in making the levy upon the property of Henry Culp, was due to the instructions of the plaintiff. The Judge in his charge instructed the jury to render a verdict in favor of the plaintiff, which was done to the amount of $1,486. The plaintiff was represented by .J. J. Hemphill, Esq., and the defendant by C. S. Brice, Esq. Thursday afternoon, and the greater part of Friday, were consumed in the trial of the case of the Cheraw and Chester Railroad Company w. R. I. White, who, in 1873, subscribed one thousand dollars to the capital stock of the Cheraw and Chester Railroad Company, but erased his name while the subscription paper was in his possession, and before it was sent to the railroad officials. The Railroad Company also claimed that the defendant was an agent of the Company, and to prove this, several witBesseB were placed upon the stand, who testified that the defendant had come to them, and solicited subscriptions from them in behalf of the road. Moreover, the testimony revealed the fact that a notice of his agency for the Company ap peared for three consecutive issues in me Chester Reporter. To rebut this testimony, the defendant claimed that he had never seen this notice, and produced witnesses who swore that while the defendant had solicited subscriptions for the Company, he had not done so in the capacity of an agent. The presiding Judge, in his charge, instructed the jury that the turning point of the case rested upon the relationship the defendant bore to the Compa. ny. If he was not an agent, he had the right to erase his name from the subscription list; if he was an agent, he had no such right. The jury found in favor of the Company for the amount of something over eleven hundred dollars, which was the amount subscribed, with interest up, to the present time. The Railroad Company was represented by J. J. Hemphill, Esq., and C. S. Brice, Esq. ; the defendant by Messrs. Patterson and Gaston. When this case had closed, his Honor discharged the juries. The Court was engaged Friday afternoon and Saturday in passing orders, and attending to such business as did not require the presence of juries. On Saturday night the Court adjourned sine die. Rev. Mr. Kelly preached on yesterday at the Methodist Church, and Rev. Mr. Trenholra at the Associate Reformed Church. Gen. W. A. Walker, member of the committee to examine the bonded indebtedness of the State, returned to Columbia last evening. He has been at home for two weeks in attendance upon the Court. The General discbarges his Senatorial duties with credit to himself and satisfaction to his constituents. Adjutant General Moise was in town 011 Thursday, and inspected the Chester Rifle Club, the Chester Sabre Club, and an infantry company from Blackstocks, commanded by Captain Thomas Brice. These companies passed a creditable inspection. The Adjutant-General made a brief address, which was enthusiastically received. He directed the officers of the Sabre Club and the Blackstocks Company to make requisitions upon the State forsuch armsand equipments as they needed, and these would immediately be furnished. The Rifle Club were so much pleased and encouraged with the Adjutant General's opinion of their soldierly qualities, that they have determined to compete for the prize to be given to the best drilled company iu the State outside of Charleston and Columbia. They will devote several evenings of every week to drilling. Qui. ?XTBA SESSION^ OF CONGRESS. Congress convened in extra session on Monday. The vote for Speaker of the House stood, Randall, 149; Garfield, 132. On taking the chair, Mr. Randall said : Gentlemen of the House of Representatives : Elevated for the second time by your generosity, to the diguity of Speaker of this House, I thank you with a grateful heart. I shall endeavor, with even temper and rigid firmness, to perform the duties of the office, aud respond adequately to the confidence reposed in me, by conforming my action to the clearly expressed will of the House. Yet, fully realizing the delicacy and difficulty of the position, I solicit your advice and assistance, feeling sure of your forbearance and indulgence. We meet under circumstances impe riously demanding that all considerations of class, section and party shall be subordinated to the loftier aud more patriotic object of doing what is best for the whole country and all its people. Since the adjournment, an administiation has been inducted into office which is obeyed as the actual government, regardless of the grave events which marked its birth, and this House, animated by a spirit of true patriotism, desiring first the public tranquility, under the law, will frankly approve any sincere and permanent policy looking to complete pacification and the advancement of all constitutional methods for the general public welfare, and it should be your sacred duty to provide legislation which will render impossible a repetition of the wrongs which have occurred aud of the dangers which threatened U8. ^ , I assume you will take no step backward in the work of retrenchment and reform, so auspiciously begun by the last House under ? ?nlan r\f rorlnnfinn nf tv umiuic auu UOUUIW piou Wl IVUUVMVM v. the expenses of the government. It is certain that a stili greater reduction can be made without impairing the efficiency of the administration. To have an honest administration, it should be frugal. Never before was it more urgent than now. With general financial distress and labor depressed, when the iron rule of hard necessity darkens every house in the land, extravagance on the part of the people's servants would be an unpardonable crime. It is partly because this wholesome policy was so faithfully carried out, that I am permitted to speak from this place. Invoking for our deliberations tolerance of opinion, which secures harmonious action ; right and clear judgment, which purifies legislation ; and hoping the mutual confidence and respect which subsist between the House and its presiding officer, I am now ready to take the oath prescribed by law. Objections were made to the swearing in of Cain aud Rainey, of South Carolina; Darrel, Elam and Robertson, of Louisiana, and Pacheco, of California, aud those members were requested to stand aside.
