Howland et al vs. Thaddeus ] I Ketty. Bill lot foreclosure. This was a do- ? morrer on the part of the respondents for the purpose of making Hr. Jorey, the executor of ] the estate, a party to the oauae. Sr. Lowndes was beard spain st the de- \ murrer, and Ur. Porter in reply. The Chief Justice decided that 4ho executor j who had takes th? bond was a necessary party in the case. The bond wae taken by Mr. Jer? sey as trustee or executor, and received for the benefit of the grandchildren of Mrs; Mon eTeld t. The property was to be divided among the children when they became of age. That ] erent did not take place until ibo year 1866. I theo, became the duty of the executor to divide the estate. The proceeds of tho bond were not distributed because the executor had received payment in Confederate money. The most of which that could be saud would be that the executor is accountable for the value of the Coufjedarate money at the time it was received. It also appeared that the *bond bad been re? ceived from Mr. Gray, Master in Equi ty, and j was secured by a mortgage upon property on King-street, and not as an independent debt, but pro raia with other debts. The object was to obtain control of this property for distribu? tion, and to accomplish that, all the parties in? terested should be brought in before the court. The demurrer was sustained; the plain tiff to have leave to amend the bill by jointure of th 9 necessary party, and payment of bosta of the tenn. Wm. Eustis, et al, vs. P. J. Sh&nd and Wm. A Vmrr Surmxx DEATH_Mr. John Mehr tens, who died very soddenly on Wednesday afternoon, of heart) disease, was a native of ? Lspe, Hanover, and only thirty-one yea? old. He was well and hearty a few moments before his death, and in the City Park with his oh ll dren, when he felt indisposed and sat down, and finally bad to be taken to his residen ce on Broad-street, where he shortly expired.
