The evidence in this case was read and the ar? gument postponed to this morning. Ibo following is tbe tall opinion of the Chief Justice relative to the motion made on Tues? day, for the continuance of the case of J. M. Alston vs. . John L. Manning, on tho ground that the present jurors are not organized as tbe law directs : The answor lo the application for contin? uance, made in behalf of tbe defendant, must depend on the construction of the acts of Con? gress relating to juries. If the proposition maintained by bira- is cor? rect, that the jury now in steendanoo upon the court is not constituted in conformity with those laws, he cannot be required to submit bis cause to ila determination. The only act wbiob it is now necessary ts consider, is that of July 20, 1840. This act frovides that the qualifications and exemp ions of jurors in the courts of the United States shall be the same as in the highest courts of the l?tate in wbiob trials by jury are held, and that they ''shall be designated by ballot, lot or otherwise, in the' mode practiced in such courts, aa far as practicable by the courts of the United States and their officers." The act of the State, in accordance with which was the mode of designating jurors practiced in tbe State Courts wben the jory now here was selected, was passed in 1809. The rule of thia court conformed to that act as far as practicable. It Ead been modified only so far as to strike out distinction oft account of color. It retained, as the law of the State and the practice of the State Courts, a property qualification. lt is not denied that the jury was constituted according to the law and practice of the State until last year. Then the property qualifica? tion was abolished; and later, within the last two or three months, a rule has been prescrib? ed for the selection of Juries in the several counties, from the white and oolored voters in the proportion of their respective members. And the question is, did these late laws be oome at once the mle of this court so far as to make void the designation of tbe jury selected in conformity with the prior law and the exist? ing rule ? It is only necessary to look at the act of Congress to determine this question. That act does not malte tbe act s of the State Legis? lature alone, but those and the praotioe of the State courts, the guides ot the United States Courts in this matter. That praotioe, of course, is presumed to be in conformity with those acts, and ia most readily ascertained by reference to then. But neither law nor State practice bas instantaneous operation in the courts of the Union. The State praotioe oan only be introduced as far as practicable, and rules are oeoessary to determine how far it is practicable, and to introduce it to that extent. Accordingly the act provides that "the Courts of the United States shall have power to make all necessary rules and regulations for conforming the designation and impanel? ling of juries, in substance, to the laws and usages now in force in such State." This was done by the rule in conformity with which this jar; was designated and im? panelled. In order that future obanges in State law and praotioe might be incorporated into the practice of the national courts, the act pro? ceeds to provide, "And, further shall have power, by role, or order, from tame to time, to conform the same to any change in these re? spects which may be hereafter adopted by the Legislatures of the respective Stales for the State Courts." Under this provision, this court bas power to provid?, and will doubtless recognize the duty of providing, by role, for the future designa? tion of Juries in substantial conformity with the recent legislation. But. until some rule or order has been mide to that effect, that legis? lation has, and under the sot of Congress can have, no operation here. It follows that the present jury was lawfully designated and impanelled, and is not affected by the legislation referred to. The existing rule rejects distinction on ac? count of color. Tho law now rejects, also, dis? tinction on account of property. It will be the duty of the court to provide, by rule, for the selection of impartial, intelligent and upright in one word, competent-jurors, without regard to either of these adventitious distinctions.
