If Lilley's testimony is essential for i the ends of justice in a case of great public c importance, I must not prevent it from com- i irteibrth. On the other hand, I mast not aid 1 in wfy effect to purchase or manufacture evi- f dence against any one. t The official statement made to me by the i solicitor and Mr. Brice is entitled to great t weight, and after mature consideration and 1 consultation, I conclude that it is my duty to c grant the pardon on certain conditions, name- i ly: First. I shall insert in the pardon the ' condition that Lilley shall submit himself to j full examination before the court on the trial, ; and that the pardon shall take effect only on your certificate that he has given evidence, m your judgment, fully and in good faith. Sec- : ond. I shall place the pardon in your hands, to be offered or not to Lilley, as you in your c judgment shall deem most conducive to the , ends of justice. I know that you will appreciate this res- 1 ponsibility and will act discreetly. You have j power to use or withhold the pardon as your l judgment and official duty shall dictate. 2 Very respectfully, your obedient servant, D. H. The Governor called thd attention of your i correspondent to the fact that the constitution 1 gives the Executive the power to grant par- c aons after conviction, on such terms and un- 5 der such restrictions as he shall think proper. 1 The request for the pardon of Lilley was not based at all on the ground of his incompeten- ] cy, and that question was not considered. The ground was that Lilley refused to give the testimony set forth in the application of Messrs. Mackey and Brice unless he was par- : doned. The question of his competency without a pardon was a question solely for the court. The Governor was not willing to grant c a pardon unless he was convinced of Lilley's ^ good faith in his offer to give testimony, me only way to guard against deception on this Eoint was to grant a pardon on condition that e gave testimony in good faith. It was necessary also to guard any inducement to Lilley to give any particular testimony for or against the defendant?hence the special form of the condition inserted in the pardon. Hence, also, the pardon was entrusted to the presiding judge who could not be imagined to have any bias or motive except public justice. It may be added that Judge Northrop informs > the Governor that he regards his action as t characterized by great prudence and wisdom, * and especially as vindicated by Lilley's final ] declaration in open court that, if pardoned, i he would not testify, thus showing that his * real motive in treating with the solicitor and ( counsel for the State had been to secure his * pardon and then to refuse to testify. Lilley , was taken to Chester on a habeas corpus ad j testificandum issued by the court at Chester, a matter of which the Governor had no knowl- f edge and over which he had no control. . f.
