AN ORDINANCE Providing for an Assessment Upon Abutting Property Owners for the Purpose of Paying for Permanent Improvements on Streets and Sidewalks, and Providing for the Marnier of Payment of Such Assessments. T>E it Ordained by the Mayor and Aldermen, constituting the Town Council of the Town of York: Section 1. An election having been heretofore held on the 30th day of April, 1919, in which the Town of York voted affirmatively upon the question of whether or not the said Town should come under the provisions of an Act entitled, "An Act to Authorize any or all Incorporated Cities and Towns within the State to levy and enforce an Assessment upon Abutting Property Owners for the purpose of paying for permanent improvements on their streets and sidewalks," approved the 18th day of March, A. D., 1919 that it is a fact, and it is hereby recited as such a fact, that two-thirds or more in number of the owners of the property abutting upon the streets and sidewalks, or parts of either, proposed to be improved, have filed with the Town Clerk their written consent for an assessment upon the abutting property owners of not less than one-half of the cost of such Improvements. Section 'i. xnat tne xown 01 iom will by contract hereafter to be let, erect and construct permanent streets and sidewalks upon the following streets and portions thereof in the said town of York, to wit, on that portion of King's Mountain Street begin- , ning at the corporate limits of the Town and running South to the intersection of King's Mountain Street with Lincoln and Congress Streets; and that portion of Lincoln Street beginning at a point where said Street crosses the C. & N.-W. Ry track, and running south to where Lincoln Street intersects with King's Mountain and Congress Streets; on Charlotte Street upon its intersection with Lincoln Street j Eastward to where said street makes I an abrupt turn to the North in the rear j of the property of J. R. Lindsay; on i Wright Avenue from its intersection ! with King's Mountain Street to its in- j tersection with West Madison Street; I on West Madison Street from the in- j tersection of Wright Avenue Eastward j to its intersection with Congress Street, ! or Main Street, and thence on East | Madison Street to a point where this ! Street crosses the C. & N.-W. Railway j track: cn West Liberty Street from a ; point a short distance West of the 1 bounty Jail Eastward to Congress or j Main Street;' and thence on East Liberty Street from Congress Street Eastward to the town limits; and on Colege Street from East Liberty to East Jefferson Street; on West Jefferson Street from the intersection of Cleveland Avenue Eastward to Main or Congress street, and on East Jefferson Street from Main *or Congress Street to the tracks of the Southern Railway Company; on Cleveland Avenue from West Jefferson Street to California Street; on Main or Congress Street from its intersection with Lincoln and King's Mountain Streets Southward to a point a short distance South of the old depot of the C. & N.W. Railway Company, to where a street turns at right angles across the C. & N'.-W. Railway tracks; and on this last named street from Congress Street across the tracks of the C. & N.-W. Railway, to a point where Chester Street turns abruptly to the South. Section 3. To defray in part the cost of the construction of such permanent streets and sidewalks, the owners of property abutting upon such streets, or parts of such streets, are hereby assessed one-half of the cost of such permanent streets and sidewalks, each property owner on each side of said streets to be assessed one-fourth of the cost of such permanent streets, and each property owner be assessed one-half the cost of the permanent sidewalk directly and immediately abutting his property. Section 4. That the property owners hereby assessed and to be assessed shall pay their assessment in the following manner and at the following time, that is to say: One-fifth thereof whenever demanded by the town, and the remaining four-fifths in four equal annual installments (the last four in*-11 a. i j --a In Biaumeius iu oe uuc uuu pn.vauic one, two, three and four years, respectively, from the date upon which the first payment is demanded;) all deferred payments to bear interest at a rate not exceeding seven per cent per annum, payable annually; with the privilege to the assessed property owner of paying his entire assessment, or any part thereof, at any time before the same is due hereunder. Section 5. That the amounts of money raised by such assessments, together with the amounts added thereto by the Town of York, shall constitute and be kept as a separate fund, and shall be used only for the purpose of constructing permanent streets and sicewalks in the Town of York. Section 6. That the assessments so laid shall constitute and be a lien upon the property so assessed, and the payment of said assessment may be en forced as the payment of town taxes are now enforced, provided such assessment shall be entered in a book kept by the Town Clerk, to be entitled "Assessment Liens", stating the names of the owners, the location of the property, and the amount of the assessment, and the time or times of payment. And provided further, that such liens shall continue from the date of entry on such book until the expiration of five years from the date when final payment is due and payable, unless sooner paid. Upon default in the payment of any installment or deferred portion of any assessment, at the time and in accordance with the terms and conditions fixed by this Ordinance, the total amount of such assessment then unpaid (including deferred installments and interest) shall immediately become due and collectible as Town Taxes are collected, and with all the costs and penalties as are now provided for the payment of Town Taxes. Section 7. It shall be the duty of the Town Clerk to make entry of satish ctious on such "Assessment Liens" Book as soon as full payment is macie, and the lien shall be thereby extinguished. provided that all payments made upon such assessments shall be duly credited on said "Assessment Liens" Book kept open for public inspection. that the amount due on such assessment may be shown at any and all times. Section 8.
