On Saturday morning Judge Carpenter livered hi? opinion in the contented elect case between Acting Mayor (.lark and present Aldermen, and Mr. Tlllsbury and Aldermen. Judge Carponter roviews thc vth cate and argues it in an able manner, cit. authorities in support of the position which takes. Tho following extract, which for the concludion of the opinion, is all that t general reader will care to eee: The line of distinction, running through tho authorities, is between pubUc and prto corporations. Over the former the Icgislat control is supreme, while it ia not so over I latter. The manifest reason is tbat the ch ter of a private corporation constitutes "a ct trol between it and the government,and vest rig ht? acquired under the act ot incorpor?t i are aa sacred as private rights vested by a other law. And this is als J true in regard rights of property in a municipal coi poratk because to the extent that such legal ri gi have become vested under the charter tb are deemed private corporations, and s placed upon the same footing. Hence t Legislature could not require the property the city to be sold and the proceeds paid m the public treasury, for the reasons that co tracts have been made, debts conttaoted, pi perty purchased tor specific public uses, ai these among others have become vested righ under the charter. The act of March 1st, 1869, does not emei the charter. It makes an election regular ai valid which was before irregular and defect iv The State government had constituted certa: persons its political agents to conduct tl election; they cinducted it rn an irregular ar illegal manner. The conditions upon, which should have been held were prescribed by tl political powers of the State; the same pone: might have neglected to require the perfore ance of those conditions before the olectio had a right to waive them afterwards, deen ed lt expedient to do so, aod did make it vali and legal. The power conceded, the expediency an propriety of the measure, are consideration, exclusively for the Legislature. The statute unambiguous, its language explicit ; the la has spoken,and it becomes my imperative dui so lo decide. According- to the views I have taken of tli case, the first and fifth pleas are bad in lav though true in fact, and the issues joined ai wholly immaterial. The d?marrer is sustaine to the second, third and fourth pleas, and o vet ruled as to the sixth plea. The relator wi bave leave to repkad as to the first and fift pleas, and upon doing so in a proper mannet judgment of ouster will be rendered againe the respondents. I am not Insensible to the magnitude nf th questions discussed and decided. Financial am commercial interests, of vast importance, hav been enlisted ; party feeling, passion and pre ?lioe invoked; but however desirable it ma; to foster the former, and curb the latter they are matters with which, as a judge, I har no concern. It is not my province to deolan an act of the political departments void unies it is so beyond a reasonable doubt. He mus be a bold man who would affirm that this ac is within that category, after a careful oxamtn ation of the authorities. I am not that man Fully aware of the pubho interest felt in thii oaso, I have given it the most careful and anx ions investigation, and honestly and firmly re ly upon the accuracy of my conclusions. I re fleet with satisfaction upon the fact that thii decision is not tm al. ard that if 1 am in erro: the more matare judgment of tie Sapnmi Court affords an ample correction. Ant should that court arrive at a different con? clusion from my own. it will be my duty anc pleasure to ex?cute the haw as expounded bj the highest judicial tribunal in the State. By this it will be seen that Judge Carpentei decides unequivocally that Mr. Pillsbury ant bis Aldermen are entitled to their offices undei act of tho Legislature of March 1,1869. To-night there will be a gathering of he friendi of the Mayor elect in front of his residence, in Doughty-street to compliment lim with a serenade ; beyond this, no other lemonstration is expected to iake place. As far as the present city officials are con? traed, there will be a clean sweep, and many aasketa of official heads will be gathered ore many days. The slate has not been definitely announced, but rumor has Major Willoughby Tor ohief of police; Daley and Tatt, lieutenants ; Lhley, orderly sergeant, and dominoes for pri? vates. General J. B. Dennis, tor city treasu? rer; T. J. Mackey, city inspector; W. B. Eiter, derk of council. In the community the decision of (he case has created no outward stir whatever. City stock, however, was dull and may temporarily decline.*^ REDUCTION or FABE.-We leam that tho fare hythe steamer Pilot Boy to Savannah, via Beaufort and Hilton Head, has been reduced from ts to $5. The Pilot Boy is a fiao and staunch steamer, and has lately been over? hauled. She is said to be one of the fastest boats in Southern waters, and there is only two and a half or three hours of sea passage on the trip. Captain Peck, the commander of the Pilot BJV, is a well-known and experienced officer. _ THE SHIP SUSSEX.-This ship, which was re? ported as taken into Tybee OD fire, oui whioh received assistance from Savannah, was in the following condition by the latest reports. The Advertiser, of Saturday morning, says : The Board of Survey returned about half past eleven o'clock last night. We learn that JU reaching the ship it was decided not to flood lier. The batches were taken off, and it was liaoovered that the fire had made considerable Headway among the cargo, although there was rery little smoke arising from the hold. The work ot discharging the entire cargo was im? mediately commenced. The cotton as it is taken ont is placed on board of a lighter, and that which ut on fire is exposed to a stream Irom the steam tire engine F. 3. Barrow. The work of discharging was continued throughout last night and will not be stopped until the en? tire cargo is taken out. Many of the bales which were bound with rope are broken open ind badly burnt, the ropes having burnt through, while bales bound with iron ties have escaped. There is no doubt but that the en tire cargo will be saved, somewhat damaged by fire and water. The fire originated under the main hatch and took a downward course, burning through the between decks, and to- i ward the forward part of the vessel.
