?te whom Officer Coates was arraigned to answer the charge of insub? ordination, preferred by Captain H. W. Hen? dricks. Mr. J. Barratt Cohen appeared as counsel foi Officer Coates,' and the Hon. D. T. Corbin tc represent the eily (as City Attorney, we sup? pose, bat it is very difficult to keep the run ol his duties.) Captain Hendrick') testified, substantially, that he bad heard that Officer Coates had gone to the steamer's whirf to ship the boy Blank, and, with Officer Beed, he went there also, When he arrived he saw Coates and Blank on the wharf. He called Blank to him, whereupon Coates arose and said be should not bave the boy. He then ordered Officer Beed to arrest Coates, who said Beed should not arrest him, and pat his hand behind him as if to draw a pistol. Witness theo jumped at Coates, caught bim by the collar, and shook his cane over bis head, and said, "You infamous scoundrel, you dire to resist mel** Officer Beed testified that when he was ordered to arrest Coates, he (Coates) said he would not be arrested, and pat his hand be? hind him, where he usually carried a piet il; thoo Captaio Hendricks caught Coates by tbe collar and shook the cane over his head ; that a f - terward Coates came quietly along with bim to the detective office. Blank testified substantially the samo as Captain Hendricks and Officer Beed. Mr. Moses Levy, who was summoned as a witness by Captaio Hendricks, testified that he vvas on the wharf loading tho bteamabip Trhen he observed Captain Hendricks and Offi? cer Reed como up, aud heard tbe Captain call Blank, who was with Officer Coates, to como to bun; saw Coates get up and advanca two or three paces, bat did not beor him make any remark. Then saw Captain Hendricks catch Coates by the collar and shake his cane over Coat o's hoad, and called him ad-d scoundrel. Coates theo put his hand behind him and called to witness to be a witness to tbe affair. Coatee made no resistaoce. Officer Coates stated that while he was sit? ting on the wharf with Blink, who had ex? pressed his desire to leave the city, Captaio Hendricks came up and called Blank. I told Blank to go to him. Captain Hendricks then said to me, "You d-d scoundrel, go to the office." He then told Officer Beed to arrest me. I said Officer Rood can't arrest me. Cap tarn Hendricks then caught me by the collar and called mo a d-d infamous scoundrel, and then shooB a loaded cane over my head. 1 then put my hand behiud me and said : "Don't you strike me." I thea called to Mr. Levy to bo a witoess of tbe affair. At the conclusion of the testimony the Mayor announced that he would reserve bis decision. Mr. Cohen then rcqnested the Miyor to en? ter charges against Captain Hendricks, first, for violation of thc duties of his office; second, for ao assault and battery. Bin. k, who has been mentioned io the city papers as chorded with dishonest appropria? tion of his employers funds, had a full bearing yesterday afternoon before Magistrate Mackey, which resulted in his discharge. We are in? formed that Blank's friends, convinced of his innocence, and indignant at the treatment he has received, design prosecuting the parties who are responsible for bis alleged unjustifi? able imprisonment. THE CUSTOMHOUSE SQUABBLE at Washington, it would appear, waxes furious. There is, we believe, little doubt that, as matters stood yes? terday morning. Dr. Mackey's friends bad suc? ceeded in securing his reinstatement, but Clark, it seems, holds on with something of the tenacity which he displayed as military Mayor of the city; and a dispatch was in circu? lation last nicht to the effect that Clark had actually been reappointed during tho after? noon. Both of the contestants, with all the friends and backers they can muster, are in Washington, and it may be presumed that the end is not yet. CBUKBS.-Magistrate DeLaree, colored, states that he has made no attempt to have any of the magistrates removed. There dre efforts being made to have somo of the magistrates removed, bat Magistrate Kanaoaux is not one of the n, as was reported. The residence of Major George L. Buist was entered early Wednesday morning, and a num? ber of bats were stolen. Mr. E. C. Thar in, who received in 1844, from Governor Hammond, a commission as notary public, found it necessary, nader the recent laws, to seoure another commission. He ap? plied to Governor Soott for it, and received it yesterday. The Willoughby stock went ap to high fig? ures yesterday, and bis friends are certain that he will be Chief of Police. The office of Clerk of the Market bas a good many candidates, among them W. T. Lovett, wh o is receiving the support of a good many of oar citizens. A caucus of the Pillsburyites was held ia the City Hall last eight. It is reported that cham? pagne, sandwiches, Ac, added interest to the meeting. It is rumored that grave charges will be pre? ferred against Captain Hendricks before Coun? cil to-night. A seaman nvned Fred. Smith deserted from the brig Monica yesterday, bat was captured shortly afterwards by Officer Qoion and tamed over to his officers. Bamor bas it that W. N. Taft, Captai ? H. W. Heedricks, C. B. TO THE EDITOR OF THE HEWS. As a member of the City Council who voted for the election of a City Coroner, I beg leave respectfully to dissent from the statement in your issue of this dato, that "there is no such . officer as City Coroner." Section * of the act of August 13,1783, entitled "An act to incor? porate Charleston," (still uuropcaled) declares that "the City Council are hereby authorized to appoint a Coroner for said city." Section 10 of on act of December 17,1817, exteods the jurisdiction of the City Coroner over the Par? ishes of St. Philip's and St. Michael's, or in j other words au th or iz 3d him to officiate throughout a territory extending about six miles beyond the limits of the city proper. Thus far we are doubtless agreed; but yon allege that Section 10 of the act of December 17,1817, having been repealed by aa act of March 26,1869, therefore the City Council have no power to elect a City Coroner. I do not think that this conclusion is warranted by the premises. The repeal of the act of 1817 leaves the office of City Coroner jost where tuat act found it, for that act simply extended the Coroner's jurisdiction beyond the proper corporate limits of the city. This is the full legal force of the act o? Marsh 26, 1869, upon which you base your conclusion. To hold otherwise, is to argue that to restrict the jurisdiction of aa officer is to abolish the office; for this last act only repeals the oct ex? tending the jurisdiction of the City Coroner, and nothing more, leaving untouched the clause of the original charter, whereby the "City Connoil of Charleston are authorized to appoint a Coroner for said city/* Moreover, even though the act of March 26, 1869, bad expressly declared the office of Citv Coroner abolished, it would have no validity, because the object of the act is not expressed in its title, as required by the Constitution of the State.
