THE Fran DEPARTMENT.-Wo have received from M. H. Nathan, Esq., Chief of the Charles? ton Fire Department, his annual report for the year ending Aptil 27, 1869. His statement of tho condition of the department is eminently satisfactory, and the comparison between the expensts of other citiea and those of oar own for the protection of property is worthy of careful consideration. Pride in the gio . rious memories of (be past, and sorrow in the realization of our almost unparalleled losses. But yesterday as it were, and wo were assem bled'together, it is true, but for a very differ? ent purpose from the mournful one whioh brings us here ibis evening. Thou the boom? ing of great guns from yon battle-so arr ed and blood-stained fortresses, and the strains of martial music, summoned us to the posts of honor and of duty. Now the simple notice of a morning's paper calls upon us to perform tho highest, the saddest duty we owe iu life to those wno, in obedience to their country's call, have gallantly and generously laid down their lives in ito defenoa. Then we wore strong in numbers, strong in discipline, and strong in hope. Now we are decimated, disor? ganized and .oppressed. How sudden the change-how ead the ? on tr as tl Where, let mo ask. are most of those who, bat a few years ago, stood shoulder to shoulder with us in defence- of this our dear cid city ? And what were their deeds that we now assert our right to render their names immortal ? Alas 1 Mr. Chairman, both you and those surrounding you already know too well the sad story ol their fate, and in no event could we now, con? sistently either with our past record or our present intentions, indulge in vain boastings of that past. That record is Doth written and unwritten. To those who would examine the former we would say, read the history of that day,and whether it be written by sympathizing friend or by envious bitter enemy, they will find the status of those we now propose to honor remains the same. To those who would consult the latter, we would say visit the grim ruins of Sumter, Moultrie, Wagner, Gregg, Pemberton. Pringle, Marions Rutledge, and ol Bee, and while treading lightly o'er their once formidable battlements, and even within react of tho whitened bones of their heroic dead there let them read in silenoe the proud history of their deeds. And, ii it be poa Bible for thom to comprehend the language of the mighty deep itself, thea let then at midnight and with fistful ear inter pr?t its mournful dirge while es oh euc cessive wave joins in the grand chorus ol love and praise to those who loved their coun? try first and for it breathed their last. From this let them turn to the fertile plains anc barren hill tops of the Old North State, ant there at leisure count the modest mounds un der wbioh our gallant comrades sleep theit last Bleep, and from which no sound can awake them to glory again. Buch and only such, Mr. Chairman, are the references we would fur nish those who may require further evidence: of our claim upon them for sympathy and ai< in the work before us, and with the earnesi hope that our efforts in this behalf may provt successful, I now proceed to submit to tnt meeting the report of their committee. Th? committee appointed st tho mooting o the 28th of April last, to dr?w resolutions ant prepare business for the meeting in June would respectfully submit the following pre amble and resolutions as their report : Whereas, During the late struggle for South ern independence the First South Carohni Brigade (Regulars) composed ol the Firs South Carolina Artillery. First South Oarolini infantry and Lucas' Battalion, while engaget in the defeooe of the chief fortifications o Charleston harbor, and afterwards in tin sanguinary battles of Avervsboro' and Ben tonville, sustained heavy losses, both ii officers and men; and whereas, it is eminen tb proper that a suitable monument should bi erected in honor of those who by their lofty patriotism, resolute courage, patient fortitude and perfect discipline, were enabled to per form, with honor to themselves and with credi to the service, the difficult part allotted tt them, and have thus gloriously completed tba record to which we will ever point with un feigned pnde. Therefore, be it 1. Resolved, That we, the survivors of sait brigade, whose names are hereunto sub son bed, do hereby unite ourselves into an as sociation to bs composed of its surviving offi eera and men. 2. Resolved, That a oomrni tee of niue, com posed ot three from each regiment, two fron Lucas' battalion, and one from the Gist Guarde be appointed, whose .duty it shall be tosolioi and receive subscriptions for the purpose c erecting a monument in honor of our dooease officers and men, who lost their lives in derona ing the liberties of our common country. 3. Resolved, That the president be anthe ized to increase said oommittee to Alteen i number, should he deem it advisable. 4. Resolved. That each member of tfcisassc elation be required to exert himself in this bc half, within the limits of his county, city c town, and that all the amounts so raised b forwarded to one of the members of the abov mentioned committee, representing the reg mentor battalion to which he belonged, ont before the 1st day of January, 1870. 5. Resolved. That said committee be autho: isad, when in fonds, to receive estimate and designs of said monument, from euc architect or architects of the State as may di sire to furnish the same, wbioh shall be sui mittod to an adjourned meeting of this assoc arion. e. The court opened at 10 o'clock yesterday morning, Chief Justice Chase and Judge Bryan on tbe bench. Chief Justice Chase delivered the opinion of the court in the case of Bastin vs. Baggett, overruling the demurrer. On motion of Pres? ley, Lord ta Ingles by, complainants solicitors, it was ordered that the defendant do answer on or before rules day in July next. Robert L. Livingston and Mary 8., his wife, et al, VB. Valentine Jordan. Trespass tn ?ry title. v A verdict having been rendered for plain? tiff-} in the above case, on motion of Messrs. Porter & Conner, plaintiffs' attor? neys, it was ordered that a writ of possession do issue in said case for the recovery of the premises described iu the pleadings. The argument in the case of Caroline Carson vs. Alexander Robertson ot al, was resumed by A. O. Magrath, Esq., for plaintiffs, followed in reply by Geooral James Simons and Edward McCrady, Sr,, Esqa. At the conclusion of the argnmont the Chief Justice took the papers and reserved the dooision of the court. The Chief Justioe then announced that thore were no other oases upon either the equity or admiralty docket to be heard, and that the court waa ready to proceed with the remaining oases on the law docket, but that it did not propose to take up any oases after that day. The case of Gooding VB. Yarn was taken ap from the issue docket. This was an as snmpsit on two promissory notes. Ed. MoOrady, Jr., for plaintiff; Campbell & Seabrook, forde fendants. In this case the plea of general issue and pie t of the statute of limitations were set upon the one side, and a replication or de? murrer on the other. The Chief Justioe decided that the statute of limitations under act of Congress was sus? pended from the 19th April, 1861, to the 1st of April, 1866, and overruled the demurrer. J. J. Pope vs. John S. Riggs. Mr. Porter appeared for plaintiff; T. Y. Simons,. Jr., for defendant. Counsel for defence not being ready for trial in consequence of a material witness, the hear? ing was postponed and the case placed on the general docket. Alexander McLeod vs. T. C. Calioott. D. T. Corbin, Esq., District Attorney, moved to set aside the verdict of the jury in this case, on the ground that it was contrary to the charge of the Chief Justice and against the evidence. Mr. Corbin was heard in favor of the motion and Mr. Campbell in reply. The court reserv? ed its decision. Constance Baring, executrix of Chas. Baring, deceased, vs. Ed. L. Trenholm and Henry F. The case of Ephraim Raynard, executor of Wm. E. Raynard, deceased, vs. the United State? Cotton Company, came up for ai hearing in the afternoon sitting ot the court. Wm. This was a motion on the part of the plain? tiff for a writ of possession and to amend pleadings ; and on the part of defendant to vacate judgment. Colonel ALLAN MACFAELANB, had departed this life, when the following preamble ?od resolutions wore offered and unanimously adopted : Colonel ALLAN MACFARLANE was a member of whom any association may justly be proud. He was well known not only to thia communi? ty, but throughout the State, as one of those publio and enterprising citizens whose loss will be deeply felt. In him we, as an associa? tion, rfoognlze the claim his many virtues have upon us, sud particularly his benevolence during the late war, in aiding us in onr works of charity.
