nod, 007 territory is sufficient to, sajjport one of seven millions, if properly distributed in manufacturers, commerce and agriculture. It beooraes your urgent duty, gentlemen, to mate immediate provision for the protection and government of the freedmen and 1 colored people who have been so suddenly released frotfi slavery in their ignorance and i dostitntion. This is alike due to humanity k and justice, as well m the imperative neoeeW sitiea of eooipty. The negro has lost the [ proteotion of his master, and be most now be protected by the law. This is expected of yon by tbe President and the Federal Congress, and will remote all pretence for military rule in tbe State, as well as facilitate yonr speedy restoration to the Union and self-government. The negro is innooent oi all that he has gained and all that yon have lost, and he is entitled to yonr sympathy and kindness, your proteotion and guidance. The Convention ordered the Provisional Governor to appoint a Commission for the purpose of preparing and submitting to the for their addition, a code ol laws for the protection and government of the frcedmeo sod colored perrons. Io obe I dienoe to their order I have appointed Jadge WardJaw and Mr. Bart, two of the most eminent jurists in the State, to compose this Commission. The; will, in due time, report to ;oo the resnlt of their labors. The Convention also authorised the Legislature L to establish a Court io each District for the W trial of all oases in which freedoms are concerned. It becomes ;oor duty to see tbat that Courts are organised. The.election of Presidential electors has heretofore been made b; tbe Legislature of Sooth Carolina, contrary'to tbe trne intent and meaning of the Federal Constitution, and against tbe usage in all the other States. An Ordinance was passed b; the Convention, expressive of their judgment in regard to this matter, and directed the Provisional Governor to communicate tMl Ordinance to the Legislature at its first set sion. In obedienoe to their order, I herewith .vend yon a oopy of the Ordinance, which you will, at oaoe, carry into effect, by providing a proper mode of electing electors of President and Vioe- President by the people. The eleotion of Members of Congress should be provided for at as early a day as possible. It is a matter of tbe highest importance that our Representatives in Congress should be in Washington, ready t? I take their seats, on tbe first Monday in De camber. By Act of Congress, passed March, 1863, it is made the doty of the Clerk of the previous House of Representatives to "make a roll* of the Representatives elect, and plaoe thereon the names of all persons, and snob persons only, whose credentials show that they were regularly eleoted in accordance with the laws of theii States respectively, or the laws of the United States." It is therefore the imperative duty of the Clerk to oall the rolh of the members of the Southern States/whose ere dentials have been exhibited to him, and shown that they were regularly elected He has no more right, under this Act, to exolade the members elect from South Carolina than he has to exclude those from Mseaohasetts. The Federal authorities have maintained that the Union never was dissolved, and that the Southern States, have always been, and still are, members of that Union. In July, 1862, Congress passed an Aet prescribing an. oath of offioe for all peraoos to take who were eleoted or ap pointed to any offioe of honor or profit under the Government of the United States. This oath requires the party to .swear that he has never borne arms against the United States; that be baa never held or sought . offioe under any power inimioal to the United States'; that he has given no aid, oonusel or oonntenanoe to persons in hostility tc the United States; and that be has not yielded a volotary support to any authority hostile to the United States. If this oath is to b? applied to members of Cogress, it will, of ooorse, exolude all from South Carolina It may, with truth, be said, that no man in Sonth Carolina oan take it without committing perjury. Bat the Constitution of the United States prescribes an oath for members of Congress to take, and they cannot be required to take any other oath coostitutionally. There may have been some show of propriety for exacting this oath when it was enaoted, amidst the war beI tween the Southern States and the United States; but there can be none now, unless ii be for the purpose of excluding the South ern people from all ofiioe within their res pective States, and still holding those State; in military subjection. I know that this ii not the policy of the President, and I cannot believe that it will be the avowed policy of the Federal Congress. If the Southerc members are present when the roll is called by States, they will take part in the organisation of the House, and may vote agaioal the oath being tendered to the members when they are sworn. ? The Convention divided the State int< four Congressional Districts, wbieb you wil respect and reodgifigft m elentinn Uintrirta It will"be your duty, also, at some convenient and proper time, during your extrt session, to elect two United States Senators, to represent the State of Sooth Caro lioa in the Senate of the United States.? There are now two vaoanoies in that bodj from Sooth Carolina. In the organizatioi ? .1 . o ... .l_ a... 01 Cu9 senate ui lue uuircu otaies mu * three classes, the Senators from Sooth Car olioa were drawn in the seoond and thlrc classes. The second-class seat for Sootl Carolina became vaoant on the third o Marob, 1865, ajd yoar election to fill tha vacancy will be six years from that date.? The third-class seat became vacant on th< tbird of March, 1861, and your electior will be for the unexpired term of that va oanoy, which will be till the third of March 1867. The sobjeot of finance is one of gTea embarassment ana serious aimouity at tm time in South Carolina, and will reqniri great wisdom and sagacity in your legisla tiou. The people are in a moat deatitoti condition, without money, and without tb< means of paying their taxes. Their goli and silver were exported during the war a a species of oommeree. The State bank are all broken, and their bills have cesser to circulate. The Confederate money, will wbioh the oouutry was inundated, is utterl; worthless. The Federal currency is inao f oesaible to our people. Their cotton hai . . - > - been destroyed, sod their provisions con' earned by the armies, end they have nothing to procure money with. Older these cironroetanoes. it would be well for you to : , consider whether or pot it is possible to defray the necessary expenses of the State by : * - n?. A - A issuing ana seuing. owe oonas, so u w avoid levying any tax daring the ensuing , year. The present indebtedness- of the State is not Urge, and her oredit ought to , be such as to secure the sale of her bonds , i at fair prices. If 70a conclude to raise , money in this way, yon ought to include the payment of the direct tax, and which ( 1 South Carolina now owes the United States, < and whioh her citizens will soon be called ; upon to pay. ( [ It is important that the courts of justice , : in this State should he once more folly 1 : opened, civil Uw restored and properly ad- ( ministered. This cannot be. done till you , fill the several vacancies on the beuoh You will have to eleet a Chief Jnstice of the ' i State, two law Judges and one Chanoellor. j i Opening onr oonrts, and the administration j of oivil justice onoe more, would' have a. , : most salutary influence on sooiety, and do j more than anything else to preserve the ( peace and quiet of the State. We have e been living without law long enough, and | have a offered enough from lawless violence, j The Act to prevent the collection of g debts, known xs the stay law, was wholly ( unnecessary at the time it was jpassed, bat < is now a matter of prime necessity to the j community. This Aot should be (Motioned, ; with permission, however, to collect the in* terests on debts doe. There are many > v widows and minor children whose sole ? subsistence depends on the payment of in- < ; terests doe them on their estates. The re-organisation of the militia is a 4 ' measure of the highest importance, under ' i existing circumstances. I have received "i ; information from the Secretary of State at j i Washington, that as soon as our State Gov[ eminent is organised, all the Eederal troops f would be withdrawn from South Carolina. \ We must then rely on the militia for the , protection of the State against insurrection f and domestio violeqoe. It is a' matter of < serious consideration, however, whether we | should not desire to retain, tor tbe present, t a portion of tbe Federal troops in the State, i The freedmen and colored people look to i these troops as their friends and protectors, ; and would be maoh less likely to have any , collision with them than the militia The i colored -garrisons, which were at one time stationed throughout the country, have done ( 1 infinite misobief, by induoing the negroes to i believe that ail the lands of their former owners were to be divided out amongst them. This hss made them discontented ' and unwilling to make contracts for the > ensuing year. In many portions of the ' State, there are serious apprehensions of . - disturbance at the beginning of the next ' year. Strong garrisons ongbt to be continued in Charleston, Beanfort and Qcorge- ' i town, wbete there is snob a preponderance ( of tbe negro population, not these garri- i I sons should not be'permitted to exercise 1 . any civil jurisdiction, sod should' be soberdioate to civil law. Otherwise, their pros- < encc would be productive of m/vre mischief than good. You will take such action in | this matter as in your judgment shall seem t best for tbe State. i ! * * * # * * i As soon as the Convention adjourned, 1 j oommunicated to the President and Secure I tary of State oopiesof the new Constitution ( of South Carolina. 1 have the pleasure of informing you that President Johnson has j expressed to me bis gratification at the a; mendments made in our Constitution, and < i his confident- hope that we should soou be, , i onoe more, "a united, happy and prosperous people, forgetting the past, and looking only to the future welfare of our common . > country." ' There is one matter of embarassmeDt in i your legislation, under tbe new Coostitu- , 1 tion, which I think my doty to bring to J ypur notice. The Constitutional Governor i will not, and oanootbe inaugurated,* till the t first week of your regular session. And ' yet the Constitution requires all Acts to be j presented to the Governor for his signature * i .** L . ri .a t - I ii D6 aoes not approve mem ne most re r torn them with his objections; and then, [ to become a law, they most be passed by a , majority of the whole representation of both Houses. Although the State Oonven tion acknowledged the authority and exis- [ tenee of the Provisional Governor by sev eral of thefr ordinances, yet they omitted - to anthorize him to act as Governor till the - inauguration of the Governor elect. All j ' your Aots should, therefore, be passed by a * majority of the whole representation of - both Houses, unless, you are disposed to 1 ' recognize the Provisional Governor as Gov- ( > ernor of the State. But even vfith this j I recognition, I think it would be safe to see - that your Acts are passed by the constitn tional majority required, in the absence of 1 the approval of the Governor.* This will j place beyoqd controversy any Aots which ] > you may see proper to pass at your extra I session, in the absence of your uew eleoted .Constitutional Governor. * * * * * * i In conclusion," I would urge you, gentle- | . men, to look only to the future in your leg. islation, and forget, so far as yon can, the - past. There is muoh to hope fpr and live j for, yet, in Soath Carolina. rfte should , i congratulate ourselves and the oountry that 1 > oivil war has ceased, and peaoe is restored (q the land. JNo longer are oar oitizens to 1 bo forced from theft homes and families i and offered a bloody sacrifice on the field of f battle. No longer is oar beloved State to t be ravaged and desolated, and oar towns - and villages committed to the flames A 3 mercifal Providenoe has once more blessed i oar land with an abundant crop, and no i - longer have we any apprehensions of want , and starvation. We are in the enjoyment of health. Oar yoang men, noble and galt lant soldiers, are peaceably resuming their s former vooations, and exerting themselves e in restoring the State to ber wonted pros- ! - parity and happiness. No civil broils or e deadly feads are disgracing our people as e in other States. We have no political di? i visions. Sonth Carolina presented a uuit j s after ber aot of seoession, and she is now s united as one man in returning to the Union;' 1 and will be as trne and lbval to her nHothtad - I * " * I D """ i faith as any State north of Mason's and j DUon's line. In this respeot, there is no . difference between former secessionists and s old Union men. They all have equally, at ".. wfcjf' * * It/ :' t . heart, the peace, honor, glory and prosperity of the American Republic. And I earneedy pay that all yoar legislation and deliberations may tend to this great purpose, under the guidance and protection of Almighty God. B. F. PERRY. ... North Carolina.
