When about three miles from tile city the horse dashed off. throwing the gentlemen out and slightly injuring them. Iho horse and buggy returned to the Charleston Hotel, leaving the parties up tho road to get down the best way they could. THE STATE COUBT-HON. B. B. BEVAN, PRESIDING.-The court waa occupied yesterday in hearing the libels of D. Boyle and T. Heyward against the steamer Volunteer, and Charles Heinrohn, Dan'l Dupre and M. Dunn vs. Ute same, her engine, tackle, co , for wages. Deas Ac Burnett for libellant, and Dingle & Barker for respondents. The case waa continued over until Tuesday next. THE BICE TIEBOE.-In noticing yesterday the mooted question of taking off the charoo usually made in this market for tle-ces in Bolling rico, we wrongly said that ?he principal factors had agreed to abolish the charge. The truth is that the buyers of ri oe are the movers in favor of the abolition, the firms who signed tbo circular which we printed be? ing the principal dealers in this city. We have no doubt that the factors wdl consider tho propriety of making the change, ?nd we tru<t that they will soon declare that to be the pi sitive fact which THE KEWS announced a littie ahead of time. We learn that a special meeting of the Chamber of Commerce- will be held next week to consider and determine the whole question. ANOTHER SENSATION.-On the night before last several government water carts and an ambu? lance were found in Queen-street aftor hours, con? trary to ordinance. They were taken to the Guard? house, and early yeuteiday morning there were the moat startling rumors afloat that ammunition wag? ons and artillery had boen secretly carried to the i Guardhouse ta be in readiness to blow the "wool" off the head ef the Republican "faithful" who should show their noses during the day. Political "love knots" lormed on the comers and in the by ways, and the matter was seriously discussed and weighed, much to the distress o? some of the "braves" who snuffed considerable discomfort in the impending result. Mid-day the truth was ascsitaiuod, "the laugh came in," an! the exercised "bussums" beat to a leas excited pulse. Binoe the beginning of Hie contest between the Mayer and A'dormen of Charleston and the Pillsbury party, who claim to have boen elected at the No? vember elections, the public baye Docomo familiar with the ordinary course of legal proceedings, and there ia scarcely a colored man in town who does not know that a writ ef ma damns means GBT our I and that a writ of quo warrante means WHAT BIO*HT HAT*, TOW TO STAT ! The interest in the result of this contest is ia'enas, and at ten o'clock yesterday morning the courtroom or the Circuit Court waa till? ed with spectators. The Acting Mayor and Aldermen were represented by the Hon. W. D. Perter, City Attorney, Theo. G. Barker. Esq., and C. Biohardson Miles, Esq. ; the claimants being represented by the Hon. D. T. Cor? bin, United States District Attorney. The return to the writ of mandamus was read. The respondents say that they do not surrender their onces because they are bi possession c f said offices, having been admitted and sworn under ap? pointments and ?lections daly made, and that the mandamus is not the proper remedy; and, further, that by the acts ot t nu present General Assembly, they are entitled and bound to continue in ornee until their successors shall be elected and qualified according to law, and that Gilbert Pillsbury and the other petitioners haye net boen elected and qntltOed according to law. They then recite tho well-known circumstances of the election, ths contest, ?ha find? ing of the Beard ef Aldermen, and say easphatlaally that the validity of the olectioa of Pillsbury and the other pctitJcners has neyer been Judicially determt oed otherwise than ay the Acing Board of Aldermen; that the bupreme Court expressly declared that they did not mean to express any opinion as to the rights ot the petitioners to the offices claimed by tbem, and that tba petitioners are entitled to hare the aamo determined by a due process of law. They also say that they are advised that the act to con? firm and declaro valid the recent municipal electlcn ls contrary to the chartered tights of the corporators of the city, and also to the 12th, 14th and 26th sec? tions of the first article of the Constitution of the ! State, and to the 20th section of article 2d of the same, and to the Fourteenth amendment to the Con? stitution of the United ?tatos. In conclusion, the fte pondents admit the demand of Pillsbury and the other petitioners for the offices and properties of the city, but say "that tue petitioaers were not duly elected and qualified, and hive no right or title th ore to; and that inasmuch as the re? spondents have been admitted, sworn, and are actu? ally in possession of their several respeodve offices, the proceeding by mandama! is not the proper re? medy for the petitioners, and they pray that the same be quashed." Signed by G. W. Clark, Mayor, and Aldermen Geddings, Petter, Lindstrom, Dereaf, Oade, Olney, Honour, Whilden, Marshall and Voigt. The pleas te tho wrir ot quo warrante are to the effect that proceedings under a writ of quo warrante were depending in the Supreme Court at the time sf filing the information and issuing the rule in this case, and that the information should be quashed. 1 he counsel state the fact that all the Aldermen were appointed by General Canny, Bave Messrs. Honour, Whilden and Olney, who were duly elected in ISM. and that they are bound under the city charter and the aots of the present General Assembly to hold their offices until those offices aro filled by the elec? tion and qualification of their successors, and that no ?. -i. 'ssore have so been elected and qualified. They admit that tho demand was made by Pillsbury and others for .the offices and the property belong? ing to them, and that they did not surrender the same because the claimants haye not been duly elect ed and qualified, and are not Mayor and Aldermen of Charleston. The plea is signed by the Bon. W. D. Porter, O. B. Miles, Esq., and Theo. G. Barker, B.q., counsel for defendants. After the reading of the returns, Mr Corbin saic that in view of the new issues and questions brought up in the returns, he would ask a postponement ol the hearing of tue cate for a few hours.
