It is said that his attention to the sick at that place during the prevalence of yellow fever has won for him tho gratitude of all, who oarnestly join in the recommendation to Executive clemency. , -Manton Marble, the tditor and owner of tho New York World, is said to bo a hard-work? ing, indefatigable man. Those who know his habits say he is a marvel of endurance. -There have been a great many singular de- 1 velopmcnts connected with tho Rogers mur- ? der, the latest of which is unfolded in tho nor- < rative of Mr. Evorett B. Dolanoy, formerly a t detective officer in New York. Some time last j year he was first mate on board of a steamer which numbered among its deck hands a ful- 8 low uamcd James Mahar. Between Djlauoy " and Mahar au intimacy sprang up, and the latter, being In a destitute condition, was pie- ' seated by his friend with a felt hat and a dark t bine flannel coat. Both men afterwards left .< the boat, and their association began gradually t to die ont. On tho morning after the Rogers murder, Delanoy met his farmer friend in Uui vereity place, tapped kim on the shoulder, and ? said, "Jim !" Mr. Booth divided the favor of th audience with Mr. Edwin Adams, and bot were called before the curtain. Miss Mc Vicker1 Juliet was injured by timidity. She wore white satin skirt, hooped with pearls, and cu pompadour, trimmed with silver bullion fringe a pearl necklace and a tiara of diamonds, an her long black hair flowing. Thc mos glaring defect is a want of lobby-room. CHARLESTON. MONDAY MORNING. FEBRUARY 8, 1869. Thc Debato on the Charleston Electioi BiU. The debate in the^tate Senate on Thurs d'iy last, on the motion to postpone th consideration of the Charleston Electioi bill to Tuesday next, developed the fae that a strenuous attempt is being made ti pass the bill as a strictly parly measure without regard to its constitutionality, jus tice or propriety. Mr. Corbin wanted to know "whethei "the law is lo be enforced,"-the questioi which the State is now asking of the Leg islslure; and he also wanted to knov? whether "money influence and big name: "are to rule, oontrary to principle, law "and justice," while the State asks ol the Legislature whether "party is to rule, "contrary to law, justice and the State Con "stitution ?" Mr. Corbin declared that hi cculd show that the bill WP.S "wisc, jtisl "legal and right." Ibis he may be able tc do in the Senate chamber; but this he can? not do in any court, or before any tribunal in thc State, where argument may be met by argument, precedent by precedent, and simple assertion by the irrefutable logic of fact?. But tho speakers who preceded Mr. Cor? bin did not confine themselves to declaring that thc law was meet and just, and, there? fore, should be passed. Mr. Allen told the Senate that they might postpone the bill if they were willing to bc trampled upon by thc Acting Board of Aldermen, and called upon them, if they intended to assert their rights as legislators, lo act upon the bill at once. As far as we know, the Acting Board of Aldermen is composed of inoffensive men who desire to trample upon no one, and least of all to wouad the sensitive feel? ings of a worthy brother Republican. They did but pei form the duty which the law of 1SGS devolved upon them. They decided that there had been no legal Municipal election in this city. They did not declare, contra? ry to law and evidence, that Pillsbury and his Board were duly elected. This is the head and front of their offending. And what thc rights of thc Senate, a legislative body, have to do with a judicial question-a question which has been before thu courts and which is confessedly kept out of the courts at this moment hy the friends of Mr. Pillsbury, because a ?earned judge cannot hear and delcrminc n grave question as quickly as senators may vote when they hear the crack of the parly whip,-Mr. Allen did not venture to explain. Cut whatever may bc the thoughts of certain senators, Ihe people know that, in the words of Mon? tesquieu, "there can be no liberty if the "power of judging be not separated from '.tho legislative and executive powers." They know that "were the power of judg? ing joined with the legislative, the lifo "and liberty of the subject would be ex "posed to arbitrary control; for the judge 'would then be the legislator." And tho senate will remember that their actions :t.nnot be hidden from the broad light of lay. They and their pretended laws will te arraigned at thc bar of public opinion, md this question of the rights of the Sen? te, as opposed to the rights of thr people, te tried by the test of the Constitution of he State, by the law of the land, by an au hority superior to auy which even Mr. Ltlen and his colleagues possess. Nor will his be done out of opj ositiou to Mr. Pills mry alone. The is*ue now is not between Ir. Clark or Mr. Pillsbury; it is whether he Legislature of thc State is to accumu ite all powers-legislativ.?, executive and udicial-in tho same hands-au accumula ton which may justly bc pronounced "the very definition of tyranny." Mr. Allen, in the course'of his speech, Iso ttt-ked whether the lawyers and press f Charleston and the Democrats of that i ty did uot "declare in advance that they .would not abide by the election if Mr. Pillsbury was successful?" Our reply is hat such a declaration was nut made by ither tho lawyers, the Democrats or the ress of Charleston, but that a declaration us made, as it is mide now, that they rould and will abide by thc results of a .gal electioa a^d thc decisions of the courts f tho State, whatever ihoso results may ie. Beyond this they will not go. Beverly Nash, thc colored senitor from ticbland, followed Mr. Allen, ?ind said cm hatically that he was not williug to leave ?thc rights of the citizens of the Stuto (i. e. .Pillsbury) to thc coarta, judges, or any 'particular individunl," and that tho mat? er should be settled "without, any regard 'to the Supreme Court, District Court, or 'any other court." Also, that if Pillsbury iud his Aldermen were elected, as was ihown by the highest number of votes, he wanted them "put into office, if it required 'the Governor to call out the whole force 'of the State for that purpose." And also -and this is the key-note of the whole de? bate-"this matter is the life of the party, ''the Republican party in Charleston. It ' depends upon it." He was in favor of the bill, not only because he believed it to be rigat, but also "as a parly measure." The threat of culling out the whole force of the State to install Mr. Pillsbury will have no effect h?re, but it proves plainly enough that this senator is ready to usurp the functions of thc Executive as well as those of tho Judiciary. It is not enough that the ultra-Ridicals should be the law? makers and the judges of the State. They will not be satisfied unless they are the Governor as well, for with less than the whole powers of the three departments of tho government wielded by one despotic body, they could not hope to succeed in giving effect to a law which would be vetoed, we trust, by Governor Scott, and would be held unconstitutional, and, therefore, void, by every court in the State. It is no rhetorical flourish now to say that the Radicals in the General Assembly are striving with might and main to over? ride the organic law which they and their party framed; but, whatever the conse? quences, there will be for us this consola? tion at least-that by their violence, their disregard of law, and their working "out "side the constitution," these Radicals will seal the fate and secure the downfall of their party.
