Great Disappointment A. nm sn g tile OiBxe-seeJcera, dee. Long before the hoar of meeting of OoanoQ last crenion, an anxious orowd bad assembled at the City Hall to witness the entertainment expected to come off. In genera), the orowd seemed to be in very good homer, bat here and there were groups of anxious faces discussing the probabilities of a quorum and the prospects of the varions candidates for the loares and fishes. As on previous occasions, only a sufficient number were admitted to occupy tb" seats in the Council Chamber. The faces of those who were unable to gain an entrance wore a look of indescribable chagrin. In the ante-room sat ex-Mayor Clara: and Mr. J. H. Jenka. A few minutes before eight o'clock, but two of tbs terrible ten had arrived-Aldermen Barrow and T. J. Mackey. All the seats around the Council Chamber were occupied, and whispers passed round that there would bo another fizzle. At eight o'clock the folio w mff additional Aldermen entered and took their seats: Aldermen E. W. M. Mackey, Greene, and E. P. Wall, IV F. Wall, Hampton I and Small, colored. The absence of two of the j faithful-Thome and brown-caused some I consternation among the brethren, who feared a ruse by tbs minority. Their apprehensions were allayed, however, by the entrance of the , Mayor at fifteen minutes past eight o'clock. On taking tbe chair, the Mayor ordered the Clerk to take tbe names and report the number of Aldermen present. The Clerk announced eight members present. Alderman Barrow rose and offered the follow? ing resolution : Resolved, That Council do now adjourn to meet at eight o'clock to-morrow evening, 27th instant. ? Alderman E. P. WaD (smiling.) That mo? tion not having been seconded, I move that we : do now adjourn. Alderman E. W. M. Mackey. I move that we do now adjourn until Tuesday evening next. The question was then put and carried. CB ABB, PRESIDING. Tho court opened at 10 o'dook yeste I morning:, Chief Justice Ohaee and Judge B I presiding. ! At tba opening of the court the Chief Ju I delivered the following opinion: j oracnrt 00?BT or TES TOTTED STATES, DXSI I Or SOUTH CAROLINA-EICHARD ARNOLD j STEAMSHIP MONERA-IN ADMIRALTY-AP j FROM DISTRICT COURT. I The libel in thia oase claims compense j for in janes to three horses shipped by I libellant at New York for Charleston ii I steamship Moneka. il If the responsibility of the vessel is to b( I terminedby thc tic Lierai law of common carr I it is n jt questioned that the libellant is er I ed to a decree. ! Bat it is claimed that there was sept ?I contract concerting the shipment of tl I horses, which relieves the carrier from I sensibility. On the other hand, it is denied that tl I was any each special contract, and it is mi J ed if there was that the injuries were oat J by negligence in transportation, to whiob I special contract did not and contd not ext? I The proof of a special contract is nota j gether satisfactory; but I think the weigh 1 evidence fairly warrants tbe conclusion I I there was one. I But the evidence does not show that I shipper took on himself anything moro than I risks whioh are inoident to a voyage in a 1 J worthy ship, conducted with reasonable c I and skill. J It may be well doubted, indeed, whether { policy of the law will permit the carrier to j lievo himself (rom risk, created by bis c ] omission of suitable provision for the voya j or by bis negligence in the macagem?nt of j "imminent and learned jndges hare condemi I any relaxation of the common law rule \ mitting common carriers to limit their I sponsibility by stipulation, and though t j relaxation is now well established, it ha? ne I been carried by the American courts to the J tent of allowing them to exonerate themsel j in this way from the consequences of tl I misconduct or culpable neglect? 1 The true rule was stated by the Supre J Court of the United St ates in tho case of ] Yoik Company vs. the Central Railroad. I j in substance th's : "The responsibility inte: I ed by the common law can only be res trie I and qualified by express stipulation for 1 I restriction or qualification. Bat when si I stipulation ls made, and it does not cover lc j es from negligence or misconduct, it must I recognized and enforced." The only quest I in the' present case, therefore, 1B whether I not there was misconduct or negligence on 1 I part of the officers of the steamer. This ii question of fact, and I have carefully oonsid I edit. It is not necessary to enter apon any mini ! review of the testimony. It is enough to t I that the horses were shipped on the 25 iL I Deoember. Stalls were constructed for tb? I between decks at the expense of the ship p I Alter the horses had been placed in the sta! and after the regalar time of starting, t steamer continued to take in cargo till abc I dark. This cargo seems to have been s tor between decks, and my mind cannot resist t impression that it was carelessly stowed. Ct I tainlv it became loose, and portions of it, 1 I eluding some kegs of nails, tumbled agail I the stalls. A heavy piece of timber waeel I left loose between decks. The 'stalls wc I broken; one of the horses was killed; an o', h I so injured that he died as soon as he was lan I ed, and the third also suffered serious injm 1 It is a fair conclusion from the evidence th I these injuries were occasioned by the loo I stick of timber and tbe loose cargo. I cann I doubt that the exercise of proper precauti I fat stowage would have prevented these inj rles. Nor can I doubt that the omission I exercise proper precaution most be imput I ss culpable negligence to the officers of tl ship. I think therefore that the libellant entitled to a decree, and aa both parties ha1 I declared themselves satisfied with the estima I of damage mada by the District Jndge, whit I seems to me also perfectly just and fab:, tl I decree of the Distrust Court will be affirmed.
