facts in the case, and how much alcohol there really was iu the malt exv tracts, and whether or not it was a beverage. Dr. Burney gave a written statement as to the value of alcohol iu malt extracts submitted to him, and from the tenor of bis letter did not seem to thiuk there was much in the extract as a beverage. He made the suggestion that the malt extracts were sold at about twenty-five cents a bottle, equal to about an ordinary size bottle of beer, aud that the price wae against the sale of the malt, as against ordinary beer, except where the malt was used for medical purposes, and that as a general ining tne mail, was drunk by woiueD. These are really ? the facts of the case. Some soda fountains are selliug the malt extract, and in those cases, which are very rare, the extract may be called a beverage, but it would be a hard matter to say that a persou could get drunk from malt extract. The chances are that the drinker would get gorged of the drink before the state of intoxication would be reached. The law simply says that it shall be unlawful to sell any drink "which contains alcohol, and is used as a beverage." The whole question hinges on the beverage feature, and it does not appear that any rumpus is being raised about the matter. Those druggists who have construed that the tonics are not alcoholic, as prohibited by law, are go^ ing right ahead selling the goods. Ready to Call For Volunteers. A Washington correspondent of The Herald quotes an influential member of the cabinet as making the following statement: "The slightest intimation from General Otis that be wants moj;e troops in addition to those he now has with him and those who are to be sent to him under the recent order, will be followed by a prompt call for volunteers. There will be no further parleying with Aguinaldo and his followers, and do letup in the aggressive campaign which General Otis is conducting. "The presideut stands ready to call for as'many volunteers as will be necessary to subdue the Filipiuos and there is every reason to believe that he can eecure without delay all the volunteers be may call for. This is the situation so far as the administration is concerned and it is unfair and unjust to charge the president with a want of aggressiveness in dealing with this subject." Injunction Against Negroes. The striking union coal miners appear to have temporarily stopped the importation of southern Negroes by the mine operators, says a Pittsburg, Kansas, dispatch of Sunday. The hearing of the injunction cases brought by the strikers to prevent the importation of miners from other states has been 4 postponed until June 24. The miners set up that the Negroes are criminals and affected with contagious diseases, and that their coming would be a menace to the health of the community, good order and public health.
