Plaintiffs consider th Southern railroad and the South Caro lina and Georgia railroad corapetinj lines, and they so allege and hope t prove it. Columbia correspondence News an< Courier, 16th : Every since the dis pensary law went into effect in thi state, liquors shipped into the stat from another state, C. 0. D., by ex press, have been considered contrabani and the constables have always beei instructed to seize all such shipments This course has been based on the as sumption that the payment of the C O. D. charges amounted to a sale o liquor in this state, and was, therefore a violation of the state dispensary law Under this assumption no end of seiz ures have been made in the past, auc the express company came to thai point that it refused to take shipment! of liquor C. O. D. Recently, however the Southern Express company har the matter referred to the governor foi legal investigation. The governor re ferred it to the office of the attorney general, and today the assistant attor ney general filed with the governor ar opinion that holds that C. 0. D. ship ments are within the dispensary law and shows that the assumption hereto fore to the contrary has been withoul warrant of law. Water Rights in Spartanburg. Spartanburg correspondence New! Courier, 14ih : Yesterday the couri was engaged in deciding a very import ant case. There was not so much money involed, but the principle madt it interesting. For years people bav< been going ahead obstructing streams and building dams, and about the onlj damage claimed in the past has beet caused by ponds producing sickness 01 flooding lands above. But with th( multiplication of factories other nict questions arise. Last year a damage case was brought against the Carpel Factory, at Guffney, because their dyes polluted streams for several miles below. The case in point yesterday was this: The White Brothers have mills, a cotton gin and ice factory on Lawson's Fork, near town. The Whitney Cotton mill is about two or three miles above it. Wheu first built the Whitney dam was a wooden structure with considerable leaking. It was claimed that the natural flow and volume of water was kept up even when the gate was closed. But a few years ago a water-tight stone dam was built at Whitney. During the day the water would fall below the top of the dam and when the gate was shut at nighi the stream below was much reduced in volume. White Brothers claimed in consequence of this that they could not run their ice plant aud cotton gin at night for want of water, and that they could not start up early iu the day, foi bo YVhitnov water did not reach them for one or two hours after the gates were lifted. R. K. Carson represented the plaintiffs, and Simpson & Bomar the defendants. After much testimony and able arguments the jury gave a verdict for the defendant. This case may go up to the supreme court This subjecr of riparian rights and privileges is an interesting one. Some farmers were in town Monday, looking up the law as to obtruding the migration of fish on small streams that ran through several farms. They claimed that persons below them had entirely obstructed the streams with traps and wire netting, so that a minnow could not pass. AT THE CHURCHES. NOTICE is hereby given to the public that the contracts for carrying the mail on all of the STAR ROUTES of the State of South Carolina, takingeffect July 1, 1900, provide that those who so desire may have the mail that is addressed to them, delivered by the carriers into boxes along the lines of the several routes. Any person living on or near any Star Route in the State, named who desires his * * 1 - lino nf tho mail deposited in a uua uu >u? ?ue u. ?v route by the-carrier on said route, may provide and erect a suitable box on the roadside, located in such a manner as to be reached as conveniently as practicable by the carrier, and such persons shall file with the posmaster at the postotfice to which bis mail is addressed (which shall be one of the two postoffices 011 the route on either side of and next to the box) a request in writing for the delivery of his mail to the carrier on the rcJUte for deposit in said mail box, at the risk of the addressee. It shall be the duty of the postmaster at every postofiioe, upon a written order from from any person living on or near the Star Koute, to deliver to the proper mail carrier for that route, any mail matter, except registered mail, with instructions as to the proper mail box into which said mail matter shall be deposited ; but .10 mail matter so delivered to a carrier for deposit shall be carried past another postotfice on the route before deposited in a mail box. The carrier on the Star Route will be required to receive from any postmaster on the route any mail matter that may be intrusted to him, outside of the usual mail bag, and shall carry such mail matter to and deposit it in the proper boxes placed on the line of the route for this purpose; ' such service by the carrier to be without charge to the addressees. The mail carriers must be able to read and write the English language and be of ;?taiiin>?iwA to nronerly handle auiuuicui' iubviu^v..v? , ' and deposit the mail for boxes along tbo routes. ) The law provides that every carrier of the mail shall receive any mail matter presented to him, if properly prepaid by stamps, and deliver the same lor mailing at the next postotlice at which be arrives; but that no fees shall be allowed hiin therefor.
