The Daily ZN'e'WS. THURSDAY MORNING, JULY 19, 1806. LOCAL, MATTKRS. ?a tCtrSEB SECOND AND THIRD PAGES. -?? The TuEnMoMF.TF.it in uur oflico, i\t 12 o'clock last night, btooil at 01 flogree?. Attention ie called to tho advertisement in to day's News of Mesar*?. En.vnoit ??c AJallonek, of fering for aale a beautiful and tant nailing yacht. o We PDBLieii to day, on our second pago, a very ablo paper on llio project for n railroad connect ing CbarlcBton with Knoxvillo via Spartanburg and tho French Broal, which wo commend to tho attention of our roadora. 8tabiiino AirnAY.?On yoatcrday afternoon about 6 o'clock, a difficulty occurred between two nogro men at a house on South Bay, it being tho residence of ono of tho party. One of the mon was boat by tho other, and attempted to make hia eacapo by running to Tradd atroot. Tho other followed him, and when in tho act of enter ing a shop in Tradd noar King street, inflicted a severe wound by atabbiug him in tbo baok of tbe neck. Tbo ono who porpotrated tho act ran off with tho knife in hia band, defying any interfer ence. An Old Drtuo Store Under a New Name.?We take ploaauro in calling the attention of our read ers to the advertisement of E. H. Kellers & Co., in another column. This now firm baa succeeded to the well-known concern of Phin & Dobn, at the samo old staud in Meeting-strcot, noar Market, and are determined to keep up the reputation of their atoro. In addition to a largo and well as sorted stock of draga, they bavo a fine soda-water fountain, where customers can bo served with tbia moat refreshing beverage at any hour of the day. We wish thom all sucoeas. A Warning to Housekeepers.?On Monday evening hiat two negro women called at tbo house of a gentloman in Wentworth-street, and said that thoy had called for the week's wash. The lady of tbe house, not knowing tho women, and thinking that something was not right, refused to give them the clothes. On Tuesday the regular washerwoman called, and said that ahe had not sent tbe women, but she recognized them from description, and warned tho lady to beware of them. We mention thin incident not for any in trinsic interest which it poBaesaes, but to put ?there on their guard againat like attempts at im position. Panknin's Hepatic Bitters.?We alwajs take pleasure in encouraging any enterprise having for its object the ?loyolupmont of our native re sources; and, in purauauce of this practice, we did not for a moment hesitate, yesterday, to take by the band a bottle of Mr. Panknin's Hepatic BittorB, which be kindly presented fr trial to our experienced ken. We taatod and highly approved, though wo do not like to express a decided opin ion upon one bottle. Mr. P. did not start trade in 1860, but was a rospoctablo druggist in this city long befnrn that, porinrt. The hmiso, established by hie father many years ago, has always ranked first among the drug atoreB of Charleston. The present proprietor is an experienced apothecary, who baa enjoyed the benefit of a life-long educa tion for tbia apecial busiucss. His character, moreover, vouches for tho truth of hia assertions, and we can, therefore, have no hesitation to re commend tho Hepatic in all sincerity. May he live to verify tho truth of his motto : " Resparo crescunt." Provobt Cotjbt, Wednesday, July 18.?There was another case before tbe Court to-day in which & policeman waa censured for going beyond tho bounds of his duty. As these cases are of great interest to tho community at the present time, we publish tho evidence and the judgment of the Court in full, boing satiB?ed that the public will be able to draw their own infeiences without any hints from us. The few blanks used in tbe testi mony roproeent language unfit for the public prints. United States vs. Daniel Biackwood (colored).? Threatening and abusive languago to tbe police. ?Policeman ?Turnes Nolan, sworn: I belong to the police force; I was on duty on King-street, near Broad-street, between four and five o'clock yea terday afternoon, when defendant waa saving that he would ehoot any -r- white-; I bad no star on, but told him he had better move on, when he asked what I ha?i co do with him; there were two persons standing near, to whom he appeared to address himself ; ho said to me, "you white-, what have you to do with me." As be refused to move on I told him I was a policeman, and took him to the Quard House; I found $2 50 on him; he made no resist ance alter I showed him my star; ho said that I was just the kind of man he would like to get at; bis conversation was that he would kiU any whito-that camolu bis way; a white man and woman stood near him. Cross-examintd.?He was making a noise, and was a publie, nnisanco ; I bavo a right to arrest any ono making a noiso ; he pulled hack when I . arrested him : I did not t-triko him or he me. Wm. Jui-kcon (colored), sworn : I know de fondant ; ho rt;i\s at my bouse ; I was prest ni when ho was arrested ; wo were walking quietly along, speaking about two soldiers walkioK along with two nolic? men, whon one of the polioomen threw his baud back and strnck defendant in the mouth; he struck hun throo times and called him a ? black-; then b? showed a star, and arrested him and took him off; he struck defend ant bofore ho arrested him, and beioro bo showod hia star ; 1 asked what right he had to arrest a man when ho was nut on duty ; then he showed his star and arrested d?tendant, and struck me and called mu a nigger. After hearing tho above ovidence, Major Coboin, tbo Provost Judge, delivered tho following opinion: There dons not appear to have been any great occasion for an arrest in this case. An arrest should not be mad? ton hkstiiy. Arrest is a acrious matter, and should not bo made without a prima facie cunee. Any i.ftvnce being committed, a privato citizen can interfere, but ho doe* it at hia peril; but. if ho is in tho rinbt, the Court will euatain him. This Court is anxious to sustain all lawful authority, and especially tho police forco of thia city. But it cannot retrain from expreaaing an opinion in this cuno, us in tho ono tried yester day, that tin, policeman whb ovor-zoalous in his iVi' an', t,,<' HUo,?*i n of tho Captain of Police will be calh-? t ihia case, that tho police may know that tit. y njust not make arreats for trivial manors, as ihn unwiao Hud oppressive nao of authority is o.ilcuUtod to irritate the peopl?', and givo only moru trouble to?thomaeives and the city. Tho prisoner was then reprimanded for using improper languago i? tho^treot, and discharge.!. Jamea Clo.i.ents (colored) was fined $2 for sleep ing in tho atreot, but?, hi? ?latcmont that he m in town for tho firm time, ami was unacquaiuUd With the rt-gu allons, a. ? on h?8 promise to seek work immediately, i.ib fine was remitted. He was warned, h wev.r, that ir h0 waa everbrongbt np again for the same offence, ho would bo nevwtly dealt with. A whito man was brought up for spitting on the dress of a colored woman, but no wituea? appoar ing againBt him, ho was dieohargcd. A vorv ignorant darhoy brought a charge against a much smarter follow of his own color for etoal iug his clothes and monny. He Btated cloarly enough wliat ho had lost, and ho.v ho had lost it, hut his idea of tho timo was cxtromuly muddlod. He eaid that it was last sumiuor about a munth ago. Tho truth of the story Bccnud to bo that the prisoner had borrowed the clothos ami money of tho witness without leave, but that afterwards tho wUdosb hud consouted to tho loan. Tho clothos had been returned much tho worso for wear, but the iuouey had not been returned at all. Tho blank look of disappointment and wonder on tho prosecutbr'B fico when ho was told that his action should be on tho civil and not the criminal sido, was ludicrous in tho extrome. Mayok's Court, Wcdnosdcy Morning.?A shock ingly bad looking Dutchman was fined ?20 for a theft, and ordered, in caso of default, to bo turned over to a Magistrate. A man, for outrageous conduct, waB turnod ovor to a Magistrate. A sailor, with a complexion dark by nature, darker by tho sun, and darker still by dirt, was fined $5 for lying down drunk on tho sidewalk. BUSINESS NOTICES. Auction Sales Tltla Day.
