And wh were their deeds that we now assert our rig to render their names immortal ? Alas ! Al Chairman, both you and those surroundii you already know too weir the sad story their fate, and in no event could we now, co sis lent! y either with our past record or o pr?sent intentions, indulge in vain boastin of that past. That record is Doth written ai unwritten. To those who would examine tl former we would say, read the history of tb day.and whether it be written by aympathizii friend or by envious bitter enemy, they w find the status of those we now propose honor re rr ams the same. To those who wou consult the latter, we would say visit the g ri ruins of 8umter, Moultrie, Wagner, Greg Pemberton, Pringle. Manon, Rutledge, and Bee, sud while treading bghtly o'er their om formidable battlements, and even within rea< of the whitened bones of their heroic dea there let them read in silence the prot history of their deeds. And, if it be po sible for them to comprehend the languaf of the mighty deep Itself, then let the: st midnight and with fistful ear into pr?t its mournful dirge while e?oh en ceasive wave joins in the grand chorus c love and praise to those who loved their cone try first and for it breathed their last. Froi this let them torn to the fertile plains sn barren hill tops of the Old North State, an there at leisure count the modest mounds nt dar which our gallant comrades sleep tbei last sleep, and from which no sound can awak them to glory again. The committee appointed at the meeting o the 28th of April last, to draw resolutions ant prepare business for the meeting in June would respectfully submit the following pre amble and resolutions ss their report : Whereas, During the late atruggle for South? am ind?pendance the First South Carolina Brigade (Begulars) composed of the First 3outh Carolina Artillery, First South Carolina Infantry and Lucas' Battalion, while engaged in the defence of the chief fortifications ol Jharleaton harbor, and afterwards in the languiuary barties of Averys boro' and Ben on ville, sustained heavy losses, both in >fficers and men; and whereas, ic is eminently groper that % suitable monument should be ?coted in honor of those who by their lofty patriotism, resolute coora ge, patient fortitude ?nd perfect da aplin e, were enabled to per form, with honor to themselves and with credit bo the servies, the difficult part allotted to ?hem, and have rhos glori joaly completed that record to which we will ever point with un? feigned pride. Therefore, be it L Resolved, That we, the survivors of said brigade, whose names axe hereunto sub (cnbed, do hereby unite ourselves into an as iocdatton to be composed of ita surviving offl :ers and men. 2. Resolved, That s commi tee of nine, corn Meed ot three lrom each regiment, two from Lucas' battalion, ?nd one from the Gist Guards, 39 appointed, whose duty it shall be to solicit ind receive subscriptions for tbs purpose of >rec ting a monument in honor of our deceased ifficere and men, who lost their lives in defend? ing the liberties of our common country. 3. Resolved, That the president be autho zed to marease asid committee to fitteen in lumber, should he deem it advisable. 4. Resolved, That each member of this aeso liatian be required to exert himself in this be ?alf, within the limits of his county, city or own, and that all the amount? BO raised be or warded to one of the members of the above nentioned committee, representing theregi nent or battalion to whioh he belonged, on or >efore the 1st day of January, 1870. 5. Resolved, That said committee be author zed, when in fonds, to receive estimates md designs of said monument, from such irehiteot or architects of the State as may de tire to famish the same, whioh shall be sub nit ted to an adj our ced meeting ot this associ? ation. 6. Resolved, That this meeting do ase?me a Mrmasent organization by the election of a vestdent, eight vice-presidents, a secretary md a treasurer, who shall b3 elected this vening, and hold their offices until the objects if this association shall be accomplished. 7. RttCtoed, That in consequence of the gal ant and meritorious services of the "Gist Juard," Captain T. G. Boag commanding, ?hile attached to thia brigade, its officers and nen be invited to participate with ns in the auction of said monument, and that the name if "Gist G a ard," together with its term of eer rice with the brigade, be inscribed thereon. 8. Resolved, That all funds received by the oem bera ot the committee, appointed from jharleaton, as piovided by tbe second resolu? tos, be trans .erred when received, from lime o time, to the treasurer of this society. 9. Parker, Colonel Rhett was requested lo vacate tho chair tem? porarily, and Major M. Moore to act as president. The -notion being secDoded and adopted, Major Mooie took the chair. Captain C. W. Parker then, in accordance with the sixth resolution to elect the officers jf the association, nominated Colonel Alfred Rhett for president, who was unanimously elected; and for vice-presidents, Colonel Wm. Botler, Lieutenant-Colonels J. A. Yates and Warren Adams. Majors J. J. Lucas, O. Bland ing, T. A Hugoenin, M. S. Moore, M. D., H. D. Horlbeck, M. D.; for secretary, Lieutenant H. W. Frost; for treasurer, Lieutenant F. E. Huger, who were all unanimously elected. Upon Maj?r Moore vacating the chair, Colo? nel Rhett was requested to resume his seat, and, upon doing so, thanked the association for the honor they had conferred upon bim, and assured them that he would do all m bis power to promote the objects of the associa? tion, which we all have BO zealously at heart. The chair then appointed as the committee of nine, called for by the second resolution, Captains C. W. Parker, Meal. Eing, Charles Ioglesby, T. G. Boag, and Lieutenants I. G. E. Gourdin, Jno. C. Minott, Edw'd Mathewea, J. D. Ford, W. G. Ogier. After a few remarks by Lieutenant Johnson as t? the advisability of getting np a racord of the brigade, Lieutenant Minott offered the following resolution, which was duly adopted, viz : Resolved, That a committee of .three, com? posed of Lieutenant Wm. Johnson, of the First Artillery, Lieutenant E. C. Edgerton, First In? fantry, and Lion tenant W. D. Martin, of the Lucas Battalion, be appointed, whose duty it snail be to prepare a history of the brigade, and that they be requested to report what progress they will have made at our next meeting in November. There being no further business before the meeting, Lieutenant Boyleton moved to ad? journ, which being seconded and carried, the meeting adjourned to meet 15th November, 1869, and eight o'clock P. The court opened at 10 o'clock yesterday morning, Chief Justice Chase and Judge Biyan on the bench. Chief Justice Chase delivered the opinion of ? the court iu the case of Eustis vs. Baggett, overruling the demurrer. On motion of Pres? ley, Lord A Ingles by, complainants solicitors, it was ordered that the defendant do .answer on or before rules day in July next. Robert L. Livingston and Mary 8., his wife, et al, vs. Valentine Jordan. Trespass to try title. A verdie t having been rendered for plain? tiff* in the above case, on motion of Messrs. Porter A Conner, plaintiffs' attor? neys, it was ordered that a writ of possession do issue in said case for the recovery of the premises described in the pleadings. The argument iu the case of Caroline Carson vs. Alexander Robertson et al, was resumed by A. G. Magrath, Esq., for plaintiffs, followed in reply by General James Simona and Edward McCrady, Sr., Esqs. At the conclusion of the argument the Chief Justioe took the papers and reserved tba decisi?n of the court. The Chief Justice then announced that there were no other oases, upon either the equity or admiralty docket lo be heard, and that the court was ready to proceed with the remaining cases on the law docket, but that it did not propose to take up any cases after that day. The case of Gooding vs. Yarn was taken -up i rom the issue docket. This was an as? sumption two promissory notes. Ed. McCrady, Jr., for plaintiff; Campbell A Seabrook, for de? fendants. In this case the plea of general issue and piei of the statute of limitations were set upon the one side, and a replication or de? murrer on the other. The Chief Justice decided that the statute of limitations under act of Congress was sus? pended from the 19th April, 1861, to the 1st of April, 1866, and overruled the demurrer. J. J. Pope vs. John S. Biggs. Mr. Porter appeared for plaintiff; T. Y.- Simons, Jr., for defendant. Counsel for defence not being ready for trial in consequence of a material witness, the hear? ing was postponed and the case placed on the general docket. Alexander McLeod vs. T. C. Calicott. D. T. Corbin, Esq., District Attorney, moved to set aside the verdict of the jory in this eise, on the ground that it was contrary to the charge of the Chief Justice and against the evidence. Mr. Corbin was heard in favor of the motion and Mr. Campbell in reply. The court reserv? ed its decision. Constance Baring, executrix of Chas. Baring, deceased, vs. Ed. L. Trenholm and Henry F. Farmer. Bill for aocouot and relief. Wm. Whaley, Esq., for plaintiff. Argument was beard and decision reserved. At the conclusion of this case the court ad? journed to 5 P. M. The case of Ephraim Baynard, executor of J Wm. E. Bayoard, deceased, vs. the United States Cotton Company, came up for a hearing io the afternoon sitting ot the court. Wm. Whaley, Esq., appeared for plaintiff; J. B. Campbell, Esq., for defendant. This was a motion on the part of the plain* alf for a writ of possession and to amend pleadings ; and on the part of defendant to pacato judgment.
