THI NEW HOSE PEEL.-The Manhattan, which arrived at 1 o'clock yesterday, brought the new hose reel of the Columbia Independent Fire Com? pany. It waa met at the wharf by the Board of J Fire Masters, and ?acortad to WHITE'S furniture store, at the corner of Meeting and Wentworth streets, where it will romain on exhibition to-day. The reel was accompanied by a delegation from the New York Volunteer Firemen's Association, consisting of Messrs. TOBIAS LAWRENCE, ABRAHAM CrjURwaw, Taos. Bunira and WM. LASTS. These gentlemen will remain with tho reel, and will pre? sent it to the Columbia Firemen from their Now York brethren. We have already described the rael in our paper, and will only say that it is a be? wildering collection of silver, mahogany and brass work. FESSENBACH is the pioneer of Restaurateurs, and we know tba!, his productions are never at a discount ; his turtle acquisition ' will only add to his reputation, and increase the number of his THE LATS BAINS.-The fall of water during the last week was, perhaps, the heaviest that has been experienced in our city for many years, and caused on the part of a number of citizens, especially those in authority, a dread of serious injury to dwellings, gardens, drains, Ac. With the severe gale which abo visited us on Saturday, their appre? hensions almost became certainty, and tho thought that disasters from the terrible wind and rain upon our people at a season of dullness and stagnation like the present, would indeed be a sorrowful ad? dition to the poverty and want that now afflicts so large a portion of our population. But we were rejoiced in hearing yesterday the Mayor remark that he had ridden through the parts of the city .where he supposed the most damage would have been effected, and, ofter an examination, was hap? py to say, with surprise, that but little injury had been done, and that the city generally was intact This is certainly a great cause for thankfulness, thai after such a period of lenthened storms we should receive so little harm, and a good reason to make ns more determined to build up our old oity and make os as proud aa ever of her appearance. A PATENT BAT TRAP.-We had the pleasure yes? terday of A-ramininp a new style of rat trap, re- I oently invented and perfected by a Hay nu street neighbor. So many futile efforts have been made to induce the long-tailed fraternity to come out of their holes and die, that we had concluded the ex? periment was useless, and rats bore charmed Uves, which nothing could injure. Our Hay ne street friend has, however, reduced the subject to a science, and the only difficulty in tho way is to keep the trap clear of the rats that throng into it. The-body of the trap ia composed of a strong wire work box, surmounted by a cupulo, through which the rats obtain an entrance to the region of bliss below. A piece of fish, or other tempting morsel, is placed near the roof of the cupulo, and in their eagerness to obtain a bite, the unfortunate animile steps upon a trapdoor, and is instantly hurled into the lower apartment, where ho is at full liberty to roam about until turn 3d over to the tender mercies of a terrier. Tho machinery that regulates the trap is mode on the dock principle, and when once wound np the door can drop fifty times. As tho lower chamber can easily accommodate that number, it is a fair inference that the new 'uvention will soon prove to be an exterminator,a ' after a few wooka nse the trap will be tenantlesu, and the odor of | salt fish will be wasted on tho desert air. Since the experiment has been tried at No. 1 ii ayn o street, numbers of tho hairy enemies that formerly infested that,establishment, have come to an untimely end, and the inventor trusts that in a short time there will be none left to mourn tho loss of the departed. We understand that an ap? plication will soon be made for a patent, and until that is granted, we forbear mentioning thc inven? tor^ name, as bis natural modesty might prevent him from making the efforts necessary to ciown his name with glory as a benefactor of the human race. Mr. B died a short timo after; brought body city and placed it in tho dead house of the Bop Hospital. Authorized Dr. HOBLBZCE to hold pi mortem examination; has bullet taken frc wound. The autapsical examination of Dr. H. B. HOB BECK was submitted to the jury by the Attonie General. This is the same as was shown befo the Coroner's Jury. THOMAS H. HAWKINS, the second witness, i peated substantially the some testimony he hi previously given at the Coroner's inquest, with tl exception that Bos come in the bar room ai ataud that he would fight BOAG, and would ha' his d-d hoart. MODOWALL then called Be Out, and they had a private conversation togothe after which BOB appeared cross. GEORGE C. CHAPMAN also repeated the f-^'TT given before the Coroner. Knew both the priaoi era and the deceased-the latter during and abu the war; knew of a disagreement between the pa ties, and heard that trouble was anticipated, ai went up to tho Oak Grove to prevont any figh while up there saw Mr. CLANCY and CALVO ride nj T. Cross-examined by Mr. RICHARDSON, who, bi fore putting the qustion, placed the features of th ease before the jury. At the ground CLANCY said to BOAG, in tho presence of others don't mind it, what he says can't mako it so. Dc posent was not present when BOAG charged Roi with absurd language ; was present whon Roi asked BOAG if he had a knife ; the others on th* ground were endeavoring to adjust the difficulty Box had his hand in his pocket, and when he fell it dropped out of his pocket Knew ROE had a bael reputation, a dangerous man, strong, few men hit match, desperate in a fi.,'ht. Ho was a terror tc the community in which he lived. Cross-examined by M. P. O'CONNOB, Esq. : Went to the ground to stop the difficulty; Mr. MODOWALL was quiet at the ground when tho party woro con? ferring, and aided thom in endeavoring to make a acttlcment; Box's conduct was such that it was evi? dent he would fight any how; saw BOB fall; went there and showed MODOWALL the wound; ho was standing near HEARD; MODOWALL was perfectly soo!; deponent loft him at tho body when he went to the city. Cross-oxamined by Mr. SLMONTON : Saw CLAN or when he arrived on the ground and usod all of his ? fifo rta to mako a settlement; finally said "if you wiR fight, I shall have to give the word." They bad called for the word previously. C. A CALVO, who had also testified beforo the Coroner, took tho stand and repeated the evidence given on that occasion. MCDOWALL appeared to witness to bo in liquor, and he saw him do or say nothing to either stop or advance the affair. One pistol alone was fired. BOAG does not know if ROE'S was cooked; heard a pistol shot after ho loft the grennd. Cross-t.ramined by Mr. RICHABDSON-Was present on the ground when BOAO said, in re? ply to the insulting language usod hy ROE, that ha boped his friends would not compromise Ros turned his back on BOAQ and said you aro a puppy, a poltroon, and a coward. BOAO, after all attempts to effect a reconciliation had failed, said : I see nothing will do bat a fight. Could not say who fired tho pistol shot after tho duol, as his bock was turned. ROE boro a very bad character, violont and quarrelsome. When intoxicated, extremoly in? sulting, self-willed; never yielded. Cross-examined by M. P. O'CONNOB, Esq.: MO? DOWALL was with ROE when he fir?t saw him; they came out or the houso together; was quite cool, and not violent; did not stagger; heard that ho was tho friend of ROE, who had come there for tho purpose of fighting BOAO; tho othora had con? versations with MCDOWALL, at which deponent was not present; when spoken to by witneaa, who requested him to atop tho fight, ho mado no re? ply; witness only approached him once; tho others had frequent convoiaations; on tho ground, MC? DOWALL was cool and collected, and atood near his principal; did not know of any efforts hoing made to stop the fig\t before tho party wont on tho ground. Cross-examined by C. H. SIMONTON, Eeq.: CLANCY handed tho pistol back to JNO. BOAQ when the conference took place, and did not seo him with it agaiu ; CLANCY came down with him ; de? ponent took a drink beforo leaving. There w.t8 somo apprehension excited in tho mind of tho dopouont that at tho timo when ROE advanced on BOAG, and used tho threatening language, that a general melee would ensue, though a fight would occur outside tho rules of tho duello. In reply by tho Attorney-General : When ROE advanced on BOAG tho apprehension was raised that a general fight would ensue. Tho eeparation of tho principals allayed thia apprehension, and it wa J not again excited. GEO. CRAMMER also teatified beforo tho Coro? ner's inquest, and his sta temen t waa the same, ox cept that Dr. BELLINOEB was met by appointment on their way to the ground, bet the Doctor only rode a shcrt distance and got out to visit some patients, dangerously ill. Tho Doctor gavo tho tourncquet and othor necessary instruments to Mr. JNO. BOAG. Tho duol waa fought at 4 P. M. Cross-oxamincd by M. P. O'CONNOB, Esq.: Did not BOO the duel, but kucw that all tho preL'min> rien wore satisfactorily arranged according to tho established code. HOE'S character was notorious as a bully, and a riotous, dan g ero ns, violent char? acter ; threatened at all times to uso weapons. Was present whon T. G. BOAG said to EOE, you have abused me, traduced my character, and spoken disrespectfully of my family. ROE answerod, what I have said I will not go back upon. When ROE said I know you are a dung-hill and a coward, and want to back down, and I will make you show tho white feather, BOAG named tho Pavilion Hotel as a place to arrange?the preliminaries, which was assented to by ROE, provided PUBCEL or NATHANS did not issue an execution against him. MCDOW? ALL carried a verbal challenge to BOAG. Cross-examined by M. P. O'CONNOB, Esq.: Tho message carried by MCDOWALL was that ROE would fight BOAO at any time or place, and in any form. When at tho Pavilion Hotel, at tho conference be* fore the fight, MCDOWALL showed a willingness to try and arrange the matter, and saw ROE, at the suggestion of deponont, but returned with the hostile message. Deponent mot ROE and MCDOW? ALL in Meeting street, at ll o'clock, and again ap? proached MCDOWALL, who conferred with ROE, and then stated that the matter was settled, the car? riage had been engaged. On the field, MCDOWALL showed the same willingness to arrange tho mat? ter, but the answer was so invariably the same that the deponent asked ROE individually, but the same hostility was shown. ROE'S disposition was Buch that when in a mood for an encounter, noth? ing could control him, not even forty seconds. He was extremely self-willed, and if determined upon a fight, nothing could h.tvo prevented him. The Attorney-General here closed the tostimony for the prosecution. Tho defenco refused to place tho prisoners on the stand, and appealed at onco to the jury. ! ASHES D. COBEN, Esq., opened the argument for tho d?fonce, showing to the jury that thc case was one of extremo novelty, as the killing of ROB was not denied. Notwithstanding that similar eases have been tried in this State, yet tho voice of tho country has always decided, from the jury box, in favor of tho accused. Tho only issue in the present case is, if the killing was justifiable. Mr. COHEN reviewed tho evidence, and showed to the jury that, with the exception ?of ROE, all parties were willing and anxious to adjust the mat? ter amicably; but, from the violent and turbulent manner of ROE, this was impossible, and the duol was not only unavoidable, but justifiable, and it was impossible for T. G. BOAO to have acted otherwise Cn \ RLES H. SmoNTON, Esq., followed, and in a clear, lucid and ablo argument, laid beforo the jury tho particular case of Mr. CLANCY, show? ing them that bo neither acted nor abetted any murder, as set forth in the indictment, but the charge had fallen to the ground. He reviewed Mr. CLANCY'S actions and proved that his presence on the ground was accidental, and after his arriv? al on tho ground his very actions was directed to? ward stopping the fight and making some amica? ble arrangement. His final action was induced by the same motives, and the only construction thal could be placed on his conduct was tho very op posito to what was charged by tho State and the prosecution. Wu. WHALET, Esq., tho associate counsel for Mr. CLANCY, followed Mr. S?VONTON. He first discuss? ed the crime of mordor and how it was cons trued by tho law; he showed what malice a forethought consisted of, and in what particulars the prosont caao was devoid of this malice. Ho roviewed the evidence and clearly showed that by the statement of the witnessos for .tho prosecution, Mr. CLANCY stood before tho community purged from any participation with tho crime, if any crime had been committed. Mr. WHALEY quoted from several learned authorities in which' similar cases woro mentioned, and where tho innocence of accused was fully shown. M. P. O'CONNOB, Esq., tho counsel for Mr. MCDOWALL, then argued the case of bis client. He traced the institution of the duello back to the remote ages, showing that in England, Ireland, F-ance, and other countries, no jury had ever re? turned a vordict cf murder, or cveu manslaughter. In this State and country tho code bas been recog? nized for ovor three-quarters of a century; it is dear to every chivalric breast, and whether govern? ed by tbs Puritan blue book laws, or by a moro en? lightened code, the result has always been the same. He showed that public opinion had recog? nized tho code of honor, and that in every age and country publio opinion would rise superior to tho common law. Mr. O'CONNOB showed that, though a second, MCDOWALL had throughout endeavored to adjust tho difficulty, and only yielded to tho implacable temper of his principal, who insisted on a fight, and if MCDOWALL had not acted as his friend, he would have fought anyhow, and in an informal manner. Tho insinuation on the part of some of the witnesses, that MCDOWALL was intoxi? cated on the ground, was more than refuted by the evidence of others, who testified that MCDOWALL was cool, collected, and managed the unfortunate affair in an honorable manner. R. W. SEYMOUR, Esq., tho associate of M. P. O'Co KNOB, Esq., aro BO to conclude the argument, when the Judge said that he would not press the trial any further. Mr. SEYHODB decided to con? tinue the argument, and addressed the Jury on the different features of the case, but enlarged particularly on the character of bis client, showing that the aspersions cast upon him had all been re? futed, and his conduct was now without a blemish. Nothing in the shape of intoxication could be proved against him, but he had, throughout the affair, acted with moderation and discretion. On the conclusion of Mr. SEYMOUR'S argument, the Court adjourned to 10 A. M. to-day, when the oase will be resumed. WE HAVE TB LED IT. Tried what?
