Section 1. Bo it onactedby the Sen ate and House of Representatives of the State of South Carolina, now met and sitting in General assembly and by the authority cf the same, That if any per son shall assault ur iutimidato any citi zen because of political opinions?or the exercise of political rights and privile ges guaranteed to every citizen of tho United States by tho Constitution and laws thereto!', or by tho Constitution and ' laws cf this State, or, for such reason, discharge such oitizens from employ ment or occupation, or cjcot such citi ten from rented house or laud or other property, such persou shall be deemed guilty of a misdemeanor, and, on con viction thereof, bo fined not less than fifty or move than one thousand dollars, or ho imprisoned not less than three months or more than one year, or both, at the discretion of tho Court. Sec. 2. That if any two or more por " sons shall band or conspire together, or go in diBguise upou the public highway or upon the premises of another, with intent to injure, oppress, or violate the person or property of any citizen, be cause of his political opinion or his es repression or exercise of tho samo, or shall attempt, by meaus, measures or ucts, to hinder, provcut or obstruct any citizen in the free exercise and enjoyment of any right or privilege secured to him by the Constitution and laws of tho Uuited States, or by tho Constitution and laws of this State, such persons shall be deemed guilty of a felony, uud, on con vietion thereof, be fined not less than one hundred or more than two thousaud dollars, or be imprisoucd not less than six months or more thau three years, or botn,'-at the dtscrctian of the court; and shall thereafter be ineligible to and dis abled from holding auy office of honor, trust or profit in this Stato. Seo. 3. That if, in violating any of the provisions of this .Act, any other crime, misdemeanor or fclouy shall be committed, tho offender or offenders shall, on conviction thereof, be subjected to such punishment for tho same as is attached to such crimo, misdemcunor and folony by the existing laws of this State. 2kc. 4. That the Sheriffs, constables and other officers in tho several circuits or counties vested with powers of arrest ing, imyrisoning and bailing offenders against the laws of this State, be, and axe hereby, specially authorized and re quired to institute proceedings against all and every person and persons who shall violate any of the provisions of this Act, and cause him and them to be arrested, imprisoned or bailed, as the may require, for a trial before such court as shall have jurisdiction of the offence. Sec: 5. That tho Circuit Courts of this State, within their respective cir cuits, in the counties of which tho cir cuits are respectfully composed, shall haye cognizance of all offeuces commit ted against the provisrons of this Act, and of all other causes arisiug under this act. Sec 6. That it shall be the duty of shcriffi, constables, and other officers who may be specially empowered, to obey and-exocute all warrants and other prJKiires issued uudet the prov'sious of this act to them directed; and should anJBaieriff, coustablc, or other officer spe?jHy empowered, refuse to receive auoa&warraut or other process, when tenured to him, or neglect or refuse to recijraUsuoh warrant or other process, wheHt'iltdered to him, or neglect or reftfitp execute the same, he shall, on conOtfon thereof, be tibed in tho sum of fifte* hundred dollars, to the use of the citiZOTS deprived of the rights secured by the provisions of this Act, or be im prisoned iu the County jail, in the dis cretiol of the Court. And the better to ennbldltho sheriffs, constables, and other officers ^specially empowered, to execute all such warrants and other processes as may be directed to them, they shall have authority to summon and cull to their aid the by-slanders or ;:o$se comitattu of the proper county; and uli pcusous refus ing to^\>bey the summons or cull of the offic?rs thus empowered shall be deemed ?-"-.> victio^thoreof, be punished. And such warrants aud other processes shall run and bo executed by said officers any where within the circuit or couuty in which* they are issuod. Six. 7. That auy person who shall I hiridevp proven t or obstruct any officer or other^j^rgph charged with the execution of any warrant or other process issued under tho provisions of this Act, in ar resting any person for whose apprehen sion $?cW!warrant or other process may have been issued, or shall rcscuu, or at tempt to rescue, such person from tho custody of tho officer or person or per sons lawfully assisting him, as aforesaid, or shtdj aid, abet or assist any person so arrest<d,i?fl aforesaid, directly or indi rectly, to cscapo from the custody of tho officeHorton or persons assisting him, as aforesaid, or shall harbor or conceal any person for whose arrest a warrant or other^roc-ess shall have been issued, so as to fir*vfmt:hh dweevory and arrest, after fltftido or knowledge ,ot tho i'uet of i the issuing ol sueh warrant Olhor' process, shall, on conviction for cither of eaid offences, bo subject to a fine of not loss than fifty, nor more than ono thou sand dollars, or imprisonment of not .less than three mouths, nor more than ono year, or both, at tho discretion of the Court having jurisdiction. Sec 8. That any citizen who shall be hindered, prevented or obstructedtcd iu tho exercise of tho rights and privileges i secured to him by tho Constitution aud laws of tho Uuitod States, or by tho Constitution and laws of this Stute, or shall bo injured in his person.or property because of his exercise of tho satuo, may claim and prosecute the County in whieh tho offence shall bo committed for any du mages ho shall sustain thereby, and the said county shall bo responsible for tho payment of such damages a? the court may award, which shall be paid by the county treasurer of srioh couuty on a warraut drawn by the county cotnmis sioners thereof; whieh warraut shall be drawn by tho county commissioners as soon us a certified copy of the judgment roll is delivered them for file iu their office. Sec. 0. In all cases where any dwell iug house, building, or any propcitv, rtal or personal, shall bo destroyed in consequence of any mob or riot, it shall bo lawful for the person or persons own ing or interested iu such property to bring suits against tho oounty iu which such property was situated and being, for tho recovery of such damages as ho or they may have sustained bv reason of tho destruction thereof; at tho amount which shall bo recovered iu said action shall bo paid iu tho tuauncr provided by Section 8 of this act. Sec. 10. That no person or per?. n shall bo entitled to tho recovery of su:h j damages if it shall appear that the de struction of his or their property was caused by his or their illegal conduct, nor unless it shall appear that he or they upon kuowledge had of the intention or attempt to destroy his or their property, or to collo2t a mob for that purpose, and, sufficient tituo intervening, gavo notice thereof to constable, sheriff, or trial jus tice or justice of the peace of the coun ty in which such property was situated andbciug; and it shall Lothe duty of such constable, shoriff, trial justice or justice of the pence, upon receipt of suoh notice, to take all legal means necessary for the protection of such property as attacked, or threatened to be attacked ; and, if such constable, sheriff, trial jus tice, or justice of the peace, upon receipt of such uotico, or upon knowledge of such int.-tit ion or attempt to destroy such property, in any wise received, shall neg lect or refuse to perform his duty in the premises, ho or they so neglecting or re fusing shall bo liable for the damages done to such property, to be recovered by action, and shall aLo be deemed guil ty of a misdemeanor in office, and, uu conviction thereof, shall forfeit his com mission. Sec. 11. That uothiug iu this act shall ho constructed to prevent the per son or persous whose property is injured or destroyed from having and maintain* ing his or their actiou against all and every person and persons engaged or par ticipating in said mob or riot, to recover full damages for any injury sustaiued : Provided, however, That no damages shall be recovered by the party injured against any of the said rioters for the Bame injury for which compcusation shall bo made by tho couuty. Sec. 12. That it shall be lawful for the county commissioners of the couuty against which damages shall be recover ed uudcr the provisions of this act to bring suit or suits, iu the uumc of the county, against any auu all persous en gaged, or in any m.tnuer participating iu said mob or riot, aud agaiust auy con stable, sheriff, trial justice, or justice of the peace or other officer charged with tho maintenance of the public peace, who may be liab'e, by neglect of duty, to tho provisions of this act, for the re covery of all damages, costs and expen ses incurred by said couuty, and such suits shall not nbate or fail by reason of too many or too few parties defendant j being named therein. Horbach, M J Hirsch und Oscar R Little, of South Carolina, und their associates or partners, shall havo the full righ*, and aro hereby authorized, to form themselves into a partnership association, to be known un der tho name and style of R II Willougb by, and Company, or such other names as they may now or hereafter ussitme. Sec. 2. That all tho rights of corpora tions known as banks be, and tho same aro hereby, vested in the said firm, for the purpose of loaning out money on in terest, purchasing and mortgaging reul esinte, bovin/ personal properh'' nur) they shall have the same rights and pri vilagcs now enjoyed by tho banking in stitutionn'of the Stato; they shall also have the right to dispose of any nnd all such property, real, personal or mixed, that they may become possessed of, in any manner, nnd on such conditions, as the said firm or association may deem fit and proper and to the advantage of said firm and to promote the interest of said School Fund of tho Stato of South Caro lina. Sec. 3. Bo it further cuacted, That, beforu commenciug business under tho provisions of this A t said firm a'tall pay or cause to be paid, into the hands of tho State Supcrintcnde.it. of Education, the sum of one thousand dollars, (8 1, 000) to be used for tho benefit of the free schools of South Carolina, aud annually thereafter a like amount, for the term of ten years, or so long as said partnership shall ehoose to bo business, it being un derstood and agreed that said payment of ono thousand dollars per annum by said association is the consideration upon which tho privilege of incorporation herein is granted; aud whenever said company, or firm, association, shall fail to pay said consideration, then their right to transact business shall cease, Sec. 4. That the association, company or firm incorporated aud established by t iis A.'t shall have full power, and are hereby authorized, to establish agcucies throughout the State. Sec. 5.
