INFANTICIDE. -Yesterday betwoea 12 and 1 o'clock a white child, lately born, was discovered by a chiffonier in a branch on the north aide of Shepherd street. It bore marks of violence on its head, which on examination by Br. Mr. Winkler was a pupil of Dr. Patrick, the widely known Charleston dentist, and bis thorough training and mechanical skill should enable him to attain a high position in the important profession which he has chosen. From the first tinkle of tho bells in the introductory overture until the close of the performance, the Peak and Berger combination* maintained their sway over the crowd, now producing their wonderful bell melody, anon charmic g their listeners by vocal and instrumental duetts and quartettes, and varying the musical melange by the inimitable comicalities of Bel Smith Buss ll. BEVAN, PRESIDING.- The "petition of G. K. Byan, assignee of Bundry bankrupts, was referred te Registrar Carpenter to call in lien creditors before 22d April, who shall then' show cause why the sale of real estate shall not be made; and further, that the Registrar shall report, Ao. J. F. Steel was allow? ed to amend schedule. Albert Barach and P. A. Treadwell were finally discharged. Registrar daw? son reported favorably on the petition of Wyman, Byrd A Co., against W. T. John Bright and Moses Brown, alias Simons, two colored vagrants, were sent to the Mazy ck-street hotel for thirty days. William Leo, colored, with an alias, for stealing paper from Colonel DeTreville's law office, Broad street, was "sent up" tor twenty days. Isaac Bryant, colored, for stealing bats from the steamer Magnolia, to be turned over to a magistrate or pay $10 finie. John Gray, colored, vagrant, sent to Mazyck-street to recruit tor twenty days. THE ACTING MAYOR AND ALDERMEN OE THE OITT OF CHARLESTON-MANDAMUS-IN THE COMMON H.KA8, CHARLESTON COUNTY. lu this case an altonattve mandamus was issued out of thin court, directe 1 to tho Acting Mayor ond Aldermon of tho City of Charleston, commanding them to turn over all the property, boole- mei papers pertaining to their several respective ofilecs to The pe? titioners therein named, and to vacate and surren? der to the said persons their several and respectivo offices, or to appear te fore tb!?court on Friday, the 19th day cf March instant, and show cause why they refuse to do so. In answer to this writ the respondents do certify and declare unto the court, "that they do not sur? render unto said persans the properties and offices a(ore?aid, heeanso they say that they are in posses? sion of said offices, having beon admitted and sworn under appointments and elections duly mado, and that mandamus is not, therefore, the proper remedy of the petition ors." 1 he responden!*, in further answer to the said writ, set forth the title under which they claim to hold their rospocti>eoffices; they traverse the seve ral allegations made by tbe petitioners as thegrounds upon which th> y are entitled to tbe writ, and which are tecitcd in the alternative writ; and they fur? ther aver that the act of the Legislature, ratified on tho Ut day of March, Instant, under thc provi? sion* of which iheitfklti?iiera claim io be cntitleu to those offices, is in violation of chartered rights of the corporators of the city, and also of the Con? stitution of tho State and of tho United States, in several particulars, and therefore inoperative ana void. Upon the filing of this return the petition? er?' counsel asked for time to plead, which was granted. Ihs petitioners then filed a general demurrer to the respondents' return. The demurrer of the peti t loners-admits all the allegations of the respondents' return, which are properly pleaded, and would seem te .>?-.? th l*i,9e the ?nffielenoy in law of their cause shown by them <or not obeying the mandate of the writ, but at the hearing the argument was confined to the question mads in the first section of the re? spondents' return-ls mandamus the proper remedy for tho petitioners ? The other questions raised in the respondents' return were Waived, aor were they admitted; but as the same questions had been made in the pleas to the writ of otto warranto aRHinatthe same respondents issued and returnable at the same time sad at the instance of the same relators, which was set down for hearing at a later day, the argu? ment was not had upon these questions, but was re? served until tbs hearing of the quo warranta. Tb? question discussed at bar, and now to be deci? ded, is a narrow and formal one, and does not go to the merits of th? case. It is not disputed that mandamus is the proper remedy against a public officer, who neglects or re* fuses to do some duty which the law enjoins upon him, and in which the petitioner or relator has an interest in and right to have done, and where there is no other remedy which is lull, appropriate and adequate. Tbe question is whether tbis is such a case. On the part of the respondents it is contend? ed that it is not, because tbey are in possession of the offices which the writ commands them to Vacate and surrender to the petitioners de facto, and by oolor of right; and that tbeiemedy of the petitioners is upon an information in the nature of a quo war? rante, in which their title will be put ta question, and upon which the ju 'gmrtit is of ouster from the offices beld by them; and that this remedy his been already granted to the petitioners by this court. The petitioners, on the other band, claim that it is the duty et the respondents, required of them by law, to vacate tbelr offices, and surrender them to the petitioners-and that they can never obtain possession of these offices, even if there should be a judgment of ouster upon the quo war? ranta, except by mandamus, which is the only ade? quate, therefore the proper nmedy. The books speak of mandamus as used to admit or restore, to an office; but it must be borne in mind that when used for this purpose lt is directed to an officer or officers whose duty it is to admit to the office claimed by the petitioner. The wilt itself as sumos ths person to whom it is directed to be an officer, and to continue in office in oider to perform tbe duty required of him. But when the office sought ls filled by one claim? ing it in his own right, mandamus is not the remedy for ono claiming against the incumbent. In such a case the claimant, if entitled to the relief of the coutt, must obtain it through a quo warranto. To illustrate this distinction in the present case, if the Acting Mayor and Aldermen of Charleston should refuse to allow one to exercise a public office, to whioh he had been cleo ed by them, he would, upon a proper case made, bo entitled to a mandamus, com? manding them io admit him; but whore tho peti? tioners seek for themselves the offices of which tho Acting Board aro ia possession, they must, seek re? lief by a quo war ronlo, and not by mandamus, This writ not only commands the Acting Mayor and Al? dermen to surrender certain property, but vacate tbelr offices. The authorities upon this point are numerous and decisive: .<lhe court will refuse to grant the writ of man? damus it it appear that tho applicant has a remedy by information in the nature of a quo warranto. Thus a rule for a mandamus to admit a recorder was refused, because it appeared there was a recorder de facto, and, therefore, the applicant bad such a rem? edy. Fer the consequence of eran tina a rule in such a oase would be, that a second person would be ad? mitted to an office already filled by another, both claiming to be duly elected. (Tapping en Mandamus, p. 27.) "When an office or franchise is full de facto, and another person disputes the validity of the election er appointment, his remedy is by a quo warranto in? formation, and not by a mandamus*' ?'lithe elec? tion were doubtful, and flt to be tried upon an infor? mation in ths nature of a quo warranto, the court ought not to grant a mandamus." "If such ouster and election be bsnaflde, tbe court will net grant a man? damus in favor ef the party displaced ; the proper proceeding is by a quo warranto against the party holding the office defacto." ""Where the aldermen and assessors of a ward in a borough had dsolared A, B or 0 to be duly eleoted as councillors, and they accordingly took upon them? selves the effice, end made declaration required ky law, and acted as councillors, the court refused a mandamus ta allow T and Z to act as councillors, even assuming that they ought to have been declar? ed duly eleoted, for the office was full de facto of A, B and O. Bat an information in the nature of a quo warrant? waa granted." (Colo on Criminal Infor? mations, 147,149, and coses oited.) Mandamus to admit a recorder was refuses, be? cause there was a recorder de facto, and the party had another remedy, by quo warranto. There beth of them claimed under the same election. (Bex. va. Mayor of Colchester, 2 T. B., 359.) The writ has often'been made use of in modern practice to admit or restore to an office, and the rule, aa above laid down, seems to have bean unohanged. But when an office is filled by a person who had been admitted and sworn, and U in by color of right, a mandamus is novar issued to admit another person. The proper remedy is by a quo warranto. (Angel ? Ames on Corpoiations, 618, 626, and oases cited; Moses OB Mandamus, 160.) The distinction as above shewn between manda? mus and quo warrants, under the practice in Oils State, is fully sustained lu State vs. Bel vre. (7 Bich., 234, and cases there sited.) But it is said that even if lhere should be judg? ment of ouster upon the quo warranto given against the respondents, they could not be compelled to sur? render tbe books and property except by a manda? mus, and that, therefore, it is the proper remedy. The comt will not assume tbat in ease of Judgment being pronounced against them on tho quo warranto tho Acting Mayor sand Aldermen would SQ remue; trat even if they should do so, the remedy would be ample without mandamus. The petitioners then have another remedy, appropriate, full and adequate, and, therefore, mandamus is not the remedy. The petitioners' counsel contended that the act of the Legislature having declared the peti? tioners entitled to the offices held by tbe respond* enthat mandamus was the proper remedy to com? pel their obedience to the act Assuming its validity, it confers a right, but does not prescribe a remedy. In this case, to save the time of the court from be? lng consumed in bearing the same argument twice, tho alternative mandamus was issued in tho first in? stance, without a preliminary ru's to show cause. Had cause been shown in r?ponse to a rule, the alternative writ would not have been issued. Boing made as a return to an alternativo writ, it is held to be sufficient why a peremptory writ shall not iseue.
