II a county neglect to repair any of tho highways or bridges which, by law, it is obliged to keep in repair, or neglect, to diAa ' the sumo safe and con venient, Much County shall bo liable to indictment and fine, as tho Court iu its discretion may order. The fine imposed in such case shall bo certified to the CountyJJCommissioners by tho Clerk of tho Court, and they shall proceed to coL lect tho same from the Surveyor or Sur veyors of the highway district or districts churged by this Act with the duty of Superintending and keeping said high way or highways iu repair; tho sum, when collected, shall be laid out iu the repair of highways and bridges in the County. Sec. 1G. Each person who shall furn ish work on the highways in payment of bis highway tax, assessed by the County Commissioners, shall be allowed, for a good hand, at the rule of ten cents for each hour. It shall be the duty of the Highway Surveyor of the district to make such allowance for the use of teams, carriages and tools, as shall be equitable and just. Sec. 17. That all able-bodied male persons between tho ages of eighteen and forty-five years shall be liable, an nually, to perform on the public high ways and roads, not less than three, und not more than five days' labor, under the direction of the highway sur veyor of their district: Provided, Thnt if any person, being warned to work upon the highways, shall pay to the highway surveyr, in the district in which he may res; la, the sum of one dollar per day for each day required, the same shall be received iu lieu of such labor, and shall be applied by the said highway surveyor to the construction and repair of the highways and roads in tho district. And should any person refuse either to work on tho highways and roads or to pay the fine imposed ns n penalty for refusing to work upon the highways and roads, according to the direction of an'nl commissioners, the said persons shall be deemed guilty of a mis demeanor, and, on conviction thereof, punished by imprisonment in tho coun ty jail for the same, for a term not ex cccding thirty days. Sec. 18. Each highway surveyor pro vided foi iu this act shall receive fifteen cents per hour for the time nccessaily employed in discharging the duties re quired by this net: Provided, That he shall not receive exceeding fifty dollars per nnnutn, except iu extraordinary cases, when tho County Commissioners may. in thair discretion, allow a greater sum, and, in no event, more than seven ty-five dollars. Sec. 19. The County Commissioners shall, for tho yeur 1871, levy no tax under thi* act but that provided for in sections 7, but shall set apart a portion of the tax heretofore authorized to be raised for county purposes, and have the some laid out und expended under the provisions of this act.
