particulars of a high handed proceed.

the oane it failed to find a true bill
against Bailey. Subsequent to this
dooi-ion of the grand Jury, and when
Bailey haod been virtually acquitted
of the crnme alleged against him, lie
was met on the highway by Smith
and killed--Smith claiming to act un
der the mandate whiIch had been is
bued to him by the acting Governor.
'Tho Grand Jury at the September
term, found a true bill, as they were
bound to do, against Smith for the
killiig of Bailey. Tho acting Gover
nor was thus a partner to the criic.
The murder of an innocent man was
committed under the hadow of his
usurped authority.
But bad as it was, his conduct in
this particular was not the worst part
of it. On the eighteenth of Juno last
even before the Grand Jury has in.
vest igated the case of Smith, Powers
pardoned him, thus usurping the pre
rogativo of the Judiciary before it
bad acted upon the caso of the mur
doror-prostituting the pardoning
power-and violating the constitution
which forbids either of tho three de.
partnicuts to exercise the functions
which belongs to the others. His
duplicity con.-isted in the fact that in
a correspondence with the counsel for
the proscoution of Smith, lie studi.
ously concealed the fact he had par
doned him, and, as stated by the Re.
publican (doubtless on authority that
Powers will not deny), encouraged
the belief that lie had not pardoned
him, anld would not without giving
both sides a hearing-the accused
all the while carrying the Executive
deliverance from the clutches of the
law in his pocket.
We submit that nothing but the
annals of carpet bag misrule can fur
nish a parallel to this outrageous pro.
