It is probable, however, that the de? mand of Mr. Pillsbury is tho preliminary step to tho suing out of a writ of gus warrarito, which, if is? sued by tbo court, would require tho Mayor and Al? dermen to show by what authority they continued to hold office in taco of the alleged fact that Gilbert Pillsbury and others had boen elected in their stead. In doing this he whole question of the al? leged illegality of the election would come up, and tho prpsont Mayor and Aldermen would, lt is presumed, adduce all tho evi? dence tuoy could oiit.iiu to prove that thero was not a legal election, that there was, therofero, no election, and (hat G. W. Clark and others legally held offico until there was a legal election. If the quo warranta were Issued by the circuit dourly either pitty could take an appeal from that decision to the Suprcme Court, whose decision would bo final. To avoid this appeal, however, it is believed that tho writ of quo vsarranto will, if possible, be ebtained from the Supremo Court direct. This is the position of tho contorted eleoUon caso as fir as it ls affected by tho action taken yesterday by Mr. Pillsbury.
